Urban redevelopment and reconstruction projects account for a substantial share of housing supply in Korea. However, prolonged stagnation or delays in these projects are caused not only by institutional and market-related factors, but also by internal operational factors of project associations composed of landowners and other rights holders, including decision-making structures, contract management, fund execution, and information disclosure. In actual project sites,
various violations such as conflicts over general meetings, failure to disclose information, accounting irregularities, and disputes over service contracts have repeatedly occurred, often leading to internal conflicts within associations and subsequent project delays. While previous studies have mainly relied on surveys or case studies, empirical research using nationwide official administrative data to analyze the characteristics of violations remains relatively limited.
Accordingly, the purpose of this study is to identify the characteristics of violations in housing redevelopment and reconstruction projects by violation type, project stage, and administrative disposition outcome, based on inspection cases of association operations. This study uses data from association operation inspections conducted by the Ministry of Land, Infrastructure and Transport and local governments from April 2021 to February 2026. The scope of analysis covers a total of 1,670 violation cases identified in 110 redevelopment and reconstruction project zones nationwide.
The main findings of this study are as follows. First, based on the inspection manual of the Ministry of Land, Infrastructure and Transport, violations were classified into four categories: service contracts and project costs, association administration, fund management and accounting, and information disclosure. Since association operation inspections focus on violations occurring after the approval of association establishment, project stages were classified into the stages of project implementation plan approval, management and disposal plan approval, construction commencement, and project completion.
Second, in terms of violation type, fund management and accounting violations occurred most frequently, followed by service contract and project cost violations, association administration violations, and information disclosure violations. More specifically, violations related to contractor selection procedures were most frequent in the category of service contracts and project costs; violations related to decision-making bodies were most frequent in the category of
association administration; violations related to audits and settlement of accounts were most frequent in the category of fund management and accounting; and violations related to information disclosure obligations were most frequent in the category of information disclosure.
Third, by project stage, violations occurred most frequently during the project implementation plan approval stage, followed by the management and disposal plan approval stage, construction commencement stage, and project completion stage. In detail, violations related to service contracts, project costs, and association administration were mainly found during the project implementation plan approval stage. During the management and disposal plan approval stage, violations related to fund management, accounting, service contracts, and project costs were relatively frequent. In the construction commencement and completion stages, fund management and accounting violations were the most common.
Fourth, the case analysis by violation type identified several major causes of violations. Violations related to service contracts and project costs were mainly caused by insufficient budget formulation and approval at general meetings, as well as inadequate review of requirements for applying bidding methods. Association administration violations were associated with poor preparation and management of internal regulations, improper management of business documents, and insufficient operation of committees. Fund management and accounting violations were caused by inadequate management of accounting
regulations, insufficient appropriateness in borrowing and managing funds, and deficiencies in budget planning and execution. Information disclosure violations were mainly related to non-compliance with disclosure requirements, failure to provide quarterly written notices, and inadequate preservation of records.
Finally, regarding administrative disposition outcomes, administrative guidance and corrective orders were mostly imposed for violations related to fund management, accounting, and association administration, while recovery measures were overwhelmingly concentrated in fund management and accounting violations. However, in the categories of information disclosure and service contracts and project costs, more serious measures, such as referral for investigation or filing of complaints, were relatively frequent. This suggests that violations related to information disclosure and contract management are legally significant because they are directly connected to association members’ right to know, financial burdens, and fairness in contract procedures.
The significance of this study lies in its identification of the structural background of violations within project associations through an analysis of violation characteristics and causes. Based on these findings, this study presents policy implications for improving transparency in association operations, standardizing
contract and accounting management procedures, strengthening the information disclosure system, and expanding the preventive function of association operation inspections. Furthermore, by empirically analyzing the characteristics of internal violations using nationwide official inspection data, this study can serve as a policy basis for preventing violations and normalizing housing redevelopment and reconstruction projects.
