환경영향평가 협의 실무사례 고찰과 이를 통한 현행 평가제도의 합리적 운용 및 개선방안에 관한 연구 = A Study on rational application and improvement program of Environmental Impact Assessment now in use through consideration a case of Environmental Impact Assessment Conference

국문 초록 (Abstract)

본 연구에서는 환경영향평가 협의결과, 협의가 미흡한 사례를 유형별로 고찰하고 이러한 유형에 해당되었던 개발사업을 표본으로 선정하여 일련의 평가 협의과정을 검토·분석하고 개발사업 주체의 시각을 중심으로 문제점을 도출하여 이를 해결하기 위한 현행 평가제도의 합리적인 운용 및 개선방안을 제안하고자 한다.
우리나라의 환경영향평가제도는 1977년 처음 도입된 이래로 지속가능한 개발의 실현을 위한 의사결정 지원도구로 꾸준히 발전해오고 있는데 환경영향평가 실시 시기의 조정, 스크리닝·스코핑 제도의 도입과 주민의견 수렴 절차의 확대 등 다양한 개선방안이 적용되고 있다. 특히 최근에는 개발사업의 상위단계인 정책, 계획, 프로그램으로 이루어지는 의사결정 초기단계에 환경영향평가를 실시하는 전략환경평가 도입과 관련, 사전환경성 검토분야에서 환경정책기본법을 개정하여 2006. 6. 1일부터 사전환경성검토에 대안분석·의견수렴을 의무화하는 선진 전략환경평가 체계로 지속가능한 개발을 실현토록 제도를 개선·시행하고 있다. 환경영향평가 분야에서는 평가제도 상호간의 중복, 각종 영향평가서 작성에 과다한 시간·비용·인력소요 등 현행 통합영향평가법 운영과정에서 나타난 문제점을 보완·개선하고자 법률의 명칭을「환경영향평가법」으로 변경하고, 내용 중 교통·인구·재해 영향평가에 관한 사항을 전부 삭제 하는 등 법률을 개정하기 위한 입법예고(2006. 9. 29일)를 하기에 이르렀다.
이러한 환경영향평가 제도가 거듭된 연구와 시행착오 등을 거쳐 바람직한 제도로 개선·발전된다 할지라도 실무 적용시 그 시행 절차나 과정에 있어 평가협의 당사자의 불신을 초래하게 될 경우는 평가제도 자체의 신뢰성은 물론 나아가 행정기관 전체에 대한 신뢰성에도 큰 손상을 입게 될 것이므로 본 연구에서는 평가협의 절차 및 과정과 그 결과에 대한 전반적인 사례 고찰을 통하여 제기되고 있는 여러 문제점에 대하여 이를 검토·분석하고 그 개선방안을 제안하였다.
협의실무 사례분석을 통하여 제안하고자 하는 현행제도의 합리적운용 및 개선방안으로서는 첫째 평가협의기관의 평가업무 담당자 변경시 전문성 등을 고려하여 초기에 의무적으로 평가교육을 실시하여 법규적용 및 행정절차의 일관성 확보와 각 지방환경관서간 업무의 통일성을 도모하는데 개선이 되도록 노력하는 방안이 필요하며, 둘째 개발사업의 토지이용계획에 상당한 변경이 예상되는 경우 등에는 평가서 검토 초기단계에 현지조사를 반드시 실시하는 제도 운용상의 개선이 필요하며, 셋째 사업자 요청 등 필요하다고 인정되는 경우 협의기관의 일방적이 아닌 사업자와 검토기관 및 협의기관간 2자간 또는 3자간 논의체제가 확립되도록 하여 주요 쟁점사안에 대한 합리적 대안모색 등 협의과정에 있어서의 사업자 참여방안이 필요하며, 넷째 검토기관 및 전문가의 검토의견을 투명하게 조정할 수 있는 협의기관의 종합조정 기능 강화 시스템의 확보 등 협의기관의 역할론 강화 방안이 필요하며, 다섯째 기존의 이의신청 제도에 대하여 현재 개선 추진되고 있는 법령 개정안의 후속 조치로서 환경영향평가 심의위원회 위원구성 범위설정과 심의절차의 간소화 등 민원인을 배려하는 제도로 시행될 수 있도록 하는 등의 개선방안이 필요할 것으로 연구·제안하였다.
또한 이를 통하여 환경영향평가는 무조건적인 생태보존만을 목적으로 하거나 이용측면만을 강조하는 계획이 아니라 보존과 개발에 합성의 오류가 없도록 자연자원의 다목적 이용체계를 수립하는 현실적이고 합리적인 접근이 가능하도록 나아가야 할 것으로 보며, 제안된 개선방안에 대하여는 다각적이고 면밀한 검토로 환경영향평가제도의 실효성 확보와 나아가 정부의 대민 신뢰성 제고가 이루어질 수 있는 기초자료로서 유용하게 활용되어 환경영향평가제도의 발전적 정착이 이루어지길 기대하고자 한다.

This study is considering Environmental Impact assessment conference result and insufficient instance of conference by many types. Assessment conference process is examined and analyzed on selected sample about development works that come in this type. It suggested of current assessment of system reasonable use and improvement plan for problem on sight of development work subject and solves
Environmental impact assessment of our country is developing steadily by decision-making support means for realization of sustainable development since 1977. It is applied various improvement plan such as adjustment of environmental assessment origin time, introduction of screening and scoping system and extension of inhabitants opinion collecting formality. Recently, it is revised Environmental Policy Fundamental Act in the introduction and relation of strategy environmental assessment and prior environmental review system which beginning environmental impact assessment on the decision-making first stage consisted of policy, plan, program that is high position step of development work. Since 2006. 6. 1, It is improving and operating so as to realization of sustainable development on an advanced strategy environmental assessment structure to responsibility by alternative plan analysis and opinion-collecting in the prior environmental review system. Environmental impact assessment field is changed the legal name of environmental impact assessment Act as complement and improvement for problem that appear in current integration impact assessment like mutual repetition of assessment system and making out impact assessment paper in excessive time, expense and human power requirement. Among these contents, it was legislation announce(2006. 9. 29) to edit law as erase all subject about traffic, population and calamity impact assessment.
When the applied business, though these environmental impact assessment system is developed and improved as desirable system through many repeat studies and trial and error, it can damage in authoritativeness about whole administration as well as authoritativeness of rating system in case of assessment conference person disbelief in the enforcement formality or process. So, this study examines and analyzes about several proposed problem through general example-consideration for assess conference formality, process and result and suggested the improvement plan.
There are the fifth plans about rationalize application and improvement plan of the present system that proposed through conference business examples analysis. At first, when assessment business officer was changed in the assessment conference authorities, it need plan that try to gain consistency security of legislation application and administration procedures, improve maintaining unity of each local environment government office business by enforcing assessment education compulsorily at the first time considering professionalism. In the second, when fair alteration is expected that land use planning of development business are changed, it need improvement of system application that assessor enforce local survey in the first stage of paper investigation. In the third, when is recognized that need a businessman claim, it need businessman participation plan in conference process such as logical alternative groping about the main point at issue plan by established that is not unilateral between businessman and examination institution or conference institution In the fourth, it need conference institution's role strengthening plan such as security of synthesis control function strengthening system on examination institution that can adjust expert's examination estimation clarity. In the fifth, it need improvement plan like a considering system of popular enmity by environmental assessment judging committee composition extent establishment and simplification of deliberation process as a follow-up measures of statute amendment in improving and promoting about the formal objection system.
Environmental assessment should be possible realistic and reasonable access that establish multi-purpose use system of natural resources so that there is no fallacy of composition in conservation and development that plan that does outright mode of life conservation by purpose or emphasizes use side is not. And this study will be expected that effectiveness security of environmental impact assessment by many-sided and meticulous examination about proposed improvement plan and expansive resettling of environmental impact assessment is achieved because governmental civil affairs authoritativeness raising are used usefully as basic data that can be attained.
