난개발 방지를 위한 개발행위허가제도 개선방안 연구 : 화성시를 대상으로 = A study on improvement of development permit system to prevent the unsustainable development. - A case study on Hwasung City -

국문 초록 (Abstract)

난개발이란 개발에 따른 외부 불경제 효과 등 부정적인 측면을 총칭하는 개념으로 사전계획 없이 무계획적으로 이루어진 개발을 의미한다. 이러한 난개발은 환경의 보존과 개발을 실현하고 질적인 삶을 추구할 수 있는 도시의 환경의 질적 발전에 큰 걸림돌이 되고 있다.
특히, 화성시의 경우 최근 급격하게 증가되고 있는 개발로 인하여 기반시설의 부족현상, 각종 환경오염 등 난개발로 인한 부정적인 영향으로 인해 삶의 질이 위협받고 있다.
따라서 본 연구는 화성시 난개발 지역에 대한 현황 검토와 이에 대한 개선방안 및 현 제도의 올바른 방향을 정립하며, 제도상 문제점을 도출하고 개선방안을 제시하기 위한 목적으로 수행되었다.
본 연구의 성과는 다음과 같이 요약·정리될 수 있다.
첫째, 난개발 방지를 위한 개발행위허가 제도개선을 위하여 난개발, 개발행위허가제에 대한 개념과 원리 및 의미를 파악하여 그 문제점과 필요성을 제시하였다.
둘째, 관련 문헌 조사를 통하여 국내·외 난개발 방지 정책에 관한 고찰을 실시하였으며, 또한, 난개발과 개발행위허가제도에 대한 선행연구를 통해 최근의 흐름 및 제도 개선의 방향에 대해 분석하였다.
셋째, 화성시를 대상으로 난개발 현황 분석 및 난개발 방지 정책에 대해 검토하고, 화성시 난개발의 주요요인인 공장, 소매점, 단독주택을 중심으로 연접개발 규정의 적용 여부에 따라 공간적으로 구분하여 제도개선을 도모하였다.
넷째, 난개발 방지를 위한 개발행위허가제의 주요 내용에 대한 개선방안과, 연접개발 규정을 중심으로 공간을 구분하여 공간별 적용제도 개선을 제시하였다. 또한, 용도지구를 통한 제도 개선을 제시하였다.
다섯째, 바람직한 개발행위허가 제도의 개선을 위하여 전문가의 의견을 수렴하여 화성시의 지역실정에 맞는 개발행위허가 제도를 개선하기 위하여 전문가 설문조사를 실시하였다. 설문조사는 ① 난개발 현황, ② 난개발 방지를 위한 제도개선으로 구분하였으며 10개의 영역, 총 22개의 설문문항을 대상으로 실시하였다.
여섯째, 화성시에서 적용되고 있는 상위 법·제도, 화성시 도시계획 조례, 화성시 개발행위허가 운영지침을 대상으로 제도 개선방안을 제시하였다.

다국어 초록 (Multilingual Abstract)

The unsustainable development is defined as a general conceptional term of all the economical side-effects pertinent to and resulting from the developments made both without thoughtfulness and with no preliminary designing plans. Those kinds of developments are vividly blocking the environmental Qualitative Growth of cities paving the way for better life standard through both conservation and development of the environment.
In particular as for Hwasung City, the rapidly increasing unsustainable developments are now threatening the life quality resulting from such negative effects as lack of infrastructure, various environmental pollution, etc.
Thus the study is focused on reviewing the status of unsustainable developments areas in Hwasung city and finding improvement, furthermore guild lining the existing system and finding the problems and renovating it
The results of this study are outlined as follows;
First of all, It proposes the disputed point and need over clearing the comprehension of the development behavior permit system to renovate it for preventing the unsustainable development.
Secondly, a research is made through bibliographic reference survey on policies preventing the unsustainable development unveiled nationwide and overseas, including a preliminary study on the unsustainable development and its related regulation systems to catch up with the recent trend of regulation reforms.
Thirdly, it reviews overall present status of unsustainable development and its enforceable prevention regulations shown at Hwasung City so as to bear improvement ideas by dividing the space, subject to the application of an adjacency development regulation, centering on such main factors causing thoughtless development as factories, retail shops and detatched houses.
Fourthly, it introduces the improvement of spatial application concept by splitting the space in accordance to adjacency development regulations as well as improving ways for permissive regulations preventing thoughtless development. It also suggests improving related system by way of adoption of utilization lots.
Fifthly, a poll was made to collect experts' viewpoints as a means of improving permit system quite suitable to Hwasung city's actual condition. The questionnaire includes 10 categories, 22 questions, divided into two topics; 1) real situation of thoughtless development, 2) systematic improvement for its prevention.
Finally, it guidelines system improvement ways focusing on the superior law,system applied to Hwasung City, its urban planning ordinances and operational principles regarding permission of development conducts.
