기초지방자치단체 토지비축제도시행을 위한 탐색적 연구- 화성시 사례를 중심으로 - = An Exploratory Study for Implementing the Land Banking System of Self-Governing City - Focused on the case of Hwaseong City -

In this study, in the era of decentralization, can basic local governments carry out their ownpublic land policy through pre-acquisition of land? It started with the question. In order toanswer these research questions, taking Hwaseong-City, Gyeonggi-do as an example, a legal andinstitutional promotion plan and a strategic land reserve area were drawn, and a land reservesystem implementation plan at the local government level was presented.
As a result of the analysis, it was found that Hwaseong City is experiencing continuousdevelopment demand, such as the development of Dongtan 2 New Town and the creation ofSongsan Green City, and it is possible to promote land reserving in preparation for future demandbased on sufficient financial conditions. As an institutional plan for this, a clear will of the headof the local government and comprehensive agreements between citizens, public officials, andthe council are required, and a step-by-step system promotion plan is presented thorough depthpreparation based on autonomous and stable financial resources using the 'fund'. In addition,as a result of deriving strategic land reserve areas by comprehensively considering developmentconditions based on unused public property and reserved land in Hwaseong City, 5 areas forpublic development and 1 area for environmental preservation were derived. In the future,Hwaseong City needs to review strategic land reserve measures to contribute to reducing thefinancial burden by determining priorities and to preserve the landscape, such as preventingreckless development.
This study made following policy recommendations. First, it is required to implement aland reserve system at the local government level. Second, specialized land reserving throughcollaborative governance with related organizations is required. Third, from a long-termperspective, it is necessary to grant authority and responsibility to local governments to achievethe public interest, which is the original goal of the land banking system, and to prepare forvarious situations such as stable financing and economic conditions, flexible operation is required.

국문 초록 (Abstract)

본 연구는 지방분권화 시대에 토지의 선취득을 통한 공익형 토지정책을 기초지방자치단체가 자체적으로 수행할 수 있을까? 라는 질문에서 출발하였다. 이러한 연구 질문에 답하기 위해 경기도 화성시를 사례로 법·제도적 추진방안과 전략적 토지비축지역을 도출하여 기초지방자치단체 차원의 토지비축제도 시행방안을 제시하였다.
분석 결과, 화성시는 동탄2신도시 개발, 송산 그린시티 조성 등 지속적인 개발수요가 발생하고 있으며, 충분한 재정 여건을 바탕으로 향후 미래 수요에 대비한 토지비축제도 추진이 가능한 것으로 나타났다. 이를 위한 제도추진방안으로 기초지자체 장의 명확한 제도추진 의지와 시민-공무원-의회의 대내·외적 합의를 전제로 ‘기금’ 설치를 통해 자율적이고안정적인 재원확보가 선행되어야 하며, 철저한 준비를 통한 단계적 제도 추진방안을 제시하였다. 또한, 화성시의 미활용공유재산 및 유보지 등을 바탕으로 개발여건 등을 종합적으로 고려하여 전략적 비축지역을 도출한 결과 공공개발용 5개소, 환경보전용 1개소가 도출되었다. 해당 지역은 향후 화성시가 우선순위를 판단하여 재정부담 경감에 기여하고 난개발방지 등 경관 보존을 위한 전략적 비축방안 검토가 요구된다.
연구 결과, 다음과 같은 정책제언을 하였다. 첫째, 지자체 차원의 토지비축제도 시행이 요구된다. 둘째, 유관기관과의협력적 거버넌스를 통한 전문화된 토지비축이 필요하다. 셋째, 장기적 관점에서 토지비축제도의 본연의 목표인 공익 달성을 위한 지자체의 권한 및 책임 부여가 필요하며, 안정적 재원조달 및 경기 등 다양한 상황에 대비하여 탄력적인 운영이 요구된다.
