「특정법」 시행에 따른 지적활동에 관한 연구 = A Study on Cadastral Activity by 'Specific Law'

국문 초록 (Abstract)

본 연구의 목적은 특정법의 실태를 조사ㆍ분석하고, 이를 토대로 특정법으로 인한 지적활동의 유형과 시사점이 무엇인가를 제시하는 데 있다. 이를 위해 연구대상을 특정법으로 한정하고, 시간적 범위는 1980년부터 현재까지로 하며, 공간적 범위는 우리나라로 한정하였다. 조사방법으로 문헌조사법, 법령조사법, 인터넷조사법을 병행하였으며, 분석방법으로는 기술적 분석방법을 사용하였다.
연구 결과, 지적활동의 대표적 유형으로는 첫째, 실체적 활동으로서 물리적인 건축물과 필지의 면적획정활동 둘째, 절차적 활동으로서 물리적인 건축물과 필지에 대한 등록활동 셋째, 관리적 활동으로 물리적인 건축물과 필지에 대한 공시활동으로 나타났다.
특정법 시행이 지적계에 시사하는 점으로는 첫째, 지적학계는 지적업계와 지적관계가 발전할 수 있는 기초이론을 제공해야 하고 둘째, 지적업계는 지적관계의 지도아래 지적학계가 제공한 기초이론을 토대로 발전전략을 수립하며 셋째, 지적관계는 지적학계와 지적업계가 발전할 수 있도록 지원과 지도를 해야 하고 넷째, 지적계는 지적제도의 발전을 위해 상호간에 역할분담을 철저히 해야 하는 것으로 나타났다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to investigate and analyze the present condition of the specific law and based on such data it is aimed at putting forward the questions about the implication and the type of the cadastral activity by a specific law. To this end, the study target was limited to the specific law, the temporal scope was defined from 1980 to the present and the spacial scope is limited to our country. The investigation has been combined with the literary study method, legislation study method and internet search method. As for the analysis method, a descriptive analysis method was adopted.
The findings support that the main type of the cadastral activity has turned out (1) area demarcation of the physical building structure and land as a substantial performance, (2) registration on the physical building structure and land as a systematical performance and (3) public announcement on the physical building structure and land as an administrative performance.
As for what implicated on the cadastral community by the enforcement of the specific law, it turned out that first the cadastral academic circle should provide a basic theory to help make it progressive with the cadastral businesses and cadastral administration authority; second the cadastral businesses should establish a development strategy based on such basic theory provided by the cadastral academic circle under the guideline of the cadastral administration authority; third the cadastral administration authority should provide the support and guideline so that both cadastral academic circle and the cadastral businesses can be more progressive; and fourth the cadastral community should take their full responsibilities for each other for the progress of the cadastral system.
