「인성교육진흥법」이 제정되어 금년 7월부터 시행되고 있다. 이 연구는 동법의 올바른 해석 과 적용 그리고 향후 개정 과정에 필요한 판단의 준거를 제시하기 위하여 동법의 제정 의미 를 명확히 하는 동시에 동법이 올바로 정착되기 위하여 필요한 과제들을 제안함에 그 목적이 있다. 이를 위하여 인성교육 개념 및 진흥 필요성 등의 논의를 거쳐 동법 및 하위법령이 어 떠한 요구에 터하여 어떻게 입법화되었고 그 과정에서의 쟁점은 무엇이었는가를 분석하였다. 동법의 제정은 유사 입법례를 찾기 쉽지 않은 인성교육 관련 단일법이라는 형식적 특성과 함께 법적 강제력을 빌려서라도 현재의 인성교육에 변화를 가져오고자 하는 국민적 합의의 결과라는 점에서 그 의미를 찾을 수 있다. 한편, 동법은 조성법으로서 법률뿐만 아니라 하위 법령에서도 지나친 상세화는 경계되어야 하며, 동법의 해석과 적용에 있어 교원들과의 충분 한 소통을 통해 그들의 협력과 변화를 유도하되 학교에 과한 부담을 지우지 않도록 하여야 한다. 「The Character Education Promotion Act」 has been enacted and implemented from July 2015. The purpose of this study is to clarify legislative intent of 「The Character Education Promotion Act」 as well as to suggest required tasks to make 「The Character Education Promotion Act」 well established to cast necessary value criterion for the authentic interpretation, application and revision process in the future. In order to accomplish the above purpose of the study, analysis of the meaning of the character education and case studies of foreign countries has been carried out. And then, for what purpose 「The Character Education Promotion Act」 and its lower statues have served, how they have been enacted and what major issues are present during that process haven been analyzed. The research findings and implications of this study are as follows: First, the real meaning of enactment 「The Character Education Promotion Act」 is building a national consensus that character education should be done not only in school but also in local community with harmonious families. Second, for the accomplishment of real meaning of enactment, 「The Character Education Promotion Act」 and regulations related should not be enacted excessively in details. Finally, positive communication with teachers and reasonable role burden of teachers are most important. These shall bring the valid application of 「The Character Education Promotion Act」 and regulations related.
