Various construction works are enforced since the recent expansion of social overhead capital, but due to the induced noises and vibrations from these constructions, there is a sudden increase of cases where livestock undergo major sufferings. All the blasting noises, vibrations, dusts and other byproducts of constructions from various, expansions and newly-built highways, roads, multi-lane railroads, sewage disposal plants, farms, and more occurring near cowsheds and pigsties have negative effects on the animals, and there is a rapid growth in the number of complaints from the farmhouses. Especially when the victimized subject is livestock, the level of counteraction and effects display very different aspects not only from the physical properties of the origination of the noises but also from the outer stress including progression level of domestication, breed, age, and impregnation as well as environmental elements of the surroundings.
In this study, we will analyze mediation examples of National Environmental Dispute Resolution Commission, an affiliated organization of Ministry of Environment, and coordinate a system that will ensure adequate compensation by calculating levels of criticality and damage on livestock before and after constructions by aggressively coping at the beginning of constructions for more efficient construction progressions and minimize unnecessary prolongation.
Of the 1,578 complaints processed in National Environmental Dispute Resolution Commission, the damages due to noise and vibration constituted 86% and 82% of damage contents, and the average processing period was 5.6 months. Among these complaints, livestock-related damages compose 15% and are constantly occurring every year.
The types of livestock damages can be classified into direct, indirect and other expense, and the person who received the damage must file the papers in person to include them in the damage calculation. The damage investigation must be performed in the fields of veterinary science and engineering, and the damage calculation shall be done after establishing the relation of cause and effect by carrying out assessments about the level of noise and examining related materials.
If the damage was inflicted on the Korean beef cattle, the calculation shall thoroughly incorporate the scale of business, form of the barn, breeding environment and system, estimated level of noise, and the physiology of the cattle, and then deliberate on stillbirths, miscarriages, and rate of declination of breeding coefficient.
