'해외 경쟁법 주요 심판결 사례 해설'은 필자인 경북대학교 최승재 교수가 우리 경쟁법 커뮤니티에게 시사 하는 바가 크다고 판단하는 다양한 해외 경쟁법 심판결 사례들을 소개하고 정리하면서, 경쟁법에 대한 적용 및 이해의 다양한 폭을 넓히게 될 것입니다. 이번 호는 연재의 첫 회로 Princo Corp. v. International Trade Comm'n, No. 2007-1386 (Fed. Cir. Aug. 30, 2010) 사건을 소개합니다. 이 사건은 미국 연방항소법원(CAFC)의 전원합의체 사건으로, 지식재산권과 경쟁법 간의 교착지점에서 의미 있는 사건으로 주목할 필요가 있습니다.

      • Acryl系 共重合體의 合成과 金屬添加物에 따른 光分解特性 硏究

        The study of many kinds of degradable polymer is actively proceeding to solve the problems of the environmental pollution which are due to sudden increasement of the plastic waste matters. Nowadays, the MMA(Methyl methacrylate) and the BA(n-Butyl acrylate) are being in use variously, making use of them synthesized copolymer with a method of the free radical initiated solvent polymerization. used Ethyl acetate as a solvent, Benzoyl peroxide as an initiator. The structure of the synthetic copolymers were confirmed making use of the ^1H-NMR and the FT-IR. And 0.001mol, 0.005mol and 0.01mol of photodegradable activators, such as Cu_2O and FeCl_3, to the synthetic copolymer were added. The film of the synthetic copolymer were make with a method of the solvent casting and then the properties of photodegradation effects of metal additives were studied. For photodegradation of the copolymers, irradiated ultraviolet light of wave length of longer than 250nm from the 450W medium pressure mercury lamp was irradiated. By 24hours intervals, the sample was gathered to measure the change of the characteristic peaks making use of the ^1H-NMR and the FT-IR. After irradiation: acrylic moidies of the copolymer were based on cain scission. The degree of photodegradation was founded on the irradiated time and the metal additives. For the photodegradation, the copolymer which have the metal additives was more efficient than a simple copolymer. Among the metal additives, FeCl_3 was more effective than Cu_2O. In Cu_2O’s case, the photodegradation tended to be decreased according th toe increasing concentration.

        뉴질랜드 이민자들의 생활체육 참여태도와 문화 및 생활 만족과의 관계

        The Relationship Between New Zealand Immigrants’Participation in Sports and Culture and Life SatisfactionSeungjae Choi Abstract: The purpose of this study was to examine the relationship between New Zealand immigrants’ participation in sports and culture and life satisfaction. The survey was conducted from 1 May to 31 July 2021 among immigrants living in New Zealand. The study involved 312 New Zealand immigrants. One-way ANOVA was performed to analyze differences according to the characteristics of New Zealand immigrants, and multiple regression analysis was performed to analyze the effect of participation attitudes in life sports on life satisfaction and cultural satisfaction. The research results are as follows. First, there were differences in New Zealand immigrants’ age, residence period, monthly average income, physical activity period, and daily sports participation attitude, cultural satisfaction, and life satisfaction according to daily exercise time. Next, it was found that the behavioral attitude, which is a sub-factor of the participation attitude in life sports, had an effect on life satisfaction. Also, it was found that affective attitude and behavioral attitude, which are sub-factors of participation attitude in life sports, have an effect on cultural satisfaction. It is expected that the foundation will be laid for the vitalization of life sports through continuous overseas research. Key Words: Lifestyle Sports, Participation Attitude, Cultural Satisfaction, Life Satisfaction, New Zealand 뉴질랜드 이민자들의 생활체육 참여태도와 문화 및 생활 만족과의 관계최 승 재* 연구 목적: 본 연구는 뉴질랜드 이민자들의 생활체육 참여태도와 문화 및 생활 만족과의 관계를 살펴보고자 뉴질랜드 이민자를 대상으로 연구를 실시하였다. 연구 방법: 뉴질랜드에 거주하는 이민자를 대상으로 2021년 5월 1일부터 7월 31일까지 설문조사를 진행하였다. 연구에는 312명이 뉴질랜드 이민자가 참여하였다. 연구 내용: 뉴질랜드 이민자의 특성에 따른 차이분석은 일원배치분산분석을 실시하였고, 생활체육 참여태도가 생활 만족과 문화만족에 미치는 영향은 다중회귀분석을 실시하여 분석하였다. 결론 및 제언: 연구결과는 다음과 같다. 먼저 뉴질랜드 이민자의 연령, 거주기간, 월평균소득, 생활체육기간, 하루운동시간에 따른 생활체육 참여태도, 문화만족, 생활 만족은 차이가 나타났다. 다음으로 생활체육 참여태도의 하위요인인 행동적태도는 생활 만족에 미치는 영향이 있는 것으로 나타났다. 생활체육 참여태도의 하위요인인 정의적태도와 행동적태도는 문화 만족에 미치는 영향이 있는 것으로 나타났다. 지속적인 해외연구로 생활체육이 활성화 될 수 있는 기반이 마련되길 기대한다. 핵심어: 생활체육, 참여태도, 문화 만족, 생활 만족, 뉴질랜드 □ 접수일: 2022년 7월 11일, 수정일: 2022년 7월 30일, 게재확정일: 2022년 8월 20일* 목포과학대학교 운동건강과 교수(Professor, Mokpo Science Univ., Email: select-choi@hanmail.net)

        2014년도 경제법 주요판례

        Among the decisions rendered in 2014 by Korean Supreme Court in the area of theMonopoly Regulation and Fair Trade Act(in short “FTL” hereafter), Cartel cases(Article 19) werethe most frequent cases together with the unfair business practice cases(Article 23). First of all first reverse payment case was made. GlaxoSmithKline, one of the global innovator in thepharmaceutical industry was alleged to make a pay-for-delay agreement with the DongApharmaceutical Co., in violation of the Article 19. Korean Supreme Court agreed with theKFTC(Korean Fair Trade Commission). In 2015, patent linkage system is to be introduced as apart of Pharmacy Act similar to that of Hatch-Waxman Act. This is one of the reasons why thiscase was highlighted by Korean Antitrust society. Secondly as per the Information ExchangeAgreement, Korean Supreme Court decided that Information Exchange agreement alone cannot betreated as a violation of Article 19 of FTL different from those counties, EU or US whereconcerted actions are regulated by the competition authority. However it could be a significantevidence when it will be combined with the other evidences. Thirdly air cargo case was decided. That was the first extraterritorial application of FTL case toforeign companies initiated KFTC by themselves not by other foreign competition authorities. KoreanSupreme Court put an restriction on the scope of application of Article 2-2 of FTL saying that couldbe utilized when domestic market is part of the defined geographic market or the effect of the cartelrestricting the competition and doing harm to domestic market will be direct and reasonablyanticipated. Furthermore price and market leadership theory has to be considered in the oligopolymarket under the newly announced Korean Supreme Court decision and division of the corporationitself will not make a impact to the collusive agreement of the pre-exsiting corporation unless anyexpress declaration of withdrawal from the cartel was made by the corporation established orremained after the division. 2014년의 공정거래법 관련 판결은 담합사건과 불공정거래행위 사건이 다수를 점했다. 담합과관련하여 최초의 역지불합의가 담합이 될 수 있다는 점에 대한 판결이 선고되었다. 제약분야는 특허분쟁이 많고 2015년부터 허가-특허연계제도의 도입으로 제도의 변화가 예정되어 있으며 미국과 유럽의최고법원들이 역지불합의에 대한 판결을 내고 있다는 점에서 큰 관심을 받았던 판결이다. 이 판결은공정거래법 제59조의 적용범위에 대한 판단이라는 점에서도 의의가 있다. 한편 정보교환행위에 대한판례들을 살펴볼 필요가 있다. 정보교환행위는 통상 협회나 해당 업종의 담당자들의 모임을 통하여 관련된 정보를 교환하는 것으로 이렇게 교환된 정보에 기초하여 가격이나 거래조건이 결정되면 이렇게교환된 정보가 담합에 이를 수 있는 유인을 제공할 수 있다. 대법원은 정보교환행위자체로도 담합이될 수 있는 것은 아니며 정보교환행위 자체는 유력한 증거가 될 뿐이라는 입장을 취했다. 그러므로 실무상으로는 정보교환행위에 더해서 어떤 정황증거를 결합하여야 담합에서의 의사의 합치를 인정할 수있을 것인지가 중점이 될 것으로 본다. 사업자단체의 구성사업자에 대한 사업활동방해 사건이 다시 선고되었고, 항공법과 공정거래법의 관계에대한 판결이 선고되면서 공정거래법 제58조에서 말하는 개별 산업규제법의 적용이 공정거래법과의 관계에서 필요·최소한의 원칙에 의한 규율을 받게 된다는 점이 재확인되었다. 대법원은 회사의 조직재편과 공정거래법의 집행과 관련해서 회사분할의 경우에도 영업양도와 마찬가지로 공동행위를 종료하는 의사를표시하지 않으면 공동행위가 유지된다는 태도를 취했다. 과점시장에서의 공정거래법 집행과 관련하여 단순한 외형상의 일치만으로는 담합의 의사를 인정할 수 없다는 점을 확인하면서 과점시장이라는 시장구조와 당해 사업자의 지위 및 행위특성을 감안하여 담합여부를 인정하여야 한다는 판결도 주목할 가치가 있다. 또 대법원이 공정거래법 제2조의2의 적용에 있어서 적용범위를 합리적으로 제한하기 위하여 국내시장의 포함여부 및 역외카르텔이 국내시장에 미치는 효과의 직접성·합리성·예견가능성을 요구하는 법리를제시한 것도 의미가 있다.

      • 活性炭 吸着分離에 미치는 溶液 pH의 影響

        By this experiment, we have the following result. In the activated carbon equilibrium adsorption of dilute aqueous solution of phenol, the adsorption quantity became the largest when solution pH was adjusted as -4<pH-pKa<-1 to each pKa. That is, as pH-pKa<-4, due to the acid adsorptive effect, the equilibrium adsorption quantity decreased, and for pH-pKa>-1, due to adsorption ionization, the equilibrium adsorption decreased. As for the fixed bed adsorption and initial adsorptive rate, in case of acid zone, due to acid adsorption, the adsorptive rate was slow, otherwise, in basic zone, by ionization, the adsorption decreased to commence breakthrough rapidly to have slow the adsorptive rate. As a result, there appeared a strong aqueous solution pH effect influenced on the adsorptive rate.

      • HEMA와 CA 및 PVA공중합체의 막제조와 물성에 관한 연구

        The grafting of 2-hydroxyethyl methacrylate(HEMA) and cellulose acetate(CA) and synthesis polymer poly(vinylalcohol) as a biocompatible material for medical application was investigated in the various condition. The structure of graft copolymer was indentified by using infrared spectroscopy.(IR) The membrane of sytnesis copolymer CA-g-p(HEMA) and PVA-g-p(HEMA) were prepared for a skin substitute and water content, tensile strength, elongation, water vapor transimmision rate(WVTR) and biodegradation the membranes was determind. And the surface structure of graft copolymer membrane characterized by SEM. The water content was about 100% and then tensile strength was 166∼661kg/㎠, 210∼88kg/㎠ at dry condition, 60∼328kg/㎠, 54∼23kg/㎠ at wet condition in the PVA-g-p(HEMA) and CA-g-p(HEMA) membrane respectively. Water vapor transimmision rate(WVTR) was 123.59∼128.54kg/㎠/day like that of the normal skin. From the result of the biodegradation by protein hydrolysis pepsin the biodegradation rate was that at the 4∼5day and accessed to the equilibrium state. From the results obtained in this study, syntheis membrane was found to satisfy most of the basic properties of a skin substitute.

      • Dimethylamine을 末端基로 한 Polydimethyl Siloxane 의 熱分解反應에 관한 硏究

        It ran been shown that the thermal degradation of linear polydimethylsiloxanes(PDMS) under vacuum results in depolymerization liberating volatile cyclic oligomers. Under non-equilibrium conditions in a catalyst-free environment Thomas and Kendrick have observed that the degradation products of a PDMS are typically cyclic trimer, (Me_2SiO)_3, with lesser quantities of larger ring oligomers and trace amounts of Me_3 Si(OSiMe_2)_nOSiMe_3 (n=0, 1). They suggested that the relatively low activation energy for depolymerization compared to the siloxane bond energy favors a degradation mechanism involving a randomly initiated intramolecular cyclic, four-centered (loop) transition state (A) accompanied by siloxane bond rearrangement. Substituent effects also appear to support this hypothesis. More recently Grassie et al. have shown that hydroxyl terminated PDMS is less thermally stable than the end-blocked polymer. They concluded from thermogravimetric analysis (TGA), thermal volatilzation data and molecular weight measurements that thermolysis of a catalyst-free polymer leads initially to condensation at the chain-ends (B) accompanied by depolymerization initiated at the chain termini (C). The data from the aforementioned studies do not preclude an unzipping mechanism either initiated at the chain ends or by a random chain cleavage. Furthermore, no distinction has been made in previous studies between partial and complete unzipping upon initation. These basic mechanisms have been treated theoretically and appropriate kinetic equations are available to test each process and, where appropriate, to deduce relevant reaction parameters. In the present study the thermal depolymerization of end-blocked PDMS is reported. Molecular weight as a function of conversion has been fitted to theoretical curves which serve as a kinetic test of the mechanism.

      • 固定化 酵素에 의한 에탄올 生成의 反應特性에 관한 硏究

        Saccharomyces cerevisiae cells were immobilized in calcium alginate beads for use in the continuous production of ethanol. The yeast cells converted 92.4% of the 10%(W.V) glucose to ethanol within 48 hrs and maintained such a conversion rate for at least 3 days. Yield, in mass of etharl01 produced to mass of 10%(W/V)glucose consumed is quite high, 0.47(Y_p/s) in average. The reaction behavior of the immobilized resting yeast and immobilized growing yeast are presented. For both of the yeasts, reaction rates are expressed, by the Michaelis-Menten equation with a linear ethanol inhibition factor. The Michaelis constants are larger than that of native S. cerevisiae. The pH change affects the metabolic activity of yeast and was resulted from the high activity of the growing yeast. This effect of PH is caused by the K_m difference. Distribution of the growing yeast cell inside the carrier gel is presented. It is found that the cell density is somewhat higher near the surface of the carrier.
