    Civil Safety Insurance is a coverage system that local governments voluntarily contract with insurance companies to compensate citizens for life and physical damage caused by various disasters or accidents. When a local government purchases insurance, all citizens with an address in the local government receive the benefits of the insurance at once without a separate insurance enrollment process. The purpose of Article 732 of the Commercial Act, which prohibits the purchase of death insurance for persons under the age of 15, is to prevent moral hazard and insurance crimes against persons who have little or no judgment, decision-making ability, or defense capability, such as minors under the age of 15.
    Recently, the fact that minors who died in natural disasters or social catastrophes could not be insured under Article 732 of the Commercial Act because they were under the age of 15, and were therefore excluded from the insureds of the Civil Safety Insurance(group insurance) subscribed by local governments and could not receive death benefits, raised the counterargument that the law aimed at protecting minors from insurance crimes was contrary to universal values such as equal rights under the Constitution. Several amendments have been proposed in the National Assembly to address these issues. The discussion is mainly focused on group insurance, with the aim of reducing the number of cases where death insurance premium are not paid to minors under the age of 15.
    This paper examines the six Commercial Act amendments submitted to the National Assembly and how to close the gap in the Civil Safety Insurance for those under 15 through a comparative legal analysis. First of all, the six amendments to the Commercial Act are intended to allow exceptions in a limited scope to solve the problem that people who die in the same disaster are not paid benefits from the Civil Safety Insurance(group insurance) subscribed by local governments due to their age.
    However, in the event that such an amendment fails to pass the National Assembly, I propose that the next best option is to refer to Article 159(2) of the VVG, which provides for the payment of an amount equal to the normal funeral expenses(our courts have awarded funeral expenses of about 5 million won to the bereaved family members after summarizing the undisputed facts). In order to continue to institutionalize and develop the program in the future, it is recommended to enforce and manage it as an ordinance.
