국내건설공사 클레임사례를 기준한 위험요인 및 대응전략 분석

According to the growth of society, The risk events of construction project have been increased against the past because it is called for variety and complexity. So that, we are recognized, the risk identification and risk response strategy are very important things in the construction project. The existing studies about judicial precedent of claim deal with mainly proving of method which is to search the judicial precedent data, to make a decision of claim and to decide schedule of construction project. Because it dose not deal not deal with judicial precedent of clime as risk management view, however, it is not helpful so much to respond at the risk for the process of construction project to the owner and the contractor. The purpose of this study, therefore, is that it identifies the risk events and set up the risk response strategy, through analysis of judicial precedent of claim as a risk management view.

건설공사의 불확실성은 빈번히 클레임에 노출된다. 대부분의 경우 이러한 클레임에 대한 기본적인 해석은 공사계약서를 기준으로 하게 된다. 이러한 계약서 작성시의 문제는 발주자나 시공자가 부담하여야 하는 계약적 위험(risk)이 어떻게 규정되어 있어야 합리적인 수준인가를 판단하는 것인데 이러한 판단을 위해서는 FIDIC 계약조건과 같이 국제적으로 합리성을 인정받는 표준계약조건을 참고하는 것이 합리적이라 하겠다. 이에 본 연구는 FIDIC 계약조건을 기준으로 국내 공공공사에서 일반적으로 사용하는 공사계약일반조건에 내재되어 있는 불공정, 불합리 조항을 분석하여 세계적 수준에 맞는 공사계약조건을 제시하고자 위험관리의 관점에서 공사 계약조건을 분석하고, 여기서 도출되는 위험요인을 검증하며, 이에 대한 대응방안을 모색함으로써 공사계약일반조건의 위험요인 감소방안을 제시하고자 한다. Construction uncertainties are frequently exposed to the claims. In most cases, an interpretation of the claims is based on the construction contract. Therefore, the key points of contract negotiation are how to fairly distribute the contract risks to the client and contractor. For these, a FIDIC that is considered as an international standard contract form would be a good reference to decide reasonable contract risk distribution. In order to find out any unreasonable and unfair contract clauses at the general conditions of contract applying generally to public construction project in Korea, this study surveys, analyses and evaluates the general conditions of contract based on a FIDIC, and then proposes a risk mitigation methodology to response those clauses' risk factors reasonably.

This study discusses a non-contact optical technique, electronic speckle pattern interferometry, that is well suited for vibration analysis without the need of any contacting. Composite plates must be considered with vibration characteristics but most of piling sequence of composite plates for mechanical design consider tensile characteristics. Although a paper said that fiber direction effect vibration mode shape variation, this problem is not inspected exactly until now. So this paper searches the cause as compared with 3 types of uni-directional composite plates

In recent years, shearogrpahy has significantly improved capabilities in the areas of unbond and<br/> separation detection in tires. Although shearography has many advantages for qualitative evaluation, the<br/> technique remains the problem of quantitative analysis of inside defects, because shearography needs<br/> several effective factors including the amount of shearing, shearing direction and induced load, which<br/> exist as barrier for the quantitative analysis of inside defects. Since the factors are highly dependent on<br/> inspectors skill and also affect the in-situ workability. The factors were optimized and the size of<br/> cracks inside of pipeline and tire has been quantitatively determined.
