정당공천제와 한국의 지방자치 민주주의 : 기초의원 정당공천제를 중심으로

국문 초록 (Abstract)

본 논문은 기초의원 정당공천제가 최초로 실시된 2006년 제 4대 동시지방선거 이후 정당공천제가 기초의원의 정치활동과 의정활동에 미치는 영향을 분석하였다.정당은 현대 민주주의의 필수 불가결한 정치기구로서 개인의 정치행위는 대부분 정당을 매개로 이루어진다는 전제 하에 지방선거에 정당공천제가 도입되었으나, 참여민주주의와 주민자치라는 측면에서 지방선거에서의 정당공천제는 많은 논란의 대상이 되고 있다.이에 본 논문에서는 경기도 기초의원에 대한 면담조사와 설문조사, 기초의회의 정당별 의석구성비 조사, 기초의회 회의시간 조사를 시행하여 정당공천제가 기초의원의 정치활동,의정활동에 미치는 영향을 분석하였다.그 결과는 다음과 같다.첫째, 기초의원의 정당활동과 지역구 정치활동의 비중이 갈수록 늘어나고 있다.둘째, 지방정치의 중앙정치 예속이 심화되고 있다.셋째, 지역주민 대리인으로서의 기초의원의 대표성을 유지하기가 어렵다. 특정 정당이 모든 상임위의 절대 과반수를 차지한 상황에서 다른 정당의 목소리가 정책에 반영되기 어렵기 때문이다.특정 정당이 지방의회 의석의 절대 과반수를 장악한 2006년 지방선거의 결과와 선거이후 지방의회 활동은 지방거버넌스의 균열과 지방자치의 과두정치화를 야기하고 있다. 대의민주주의의 왜곡과 정당다원주의 위기 또한 초래되고 있다. ‘공천이 곧 당선’이라는 공식이 성립되면서 기초의원 선출시 주민의 의견보다는 정당의 판단이 우선시되고 의원의 사용주체도 주민이 아니라 정당이 될 소지가 있다. 이러한 구조 하에서는 정당다원주의나 복수정당의 선거 경쟁성이 확보되지 않으며 국민의 정당 지지율과 지방의회 정책 의결권의 괴리도 나타나고 있다.기초의회는 중앙정치 이슈와 크게 관련되지 않고 주민의 실생활과 직결되는 사안들을 다루는 정치기구이며 주민들의 직접참여와 관리가 용이하다. 주민자치를 실현하기 위한 지방선거제도는 이러한 전제 하에 지방자치 주체들이 참여한 가운데 진지하게 재논의되어야 한다. 정당공천제가 선거이후 지방의회 활동과 지방자치 민주주의에 어떤 영향을 주고 있는지를 치밀하게 분석하여 정당의 개입범위를 새로이 조절하는 것은 지방선거제도에 대한 새로운 논의를 위해 반드시 필요한 작업이다.

다국어 초록 (Multilingual Abstract)

This study analyzed the impact of the party nomination system applied to county council candidates since the Korea's 2006 local election, on county council members' political activities and parliamentary politics.The party nomination system in local elections has been introduced on the premise that political parties are indispensable factors of modern democracy and that most of the individual citizens' political actions are accomplished by the midium of political parties. However, this system has caused many controversies from the perspective of participatory democracy and local autonomy.Therefore, this study carried out interviews and surveys of the members of county councils in Gyeong-gi Province, and investigated the proportion of each party in the council and council meeting time duration to find out the influence of party nomination system on the county councils in Korea.Followings are the findings.Firstly, members of the county councils are spending more and more time on activities for their party and national assembly members of the same region.Secondly, local politics are getting increasingly subordinate to central politics.Lastly, members of county councils have difficulties in representing the residents who supported their party or its policy, because one party holds the absolute majority of the seats in every committee of the council. This situation makes it difficult for the voice of other parties to be reflected in local policy making processes.The result of the 5th local election, in which one party alone occupied the majority of the seats in all councils, is causing the breakdown of local governance and the rise of local oligarchy. It also leads to a distortion of representative democracy and a huge crisis in party pluralism. The predominance of the idea that the nomination by the majority party is the same to winning an election makes the party, not the local residents, become a 'subject of right' to determine which candidate goes to the council and to control all the conducts of the council members. Also, this one-party-majority system fails to guarantee party pluralism in assembly and fair competition in election, bringing about the separation of each party's supporting rate and voting power in the assembly through the process of committee composition.County councils usually deal with local residents' minor concerns directly related to their daily lives and not connected to central government's issues, and local resident's participation in managing and controlling their county council is easy enough in the meaning of time and space. This fact must be the basis for a sincere discussion on a new local election system to realize resident's participation in local autonomy. The impact of party nomination system in local elections on local autonomy ought to be carefully examined, and political party's range of intervention in local elections must be coordinated according to the result of this examination.
