공공SW사업의 내실화(內實化)를 위한 법제도 개선방안 = Improvement of Legal Framework for Public SW Projects

Properties of SW technology has developed a thin properties cumulatively and incrementally. In the process of SW technology innovation has been made. Nevertheless, there is a limitation in that it was a short-term prescription to quickly eliminate the adverse phenomenon of the market more policies for the attributes described SW. The role of SW Industry Promotion Act, but is not intended for the purpose of promotion of the software industry has been turned into a public SW laws regulating the business. This is why it is severe competition for public order SW business among domestic enterprises increased regulation to protect and guarantee the fairness of the small and medium enterprises SW. SW business of government public procurement means procurement for the development of software for the needs of the public. SW is public business, including by building, not only error-free activation of the software market, software systems also allow citizens to conveniently access e-government services. Government procurement is transparent budget execution is required due to the use of government resources. For this reason, it has been subject to criticism SW business is changing as regulatory nature. This study aimed to examine some of the details for the substantiality of the public business SW. First, look at the legal limit for the current business software SW Industry Promotion Public. Second, one of the problems in public SW business is concerning intellectual property rights on the software business results. Third, the maintenance plan will be presented to the legislation of the Software Industry Promotion Act as limits. Finally, through discussions, we propose the basic principles for the public business SW.
