주택재건축사업의 기부채납 개선방안에 관한 연구 : 서울특별시 강남·강동구 아파트재건축사업의 공원을 중심으로 = (The) improvement of land donation for housing reconstruction : focused on park of apartment reconstructions in Gangnam·Gangdong-gu, Seoul metropolitan city

다국어 초록 (Multilingual Abstract)

This study examines The Improvement Parkland Donation for Apartment Reconstructions in Seoul Metropolitan City. Land Donation is an essential part in the process for the Urban Redevelopment in Korea. In this study, I have studied and analyzed the problems of the Land Donation in the field of the Apartment Reconstruction among the Urban Redevelopment in Seoul.

Land Donation, which is already implemented by the policy or guidance of a local government regardless of having imprecise legal basis, is said to be above the law. It only conciliate the illegality and civil unrest with incentives to relax restrictions on the floor area ratio. However, an excessive demand on Land Donation is not only the financial burdens in the Housing Reconstruction, but also disrupt resettlement of original resident because of the overburden to the members of the union.

Land Donation, being used like a double-edged sword as regulation and dispensation by administrative agency, should make legal basis clear and utilize an administrative measure for citizens from a tax-paying citizen's perspective. And the central government should set clear criteria for the law of Land Donation to control the arbitrary regulation acts by a local government head.

According to the judicial branch, it is lawful in the case of Land Donation presupposes administrative benefits. Still it draws a expansive conclusion if it is discussed in depth by the professionals as to contradiction of etymology and ambiguous legal definition of Land Donation

Housing reconstruction projects built by the city in urban planning are to be conducted for the bad housing area which Urban infrastructure is good. However, Korea has a short history of modern town planning, housing reconstruction projects have been driven by Urban Planning Act which made 1962 with housing reconstruction and part of the Residential Environment Improvement Project.
Although there is a significant difference in Business processes and method, housing reconstruction projects has shorter history than housing redevelopment has and small size, policymaker overlooks the need of housing reconstruction projects.
Park donation of apartment reconstruction is 50% or more.
However large scale neighborhood park near reconstruction operations and apartment complex commonable even though can be built by laws and regulation.
So increased the economic burden of local resident becomes problems.

When we can be to adjust to the reality, the economic burden of local resident can be reduced.
And the central government should set clear criteria for the law of land donation to control the arbitrary regulation acts by a local government head.
