차별의 교차성 이론은 1989년 미국 여성주의 법학자 Kimberlé W. Crenshaw에 의해 처음 개념화된 이후 법학적 배경에서 출발하여 다양한 학문영역에 광범위한 영향을 미쳐왔다. 차별금지법 분야에서도 복합차별을 입법적으로 제도화하고 사법적 해석법리에 복합적 차별분석을 수용하기 위한 각국의 논의는 이미 30년 넘게 이어졌다. 그러나 한국의 법학적 지형에서 복합차별에 관한 논의는 거의 전무한 상태이다. 이는 차별의 일반적 개념정의에 대한 한국 대법원의 협소한 해석과 깊은 연관이 있다.
근로기준법 제6조는 ‘남녀의 성을 “이유로” 차별적 처우를 하지 못하고, 국적ㆍ신앙 또는 사회적 신분을 “이유로” 근로조건 등에서 차별적 대우를 하지 못한다’고 규정하고 있다. 그런데 근로기준법상 균등대우조항을 해석할 때, 대법원은 ‘(남성 또는 여성)이라는 “이유만으로” 부당하게 차별대우하는 것을 의미한다’고 설시하였다(대법원 94누13589 판결; 2013두20011 판결 등). 단일 차별사유만을 이유로 차별을 판단한다는 것은 오직 하나의 사유만이 주로 또는 본질적으로 차별의 근거일 것을 요구하기 때문에, 다른 차별원인들이 차별적 결과에 영향을 미치더라도 차별을 인정하는 요소로 고려되지 못하고, 오히려 문제된 차별사유에 의해 발생된 결과가 아니라는 이유로 차별을 정당화할 위험이 있다. 그러나 단일사유만으로 차별을 판단해야 한다고 좁게 해석해야 할 법문언상의 어떠한 실질적인 근거는 없다. 실제 한국의 고용차별금지법들은 단일사유만으로 차별을 판단하도록 명시적인 규정을 두고 있지 않다. 개별 차별사유에 따라 차별금지조항을 규정한 남녀고용평등법, 연령차별금지법도 제한적이지만 복합차별을 다룰 수 있는 문언적 가능성을 열어두고 있고, 특히 장애인차별금지법은 법문상 여러 차별원인에 근거한 복합차별의 존재를 인정하고 차별판단에 복합차별 분석을 허용한다. 그럼에도 단일 차별사유 판단기준에 대한 대법원의 확고한 관점은 차별을 주장하는 사람이나 차별사건을 다루는 법률가에게 단일사유에 기반한 차별만을 인지하게 만든다. 다양한 차별원인으로 인해 하나의 차별로 인정받기 어렵다고 판단하면 아예 사건화되지 못하거나 사건이 제기되더라도 주된 차별사유 아닌 다른 차별원인은 차별판단과정에서 드러나지 않기 때문에 복합차별은 비가시화된다.
한국의 이러한 사법적 현실에서 복합차별에 대한 법적 연구가 제대로 이루어지려면 복합차별의 개념과 판단기준에 대한 관점을 제대로 정립하는 것이 무엇보다 중요하다. 첫째, 단일 차별사유 판단기준이 고착화된 사법환경에서 차별이란 원칙적으로 하나의 차별사유에 기초한 것으로 생각하게 되며, 복합차별은 둘 이상의 차별사유가 결합하는 것으로, 일반적인 차별과 다른, 예외적이고 특수한 유형의 차별로 인식하게 된다. 이는 마치 복합차별을 파악하려면 일반적인 차별판단기준과 별도의 판단기준을 구성해야 하는 문제로 이해하게 된다. 그러나 차별은 일반적으로 하나 이상의 차별사유 및 그와 관련된 차별특성들이 상호작용하여 불이익한 결과를 초래하는 상태를 의미하는 것으로 복합차별은 차별의 일반 개념의 일부를 구성한다. 따라서 복합차별에 대한 판단기준 역시 복합차별을 포괄하는 일반적인 차별판단기준의 일부로서 재구성되어야 한다. 둘째, 통상 차별 개념과 달리 복합차별을 둘 이상의 차별사유로 발생되는 예외적인 차별형태로 이해하면, 복합차별의 법적 수용 문제를 입법정책적 과제로 치부하기 쉽고, 차별금지법상 복합차별을 명시적으로 인정하는 규정이 신설되지 않으면 복합차별을 검토할 실익이 없다고 단정하게 된다. 포괄적 차별금지법의 도입은 하나 이상의 차별사유들이 결합된 복합차별 분석에 더 유리한 입법적 조건인 것은 사실이다. 그러나 복합차별은 차별의 일반적인 개념정의의 일부로서 복합차별의 수용 문제는 사법적 해석법리를 구성하는 문제이다. 즉 복합차별을 금지하는 명시적인 입법이 존재하지 않는 한 입법적 제한의 대상이 될 수 없고, 하나 이상의 차별사유들과 그 속성들이 상호작용하여 차별적 결과에 미치는 효과를 실질적으로 분석할 수 있는 복합차별 분석을 구체화하는 것이 핵심적인 과제가 된다. 셋째, 단일사유를 중심으로 한 차별판단은 복합차별을 단순히 둘 이상의 차별사유들이 공존하는 상태만으로 인식하기 때문에, 둘 이상의 차별사유가 관련된 사안도 각 사유별로 차별판단을 하면 되고, 둘 이상의 차별사유들이 서로 상호작용하여 차별적 결과에 영향을 미치는 경우에도 단일사유에 대하여 간접차별 여부를 판단하면 족하다고 본다. 그러나 하나 이상의 차별사유들이 상호작용하는 복합차별 중 단일사유 차별판단을 병렬적으로 적용하거나 단일사유에 대한 간접차별 법리를 적용하더라도 차별을 파악할 수 있는 경우는 다양한 복합차별의 불이익 양상 중 일부에 불과하다. 하나 이상의 차별사유들이 공동으로 결합하여 고유한 새로운 차별적 결과를 야기하거나, 주된 차별사유에 다른 차별특성이 결합하여 차별적 결과에 공동으로 영향을 미치는 경우, 혹은 다른 차별사유에 결합하면서 동시에 독립적으로 차별적 결과에 상승효과를 미치는 경우 등 단일사유에 기반한 차별판단법리로는 다양한 복합차별을 온전히 파악하기 어렵다. 복합적 차별사유들의 다양한 결합방식과 새롭게 형성되는 불이익 양상을 누락시키지 않고 통찰력 있는 차별분석을 하기 위해서는 차별사유를 드러내는 차별특성들이 어떻게 상호작용하고 어떤 방식으로 집단 불이익을 야기하는지 사회구조적ㆍ맥락적 분석을 통해 통합적으로 접근해야 한다. 또한 하나 이상의 차별사유에 근거한 불이익 발생을 입증하기 위해, 차별특성들 전부를 공유하지 않는 개인이나 집단과의 유일한 비교만을 고집할 것이 아니라 차별특성의 일부를 공유하는 다양한 비교군들과 불이익의 동일성 또는 차이를 분석함으로써 차별사유들이 차별에 미치는 직간접적인 영향을 파악하는 복합차별의 비교분석방법을 적용하는 것이 중요하다. 특히 복합적 차별사유의 상호작용은 집단 불이익을 상호강화하는 상승효과가 있다는 점도 주목해야 한다. 오직 하나의 차별사유로는 차별적 결과에 이르지 못하는 경우에도 하나 이상의 차별사유들이 공동으로, 그리고 독자적으로 불이익 효과에 누적적인 영향을 미치면서 차별적 결과를 야기할 수 있기 때문이다.
고용상 복합차별은 근로관계가 장기간 지속되면서 차별사유들이 누적적이고 집중적인 상호작용을 하는 구조를 갖추고 있기 때문에, 이러한 복합차별 법리의 중요한 시사점들을 잘 보여준다. 첫째, 근로관계가 지속되는 과정에서 과거의 차별고용관행에 의해 형성된 차별적 근로조건에 다른 차별특성이 결합하여 새로운 차별적 효과를 야기할 수 있다. 둘째, 산업고도화 속에서 점차 근로관계에 대한 의사결정과정은 탈중심화되고 사용자 책임은 분산되어 차별금지의무의 주체가 모호하고 하나의 차별사유를 특정하는 것도 어려워진다. 셋째, 결과적으로 고용차별에서 복합적 차별사유들은 쉽게 분리되지 않은 채 불이익에서 상승효과가 나타날 가능성이 크다. 고용상 복합차별의 이러한 특성들로 인하여, 고용영역에서 단일한 차별사유를 특정하기는 더 어려워졌지만, 하나의 차별사유를 특정할 수 없는 사안일수록 사용자의 경영상 판단재량의 영역이라는 이유를 들어 차별을 정당화하려는 경향은 더 커진다. 그러나 이러한 특성이 고용상 복합차별의 고유한 성격임을 인식한다면, 사용자의 차별금지의무의 의미는 다양한 정체성을 수용하는 사용자의 적극적 주의의무로 이해될 수 있다.
국제사회는 다원화된 사회를 포용할 수 있는 포괄적 차별금지법 체계로 진전해가고 있다. 국제인권기구는 이미 수년 전부터 한국정부에 포괄적 차별금지법 도입과 복합차별 구제제도의 마련을 권고하고 있다. 한국의 고용차별법 체계는 복합차별을 다루기에 제한적인 입법구조를 취하고 있지만 복합차별 법리를 수용할 수 있는 법문언적 근거 역시 보여준다. 현행 체계에서 복합차별을 적용할 수 있는 사법적 해석기준을 제시하는 것은 향후 포괄적 차별금지법을 도입하고, 차별의 일반개념에 복합차별 개념을 통합적으로 적용하기 위한 입법적 토대가 될 것이다.

The intersectionality in discrimination law was first conceptualized by American feminist jurist Kimberlé W. Crenshaw in 1989, and since then, it has had a wide- ranging impact on a variety of academic disciplines from its legal background. Discussions in countries to legislate the concept of multiple discrimination and embrace intersectional discrimination analysis in discrimination laws have been ongoing for over 30 years. However, there has been almost no discussion of multiple discrimination in Korea. This is largely due to the Korean Supreme Court's narrow interpretation of the definition of discrimination.
Article 6 of the Labor Standards Act provides that ‘an employer shall neither discriminate against employees “on the grounds of” gender, nor take discriminatory treatment in relation to terms and conditions of employment “on the grounds of” nationality, religion, or social status.’ The Supreme Court explained that this means unfairly discriminating against a person “on the grounds only of” being a man or a woman. Because a single-axis framework of discrimination requires that only one identity be primarily or essentially the basis for discrimination, there is a risk that other discriminatory factors, even if they contribute to the adverse outcome, will not be considered as a basis for discrimination, but rather justified on the grounds that they are not discriminatory on the grounds in question. However, there is no legislative reason to support the Supreme Court's interpretation that discrimination must be based on a single ground. In fact, Korean anti-discrimination laws do not explicitly require that discrimination be judged on a single ground. The single-basis anti-discrimination laws(Framework Act on Gender Equality; Act on Prohibition of Age Discrimination in Employment and Elderly Employment Promotion) are limited, but leave open the possibility of addressing multiple discrimination, and in particular, ADPD(Act on the Prohibition of Discrimination against Persons with Disabilities, Remedy against Infringement of their Rights, etc.) recognizes multiple discrimination based on various discriminatory factors and requires the application of an intersectional discrimination analysis. Nevertheless, the Supreme Court's entrenched view of a single-axis framework leads people to recognize only single-axis discrimination and to make only single-axis claims. If it is believed that a single-axis discrimination claim will not be successful because of multiple discriminatory factors, people will not bring discrimination claims at all, and if they do, the intersectionality of discrimination will be invisible because discriminatory factors other than the alleged ground will not be considered.
In order to analyse the complexity of discrimination through the lens of inter- sectionality in Korean discrimination law practice, it is important to establish a proper perspective on the concept and jurisprudence of multiple discrimination. First, in a judicial environment where the single-axis test is entrenched, discrimination is generally thought of as being based on a single ground of discrimination, while intersectional discrimination is perceived as a combination of two or more grounds of discrimination, and as an exceptional and special type of discrimination that is different from general discrimination. Therefore, it is understood that a separate mechanism is required to identify intersectional discrimination, which is completely distinct from the general approach to discrimination analysis.
Secondly, in contrast to the general definition of discrimination, if multiple discrimination is understood as an exceptional form of discrimination arising from two or more grounds of discrimination, it is easy to dismiss the question of legal acceptance of multiple discrimination as a legislative policy issue, and thus to conclude that there is no point in examining multiple discrimination in the absence of a definition of multiple discrimination in anti-discrimination legislation. It is true that the adoption of comprehensive anti-discrimination legislation is a legislative condition more conducive to multiple discrimination analysis. However, multiple discrimination is part of the general concept of discrimination, and its acceptance is a matter of judicial interpretation: it cannot be subject to legislative restriction in the absence of an express provision prohibiting its application, and the key challenge is to formulate multiple discrimination in a way that substantially analyses the interactive effects of one or more discriminatory grounds and their characteristics.
Third, because the single-axis approach recognises multiple discrimination as simply the co-existence of two or more grounds of discrimination, it is sufficient to make a discrimination finding on each ground in cases involving two or more grounds of discrimination, and to determine whether the interactive effect of two or more grounds of discrimination is indirect discrimination on a single ground. However, the multiple discrimination that can be identified by applying the parallel or indirect effect analysis of the single-axis approach is only one of many patterns of disadvantage that arise from the interaction of grounds of discrimination. A single-axis analysis of discrimination does not fully capture the different patterns of disadvantage in multiple discrimination, such as when one or more grounds of discrimination combine to create a unique new discriminatory outcome, or when a primary ground of discrimination is combined with other discriminatory characteristics to jointly affect the discriminatory outcome, or when one ground of discrimination affects the discriminatory outcome both in combination with other grounds of discrimination and independently. An insightful approach to discrimination that does not miss the different ways in which grounds of discrimination combine and the emerging patterns of disadvantage requires an integrated approach to the nature of disadvantage as grounds of discrimination interact in social structures and contexts. In addition, to demonstrate the occurrence of adverse outcomes based on more than one ground, the direct and indirect effects of discrimination should be analysed by looking at the same or differential disadvantage across a range of comparator groups that share some of the discriminatory characteristic, rather than focusing on a sole mirror comparator that does not share all of the discriminatory characteristic. In particular, it should be noted that the interaction of multiple grounds of discrimination can have a synergistic effect that mutually reinforces group disadvantage. Even if a single ground of discrimination alone does not lead to a discriminatory outcome, one or more grounds of discrimination may jointly and independently have a cumulative impact on the adverse effect, leading to a discriminatory outcome.
Multiple discrimination in employment is characterised by the cumulative and intensive interaction of discriminatory factors over the course of a long employment relationship, which illustrates some of the important implications of this multiple discrimination doctrine. First, discriminatory conditions and circumstances created by past discriminatory employment practices can cumulatively combine with other discriminatory characteristics to create new discrimination. Second, with increasing industrialisation, the decision-making process in the labour relationship is decentralised and the responsibility of the employer is dispersed, thus blurring the subject of the non-discrimination obligation. As a result, multiple sources of discrimination in employment are not easily separated and are likely to have a synergistic effect on disadvantage. In this employment environment, where it is more difficult to apply a single-axis discrimination analysis, the more difficult it is to identify a single ground of discrimination, the greater the tendency of employers to justify discrimination by arguing that it is an area of managerial discretion. However, recognising the unique nature of multiple discrimination in employment, the meaning of an employer's non-discrimination obligation can be understood as an affirmative duty to accommodate multiple identities.
The international community is moving towards a comprehensive anti-discrimination legal framework that is inclusive of a pluralistic society. The United Nations has been recommending that South Korea adopt comprehensive anti-discrimination laws and establish multiple discrimination remedies for several years. While South Korea's anti-discrimination law on employment relations has a limited legislative framework for addressing multiple discrimination, it also demonstrates the legal basis for applying the multiple discrimination doctrine. Providing a judicial interpretation standard for the application of multiple discrimination in the current legal framework will provide a legislative foundation for the adoption of a comprehensive non-discrimination law in the near future and the incorporation of a multiple discrimination definition into the general concept of discrimination.
