연쇄범죄의 수사전문화제도에 관한 연구 : 경찰수사를 중심으로 = (A) study of specialization of criminal investigation system for serial crimes : with emphasis on police criminal investigation

국문 초록 (Abstract)

유○○과 온○○, 지존파, 막가파 등 연쇄살인사건과 성범죄자의 상징으로 불리는 속칭‘발바리’라는 명칭의 각종 성범죄사건이 빈발하고 있다. 거기에 더하여 연쇄방화사건 또한 수시로 발생하고 있다. 이에 따라 연쇄범죄에 대한 수사 기능적 대응방안이 신속히 구축되어야 한다는 의견이 대두되고 있다. 최근에 이르러 연쇄범죄 현상에 대하여 많은 학자들이 다양한 관점에서 연구를 하고는 있지만 아직까지 제대로 된 연쇄범죄 관련 연구가 학문적인 틀을 잡지 못하여 그 중심적인 주제와 논점의 혼돈 현상이 있으며 정작 범죄수사라는 관점에서 이를 분석, 연구하는 자세가 정립되어 있지 못한 상황이다.
연쇄범죄는 이른바 선진국형 범죄로서, 경제발전에 필연적으로 동반되는 명과 암의 양면을 보여주는 범죄 양상이라고 할 수 있다. 명실공이 세계 10대 경제대국으로 성장한 우리나라도 그 범죄 양상에서 비켜갈 수는 없는 것으로 보여 진다. 연쇄범죄에 대한 별도의 연구를 통하여 이에 대한 적절한 대책과 수사대응책을 구축하지 않는다면 연쇄범죄는 결코 줄지 않고 지속하여 발생할 것이다. 연쇄범죄를 예방하는 것은 오로지 검거이다. 그것도 조기에 신속하게 검거하지 못하면 그 피해는 가늠하기 어려운 지경에 이르게 된다. 본 논문은 연쇄범죄의 유형과 특성, 원인 등을 분석하고 이를 바탕으로 하여 다양한 연쇄범죄의 사례를 분석한 후, 그 결과를 도출하여 우리나라에 적합한 연쇄범죄 수사제도의 전문화 모델을 구성해보는 데 있다.
부분적이긴 하지만 기존의 연쇄범죄를 수사했던 연구자의 경험을 바탕으로 이론과 실무가 적절히 작용하여 실제로 수사과정에 작은 기여가 되었으면 한다.
연구에 있어, 연쇄범죄의 유형과 특성, 원인에 대한 분석은 기존의 연쇄범죄와 관련한 선행연구 및 사례 연구, 각종 저술과 논문, 언론 기사와 방송 내용을 바탕으로 진행하고자 하며, 유형과 특성, 원인 등을 세분화 하여 단순하게 연쇄범죄라는 하나의 범위가 아닌 그 안에서도 개별적이고 고유한 특성이 있는 부분들을 찾아내어 이를 기반으로 분류하였으며, 각종 연쇄범죄사건들을 정밀하게 분석하고 각 사건들이 가지는 특성들을 도출하여 연쇄범죄가 일반범죄에 비하여 어떠한 부분이 확실히 다른지 정리하였다.
외국의 범죄 사례들은 미국과 유럽을 중심으로 하였고, 세계경찰기구나 세계범죄학회, 미 연방수사국(FBI)이 공식적으로 인정하는 사건만 연구대상으로 하였다. 국내 사례들은 경찰청에서 연쇄범죄로 인정하는 사건들을 인용하였으며 이를 위하여 경찰청, 경찰교육원, 경찰수사연수원, 중앙경찰학교, 경찰대학, 과학수사연구원 등의 각종 교육자료 및 연구 자료를 수집하고 그 중 본 논문에 필요한 부분만을 발췌하였다.
보다 효과적이고 객관적인 연구를 진행하기 위하여 각종 학술 서적과 대학교재, 수사관련 매뉴얼, 외국의 수사제도 문헌, 논문을 중심으로 연구를 수행하였다. 논 논문은 이론적인 측면이 아닌 실무적인 측면에서 수사제도 개선을 통한 연쇄범죄 대처방안 강화를 목적으로 하기 위하여 제도론적인 내용보다는 수사과정상의 제도론적 내용에 중점을 두었다.
이제 연쇄범죄는 이미 우리나라에 보편화된 범죄양태이다. 이미 자리를 잡았다고 보아도 무방하다. 이를 예방하고 검거하기 위해서는 연쇄범죄와 관련된 정보의 취합 및 분석, 추가적인 범행의 예방을 위하여 우리 사회의 전반적인 관심이 필요하다. 모두의 노력으로 우리나라에서 연쇄범죄는 반드시 검거되고 처벌된다는 원칙을 확립하여 더 이상 연쇄범죄가 발생하지 않았으면 한다.

다국어 초록 (Multilingual Abstract)

The number of serial murders of Yu○○, On○○, Jijonpa, and Makgapa, and various sexual crimes of sexual criminals nicknamed 'Balbari', is increasing. In addition to that, serial arson also occurs from time to time. Many people argue that a functional investigation system should be constructed for serial crimes. Many scholars are studying serial crimes from various perspectives nowadays, but there is no academic framework for the study of serial crime, causing a confusion of main topics and theses. Serial crimes are still not analyzed or studied from the perspective of criminal investigation.
Serial crime is so-called the crime of advanced countries and the type of crime that shows the two sides of the coin that inevitably follows the economic development. It seems that Korea cannot evade this type of crime as the 10th greatest economic nation in the world.
If serial crime is not studied separately and appropriate measures and investigational counteractions are not developed, it will never decrease, but it continues to occur. The only way to prevent serial crimes is arresting. If the criminal is not arrested in the early stage, the damage would be impossible to estimate.
This study analyzed the types, characteristics, and causes of serial crime to analyze various cases of serial crimes and develop a specialization model of criminal investigation system for serial crimes suitable for Korea based on the results. It does not cover every aspect, but I hope that my experience of studying serial crimes and my background knowledge can make a substantial contribution to actual investigation.
The analysis of the types, characteristics, and causes of serial crime was based on the preceded studies and case studies on serial crime, various publications and theses, press articles, and broadcasting resources. The types, characteristics, and causes were categorized and classified into different categories with individual and original characteristics. Various serial crimes were analyzed in detail to derive the characteristics of each case to clarify how serial crimes are different from ordinary crimes.
The cases of foreign crimes were focused on the U.S. and Europe and only the cases officially acknowledged by the International Criminal Police Organization, the International Society for Criminology, or the U.S. Federal Bureau of Investigation. The local cases of Korea adopted the cases acknowledged as serial crimes by the National Police Agency. For this purpose, various educational resources and research resources were collected from the National Police Agency, Police Training Institute, Korea Police Investigation Academy, Central Police Academy, Korea National Police University, and National Forensic Service, and the necessary information was excerpted for this study.
For a more effective and objective study, various academic books, college materials, investigation manuals, literature on foreign investigation systems, and relevant theses were referenced. This study focused on the systemic method of investigation procedure in the practical aspect rather than theoretical aspect to strengthen the counteraction to serial crimes.
Serial crimes have already become popular in Korea. It can be said that they have already settled in Korea. In order to prevent them and arrest the criminals, the entire society's interest is needed to gather and analyze the relevant information to prevent additional criminal acts. I hope that everyone's effort comes together to establish the principle that all serial criminals are arrested and published in Korea to prevent any serial crimes in the future.
