도시정비사업의 공공관리제도 효과성 분석 조사 연구

낙후된 공간을 재설계․재배치하여 쾌적하고 안락한 주거환경을 형성하기 위한 과정이 도시정비사업이다. 그러나 주민의 주거생활의 질을 제고하려는 도시정비사업이 본래 취지를 벗어나면서 많은 문제점과 부작용을 양산하게 되었다. 구체적으로 사업을 추진하는 과정에서 주민참여제도 부재, 정비구역지정의 비현실성, 비합리적인 조합임원의 임기 규정, 행정관청의 형식적 관리, 잦은 규정 변경 등의 제도적인 문제, 그리고 추진위 및 조합 임원의 비전문성, 추진위 및 조합운영의 불투명성, 협력업체 담합 및 과당경쟁 입찰, 잦은 사업계획 변경, 사업비용 상승 등 비제도적인 문제가 다양하게 나타났다.
서울시는 도시정비사업의 문제점을 해결하기 위해 공공관리제도를 시행하고 있다. 공공관리제도를 통한 노력에도 불구하고, 또 다른 문제가 나타나고 있다. ① 조합의 자금 조달의 어려움, ② 주민 재산권 침해 우려, ③ 세금사용의 형평성 문제, ④ 공공관리제 적용으로 인한 사업지연, ⑤ 미숙한 업무처리로 인한 갈등유발, ⑥ 상위법인 도정법과의 충돌문제 등이 제기되고 있다. 이러한 공공관리제도의 문제점이 발생하는 가운데 제도의 효과가 있는지 없는지 파악하는 것이 중요하다.
따라서 본 연구에서는 공공관리제도에 대한 기본적인 인식을 파악하고, 그 효과가 현재까지 어느 정도 나타났는지 또한 앞으로 어느 정도 나타날 것인지를 분석하였다. 또한 공공관리제도 시행이후 제도에 대한 문제점을 조사하고 이에 대한 해결방안을 제시하였다.
분석결과, 공공관리제도에 대한 홍보가 더 필요한 것으로 나타났다. 공공관리제도 시행 찬성여부의 경우, 응답자의 절반 정도가 반대하는 것으로 나타났다. 반대하는 이유로 공공관리자(구청장 등)의 비리발생우려가 가장 큰 이유로 꼽혔다. 제도의 효과와 관련하여, 현재까지의 효과보다 앞으로의 효과가 더욱 크게 나타날 것으로 기대하고 있었다. 공공관리제도 시행으로 인한 문제점을 해결하기 위해서, 공공관리자의 비리를 방지할 수 있는 제도적 장치가 요구되었다. 또한 전문가 및 주민 참여의 보장이 요구되었다.

A Study on the Effectiveness of the Public Management
System in the Urban Redevelopment Projects



The Urban Redevelopment Projects is the process to build up comfortable residential environment from redesigning and relocating backward places. However, it caused many problems and side effects with deviating from main purpose of the urban redevelopment projects. To be specifically, during the process of the projects, diverse problem such as increasing of project cost, frequent project plan change, collusion of cooperation corporations and over competition bids, non-professionality of promotion committee and union official, opacity of committee and union operation, systematic problem(irrational term rule of union official, superficial management of administration, frequent change of the rule, unreality of redevelopment area determination, absent of resident participation system) have been arising.
Although Seoul implement Public Management System to settle the problems of the Urban Redevelopment Projects, other problem has been encountered. ① difficulty of raising fund of union, ② concern with trespassing of property right of local resident, ③ equity problem of tax using. ④ project procrastination according to application of the Public Management System, ⑤ conflict emerging caused by clumsy work, ⑥ conflict with higher regulation (Urban and Residential Environment Maintenance Law). Among these peroblems of the Public Management System, it is important to understand the effectness of the system.
This research is to understand fundamental perception of the Public Management System and analyze how much its effects have been produced so far and will be emerged. Also, I examine the problems of the Public Management System and suggests implications to settle it.
From the results, it could ascertain that more public relations about Public Management System should be needed. More than half of the responses oppose the implement of the Public Management System, and concerns for corruption of manager is the primary reason of oppose. Related with effectiveness of the system, respondents are expecting that further effectiveness will be bigger than the one of so far. To settle the problem of the implement of the Public Management System, institutional instruments are needed prevent corruption of the mangers and to secure participation of experts and local residents.
