지적재조사특별법(안)에 관한 비교 연구 = A Comparison & Study of the Special Act on Cadastral Resurvey(draft)

국문 초록 (Abstract)

본 연구의 목적은 내무부와 대한지적공사 및 국회에서 입안하였던 지적재조사특별법(안)의 내용 중에서 지적공부에 등록하는 기본정보와 국민의 재산권 행사에 직접적으로 관련이 있다고 판단되는 규정을 비교 연구하여 재검토 과제와 신규검토 과제를 제시하는 데 있다.
연구결과 첫째로 재검토 과제는 지적공부에 등록하는 기본정보인 “지번, 지목, 면적, 경계” 등이 있고, 둘째로 신규검토 과제는 “투자비용의 회수, 경계의 확정, 지적공부의 공신력” 등이 있는 것으로 분석되었다.
따라서 위와 같은 재검토 과제와 신규검토 과제를 집중적으로 연구하여 지적재조사특별법(안)에 반영함으로써 지적에 관한 법률과 차별화하고 새로 작성하는 지적공부의 등록사항에 대한 공신력을 인정하면서 다목적지적제도로 개편할 수 있도록 지적재조사사업을 추진할 것을 제안한다.

다국어 초록 (Multilingual Abstract)

The purpose of the present research is to suggest review and new investigation subjects by comparatively examination the basic information registered in the Cadastral Record and regulations judged to directly have relations with use of property rights among the contents of the Special Act on Cadastral Resurvey(draft) that drew up at the Ministry of Home Affairs, Korea Cadastral Survey Corporation and National Assembly since 1996.
As a result of this research, first, the review subject is “Parcel Number, Land Category, Area and Boundary” which are basic information being registered to the Cadastral Record. Second, it was analyzed that the new investigation subject is “recovery of investments, fixing of a boundary and public trust,” etc.
Accordingly, by intensively researching the above review and new investigation subjects and reflecting it to the Special Act on Cadastral Resurvey(draft), this research proposes promotion of the Cadastral Resurvey Project to be reorganized to a Multipurpose Cadastral System while recognizing the laws on a land register and the public trust on registration items of the Cadastral Record.
