광역자지경찰제 연구 = A Study on Wide-area Autonomy Police System

In modern society, paradigm of administration was shifted from government to governance, along with the changes of administration conditions, called as megatrend such as golbalization, informationization, intellectualization, localization The localization of administration restored local self-government, and the settlement step of it may be achieved. Most of government functions are managed under the wide-area administration system, and education and fire service are implemented under the wide-area local administration. For the enhancement of resident's welfare prescribed by Claus 1, Article 117 of the Constitution and Claus 1, Article 8 of the Local Autonomy Law, above all, security of public peace responsible for safety of residents and local stability may be important. However, the current wide-area local administration is not perfect because only a police system has been centralized.
The introduction of wide-area autonomy police system may be required to support the security of local administration and supplement the incomplete local self-government. This it to introduce and implement the autonomy police system as police governance capable of performing community policing by connecting self-government education and fire service. The autonomy police system, police governance through the involvement and cooperation of residents, is the community policing. The public peace service, a kind of publics goods, was managed by police administration so far, but now the network establishment of local governance elements such as residents's participation, collaboration and competition between private and public, and partnership among actors are necessary. The police governance in networked collaboration system may be the police paradigm to be established as the community policing.
If the relation of community policing, local governace and public service are systematized and if the organization is supportive and promising, then it may be called wide-area autonomy police system. This may be the system in which government agencies, the National Police Agency, provinces, ward or county self-government body, members inside police officers which are a group involved in the policy, implementation of autonomy police, all can achieve win-win. For the successful autonomy police system, the autonomy police system, decentralization of police authority, and the police autonomy, independence of police administration from local general administration should be necessarily maintained. From the implementation of the wide-area autonomy police system capable of securing the local administrative, financial power, ‘the community policing of the residents, for the residents and by the residents' can be performed substantially as a true municipal police.

국문 초록 (Abstract)

현대사회는 메가트랜드(megatrend)로서 세계화(globalization)·정보화(informationization)·지식화(intellectualization)·지방화(localization)라는 행정환경의 변화와 함께 행정의 패러다임도 government에서 governance로 바뀌었다. 행정의 지방화는 지방자치를 부활시켰고, 이제는 정착단계에 이르렀다고 할 수 있다. 정부기능의 대부분이 광역행정체제로 운영되고 있고, 교육과 소방이 광역자치행정으로 실시되고 있다. 『헌법』 제117조 제1항과 『지방자치법』 제8조 제1항에 규정하고 있는 주민복리 증진을 위하여는 지역의 안정과 주민의 안전을 책임지는 치안력 확보가 무엇보다 중요하다고 할 수 있다. 그런데도 경찰만이 유일하게 중앙집중적으로 운영되고 있어 절름발이 광역자치행정이라고 할 수 있다. 이런 불완전한 지방자치를 보완하고 지방행정력 확보를 지원·보강할 수 있는 광역단위의 자치경찰제 도입이 적합하다. 현재 실시하고 있는 자치교육과 자치소방을 연계하여 지역사회경찰활동(community policing)을 수행할 수 있는 경찰거버넌스로서의 자치경찰제를 도입·시행하는 것이다. 자치경찰제는 주민의 참여와 협력으로 이루어지는 경찰거버넌스로서 지역사회경찰활동이다. 공공재인 치안서비스를 지금까지는 경찰행정이 담당하였다면 이제는 주민참여, 公-私간의 협력과 경쟁, 행위자간의 파트너십 등의 로컬거버넌스 요소의 네트워크 구축이 필요하다. 네트워크화 된 협력체제에서의 경찰거버넌스가 지역사회경찰활동으로 정착되어야 할 경찰패러다임이라고 할 수 있다. 지역사회경찰활동과 로컬버넌스, 공공서비스의 관계가 체계적이고 미래지향적일 수 있는 조정·지원적 체계는 광역자치경찰제라고 할 수 있다. 광역자치경찰제는 자치경찰의 실시라는 정책에 참여하는 집단인 정부기관, 경찰청, 시·도와 시·군·구자치단체, 경찰내부 구성원이 모두 win-win하는 제도가 될 수 있다. 자치경찰제가 성공적으로 실시되기 위해서는 중앙집중적인 경찰권의 분권이라는 자치경찰권과 지방의 일반행정으로부터 경찰행정의 독립이라는 경찰자치가 반드시 지켜져야 한다. 그리고 지방행정력과 재정력의 확보가 가능한 광역단위의 자치경찰제의 도입·실시가 진정한 자치경찰로서, 「주민의, 주민을 위한, 주민에 의한 지역사회경찰활동」을 충실하게 수행할 수 있다.
