Real estate constitutes a core and principal property right of citizens, serving as both an individual asset and the bedrock of national economic activities. In the modern legal framework, the attribution and modification of real estate real rights (rights in rem) must be widely publicized through registration—a method of public notice—to guarantee the safety of transactions. However, while the current Civil Act of Korea adopts the principle of "constitutionality (formalism)," which requires registration for changes in real rights through juristic acts, it concurrently harbors a legal and institutional contradiction by denying the "public confidence (Öffentlicher Glaube)" of such registrations. Consequently, even a bona fide third party who transacts in reliance on the registration register, an official public record maintained by the state, faces the risk of losing their rights if the registration is defective due to forged documents or invalidation of cause. This shifts unexpected damages onto the citizens and engenders profound social distrust in the public notice system of real estate. To harmoniously achieve both the dynamic safety of transactions (protection of transactions) and the static safety of rights (protection of true titleholders), this study aims to examine the structural limitations inherent in the current real estate registration system and to comprehensively propose legislative, judicial, and policy measures to overcome them.
An analysis of the operational status and problems of the current registration system reveals three core legal issues.
First, there are limitations in scrutinizing the authenticity of registration applications. Under current law, registrars are bound by the principle of "formal examination," evaluating only the procedural legality of submitted documents. Consequently, they fail to substantially filter out sophisticatedly forged documents or fictitious contracts, rendering the system incapable of preventing defective registrations. Furthermore, the duty of qualified representatives (such as judicial scriveners), who handle over 96% of registration applications, to verify the identity of the parties lacks clear and specific criteria. As a result, procedures such as verifying certificates of personal seal impression or preparing confirmation documents are operated in a purely perfunctory manner.
Second, the objection procedure against a registrar’s disposition of dismissal is highly inefficient. Although expedition is vital in registration procedures, the current objection system is subject to the principle of "non-suspension of execution." This creates a critical vulnerability where judicial remedy becomes fundamentally impossible if a third party acquires the rights while the procedure is delayed. Moreover, due to the excessive workload and lack of specialized expertise among general judges in charge of objection cases, combined with the administrative burden on registrars to prepare written opinions, the processing period for the court of first instance is delayed by an average of four to five months, threatening to render the objection mechanism obsolete.
Third, there is an absence of an ex post facto remedy and liability system for defective registrations. In a reality where public confidence is denied, even if a victim files a claim for state compensation, it is virtually impossible to prove the "intent or negligence" of a registrar who performed duties lawfully within the bounds of formal examination authority, thereby creating a blind spot in damage indemnification.
A comparative legal analysis offers critical insights. Germany recognizes the public confidence of registration and enforces the notarization of real property agreements (Auflassung) to ensure substantive truth, while broadly empowering judicial assistants (Rechtspfleger) with the authority to make registration dispositions and conduct primary objection reviews. France, despite adhering to the principle of opposability, mandates the execution of notarial acts to achieve safety virtually equivalent to public confidence, and recognizes the strict (no-fault) liability of the state for registration errors. The United States compensates for the vulnerabilities of its recording system, which lacks state examination power, through private market mechanisms such as escrow systems and title insurance; additionally, certain states operate state-led indemnity funds through the Torrens system. Japan, following the implementation of online registration, introduced systems for registration cause information and registration identification information to counteract the abolition of the mandatory physical appearance rule, while maximizing preventive functions by imposing stringent identity verification duties and criminal liabilities on qualified representatives.
Based on these findings, this study proposes several improvements:
Enhancing the Authenticity of Registration Applications: To fundamentally block defective registrations, a mandatory notarization system should be phased in for registration cause certificates of critical real estate transactions, such as transfers of ownership. As a realistic alternative to complement or substitute notarization, the identity verification duties of qualified representatives must be substantiated. By adopting Japanese legislative precedents, their liability and status should be significantly strengthened by introducing criminal penalties for providing false confirmation information and increasing financial liability insurance limits.
Rationalizing the Objection Procedure: To alleviate the judicial workload and facilitate prompt, specialized remedies, a "Judicial Assistant Dedicated to Registration" system should be actively introduced, granting them the authority for primary examination and decision-making in objection cases. Concurrently, procedural delays should be eliminated by statutory codification of processing deadlines, the establishment of specialized judicial benches for registration objections, and a revolutionary advancement of precedent search information systems.
Strengthening Liability and Remedies for Defective Registration: To ultimately harmonize with the constitutionality principle of the Korean Civil Act, it is desirable to introduce the public confidence of registration to protect dynamic safety. However, since establishing public confidence involves numerous prerequisites that may remain long-term challenges, mandatory subscription to and vitalization of private "title insurance" should be actively pursued as a transitional measure and a safety net to rescue true titleholders. In response to contemporary demands requiring a robust role for title insurance, universal premiums based on "economies of scale" are currently being presented. Supplementally, the establishment of a registration special account or a separate indemnity fund funded by registration fees should be considered.
In conclusion, restoring public trust in the real estate registration system requires a structural triad of reform that transcends microscopic adjustments of individual mechanisms: "Verification of Authenticity (Ex-Ante Prevention) – Rationalization of Procedures (Intermediary Expedition) – Indemnification of Loss & Recognition of Public Confidence (Ex-Post Remedy)." It is highly anticipated that the legislative and judicial-administrative improvements proposed in this study will serve as a cornerstone for building absolute public trust in the state's public notice system and, furthermore, flawlessly safeguarding the citizens' property rights guaranteed by the Constitution.
