ABSTRACT
After the United Nations agreed the existing international law could be applied to cyberspace, efforts have been made to further clarify its method and scope of the application. In particular, the right of self–defence was a subject on which states had different opinions, leading the concept to be reflected indirectly in the fourth UNGGE report.
Under current international law, where the use of force by individual states is extensively prohibited, self-defence is an exceptional cause. Especially, considering the fact that the risk of cyber operation aimed at a specific country is increasing and cyber operations by non-state actors are frequently occurring, it seems necessary to discuss the right of self-defence focused on cyber. In this sense, this dissertation examines whether the existing international law can be applied to cyberspace. This includes both discussions on whether cyber operation can come under the category of the concept of armed attack and the condition for self-defence; and discussions on responding with cyber operations against armed attacks.
Article 51 of the UN Charter can be applied irrespective of the means or weapons used, therefore cyber operations can constitute an armed attack if they meet certain criteria. In addition, in determining whether the UN Charter can be applied, the 'scale and effect' criteria may be applicable to existing customary international law. Traditionally, only states have been understood as actors of the armed attack, however, as the capacity and influence of the non-state actors increase, the voice that the non-state actors should be included as the actors of the armed attack is becoming highly persuasive. Specifically, it is underscored that countries should be able to cope with the acts of non-state actors by force, considering the openness of the cyberspace and its inter-connectivity.
The requirements of the right of self-defence under existing international law are also valid in cyberspace. All the substantive requirements established by customary international law – the necessity, proportionality, and immediacy - and the procedural requirements of Article 51 of the Charter of the United Nations are all required. Regardless of whether a preceding armed attack uses cyber means and whether cyber means are used during the exercise of self-defence, these requirements should be met.
The right of collective self-defence is an established concept clearly identified in Article 51 of the Charter of the United Nations along with a number of treaties. In order for the right of collective self-defence to be effective, a request must be made by the victim country. The North Atlantic Treaty Organization (NATO) and the European Union (EU) have confirmed the possibility of the exercise of collective self–defence against cyber operations. The right of anticipatory self–defence is not a concept recognized in the Charter of the United Nations. However, considering the fast speed of cyber operation and the low possibility of predicting the scale of damage, its application is called for.

유엔 차원에서 사이버공간에 기존 국제법을 적용할 수 있다는 합의가 이루어진 이후, 그 적용 방식과 범위를 보다 구체화하려는 노력이 이어지고 있다. 특히 자위권의 적용 문제는 국가들 간 입장 차가 분명했던 주제로서, 제4차 UNGGE 보고서에 우회적 용어로 반영되었다.
개별 국가에 의한 무력사용이 광범위하게 금지되는 현 국제법 체제 하에서 자위권은 그 예외적 사유라는 점에서 상당한 의미를 갖는 개념이라고 할 수 있다. 특히 특정 국가를 겨냥한 사이버 조작의 위험성이 점점 증대되고, 비국가 행위자에 의한 사이버 조작이 빈번히 일어나고 있는 현실을 감안할 때 사이버에 초점을 맞춘 자위권 논의가 필요하다고 생각된다. 따라서 이 논문은 사이버공간에 기존 국제법상 자위권이 적용가능한지를 검토하였다. 이는 사이버 조작이 자위권 발동 조건인 무력공격에 해당할 수 있는지의 논의와 무력공격에 대해 사이버 조작으로써 대응하는 측면의 논의를 모두 포함한다.
유엔 헌장 제51조는 무력공격을 행하는 데 사용된 수단이나 무기와는 무관하게 적용이 가능하므로 사이버 조작 역시 일정 기준을 만족할 경우 무력공격을 구성할 수 있다. 또한 이를 판단함에 있어 기존 관습국제법상 ‘규모와 효과’ 기준이 적용 가능하다. 전통적으로 무력공격의 행위 주체는 국가로 이해되어 왔지만, 비국가 행위자들의 역량과 영향력이 증대됨에 따라 무력공격의 행위자로서 비국가 행위자도 포함되어야 한다는 목소리가 설득력을 얻고 있다. 특히 사이버공간의 개방성, 상호연결성 등을 고려할 때 비국가 행위자들의 행위에 국가들이 무력으로 대응할 수 있어야 한다는 점이 강조된다.
기존 국제법상 자위권 요건들 역시 사이버공간에서 유효하다. 관습국제법상 확립된 실체적 요건들인 필요성, 비례성, 즉각성과 유엔 헌장 제51조 상의 절차적 요건들이 모두 요구된다. 이는 선행하는 무력공격이 사이버 수단을 사용하는지 여부와는 무관하게, 또 이에 대해 자위권 발동 시 사이버 수단으로 대응하는지 여부와는 무관하게, 자위권 원용국은 이들 요건들을 만족시켜야 한다.
집단적 자위권은 유엔 헌장 제51조 및 다수의 조약들에서 확인되는 확립된 개념이다. 집단적 자위권의 원용이 유효하기 위해서는 피해국의 요청이 있어야 한다. 북대서양조약기구와 유럽연합은 사이버 조작에 대한 집단적 자위권의 발동 가능성을 확인한 바 있다. 예방적 자위권은 유엔 헌장에서 확인되는 개념은 아니며, 그 인정 가능성에 대한 의견도 다양하다. 그러나 사이버 조작의 발현 속도가 빠르고 피해 규모의 예측가능성이 낮다는 점 등을 고려했을 때 그 적용의 필요성이 요구된다.
