Traditionally, violence related to husband and wife is unlikely to be exposed outside because speaking out that problem is regarded to be disgraceful in korean culture.
However, the strong opinion against domestic violence has been increasing, in that sometimes domestic violence leads to serious crime like a serious wound, homicide and has an influence on children's behavior. Those opinion made the government to initiative 'the special act of regarding domestic violence' and request the public service like the police to get involve in domestic violence.
Unfortunately, it is true that the intervention of the police and other government organization has been insufficient and passive. This phenomenon represents the concept of the police about domestic violence. It seems that the police still handle the domestic violence as a trivial family problem and don't comprehend their legal action against domestic violence.
Based on the current situation and problems that mentioned earlier, this research is focused on the problem of police response and done to suggest possible solutions. For those purposes, many of documents have been examined and a thorough interview with the victims of domestic violence prosecuted.
This research has found the problems of the police response like following:
First, there are some misconduct at the level of the first reaction of the police. Normally, most adult korean are reluctant to call the police about domestic violence around neighbor or even in their family. Also, the police reaction is prone to be delayed when compared to other emergency calls, such as kidnapping and homicide.
Second, at the level of domestic violence scene seems the investigation of the police to be carried out unsuccessfully. The proper explanation of the victim's right and way to punish the attacker should be informed to the victim at the scene by the specialized and trained police officer in those field. Without those explanations could additional domestic violence happen.
Third, in the current 'the special act of regarding domestic violence' is the legal ground for the police to intervene and arrest the attacker very insignificant and that pitfall may puzzle the police in their action related to the response to domestic violence. Especially, makeshift measures and pobational management have to be improved in terms of law.
Forth, after the duty of the police are additional rehabilitation and correction programmes followed. Not only for the victims, but also for the attackers are those programs equipped with speciallized consultant inevitable. There are several government-supported organizations running those programs but couldn't keep up with the rising trend of domestic violence.
In conclusion, this research could prepare several solutions like followings.
First of all, the government should support the prevention instruction of domestic violence for eliminating domestic violence. This method ought to provide correct definition, possible effects and punishment of the domestic violence to all members of society regardless of age or sex.
Second of all, the special act of regarding domestic violence is to be revised. With the upgraded legal basis could the capability of the police in domestic violence scene be enhanced, from arresting to post-check up the attacker. Moreover, for the safety of the victim is probationary activity right to be entitled to the police and the range of the received to be enlarged. Also, the correct and rehabilitation system should be developed, with support by the evalutaion tactics that could used to predict risk degree of attackers.
