동물대체시험법 활성화 법률 제정에 관한 연구 동물실험은 오랫동안 의약품, 화학물질 및 화장품의 안전성 평가를 위한 주요 시험방법으로 활용되어 왔다. 그러나 동물복지에 대한 요구가 확대되고 동물모델의 과학적 한계가 지속적으로 제기되면서, 동물대체시험법을 규제체계에 수용하고 그 활용을 촉진하기 위한 법제 개편이 국제적으로 확산되고 있다. 반면 우리나라의 법제는 관련 규정이 개별 법률과 행정기관에 분산되어 있어 대체시험법의 개발, 검증 및 규제 수용을 일관되게 추진하기 어려운 한계를 가진다. 이에 이 논문에서는 우리나라 동물복지에 대한 국가의 의무, 동물대체시험법 의 법적 지위와 규제체계를 고찰하고 대체시험법 활성화를 위한 기본법 제정 방안을 제시하는 것을 목적으로 하였다. 특히 개별 법률의 부분적 개정만으로는 해결하기 어려운 제도적 한계를 개선하기 위한 통합 입법 방안을 모색하였다. 이를 위하여 국내 법령과 입법안을 검토하고, 주요 국가의 법제와 비교 하여 개선 방향을 도출하였다. 구체적으로는 「동물보호법」, 「실험동물법」, 「화학물질의 등록 및 평가 등에 관한 법률」, 「화장품법」 등 국내 관련 법령과 입법안과 미국, 유럽연합, 독일 및 경제협력개발기구의 법제를 분석하였다. 특히 대체시험법의 법적 정의, 국가 검증기관의 운영, 규제 수용 절차 및 행정기관 간 협력체계를 중심으로 검토하였다. 연구 결과, 현행 법제의 한계는 용어의 불일치, 검증체계의 미비, 규제 수용 절차의 단절이라는 세 가지 쟁점으로 정리할 수 있었다. 현행 법제는 대체시험법을 개별 법률에 분산하여 규율함으로써 용어와 적용 기준이 일관되지 않고, 국가 검증기관의 법적 근거와 권한이 충분하지 않아 검증 결과가 위해성 평가와 안전성 심사에 체계적으로 반영되지 못하는 한계를 확인하였다. 또한 대체시험법의 개발, 검증 및 규제 수용이 하나의 행정체계로 연계되지 못하고, 부처 간 협력체계 역시 법률에 명확히 규정되어 있지 않음을 확인하였다. 반면 미국, EU 및 독일은 국가 차원의 검증기관을 중심으로 범부처 협력체계 를 구축하고, 검증 결과를 규제 절차와 연계함으로써 대체시험법을 규제체계 안에서 활용할 수 있는 제도적 기반을 마련하고 있었다. 이러한 검토 결과를 바탕으로 본 연구는 「동물대체시험법 활성화 법률 (안)」을 제안하였다. 제안 법률안은 대체시험법의 통일된 법적 정의를 마련하고, 국가와 관계 행정기관의 책무를 규정하며, 국가 검증기관의 법적 지위와 기능을 명확히 하고, 범부처 협력체계를 구축하는 한편, 검증된 대체시험법이 규제 절차에서 활용될 수 있는 법적 기반을 마련하는 것을 주요 내용으로 한다. 이를 통해 대체시험법의 개발·검증·규제 수용을 하나의 법체계 안에서 연계하고, 연구개발 단계의 기술이 규제 기준으로 활용될 수 있는 법적 기반을 제시하고자 하였다. 본 연구는 대체시험법의 활성화를 위해서는 개별 법률의 부분적 개정보다 국가 차원의 기본법 제정이 필요함을 제시하였으며, 기본법을 통하여 대체시험법의 검증과 규제 수용을 연계하고, 범부처 협력체계를 구축함으로써 동물 복지와 안전성 평가의 과학적 신뢰성을 함께 확보하기 위한 입법 방향을 제안하였다는 점에 의의가 있다.

Animal testing has long served as the primary method for evaluating the safety of pharmaceuticals, chemicals, and cosmetics. However, growing concerns for animal welfare and the recognized scientific limitations of animal models have accelerated legislative efforts worldwide to incorporate alternative methods into regulatory decision-making and promote their use. In contrast, the Korean legal framework remains fragmented, with relevant provisions dispersed across multiple statutes and administrative agencies, making it difficult to establish a coherent system for the development, validation, and regulatory acceptance of alternative methods.
This study examines the legal status of alternative methods to animal testing and the Korean regulatory framework from the perspective of administrative law and proposes the enactment of a comprehensive basic act to promote their implementation. To this end, it analyzes major domestic legislation, including the Animal Protection Act, the Laboratory Animal Act, the Act on the Registration and Evaluation of Chemical Substances, and the Cosmetics Act, together with recent legislative proposals. The study also conducts a comparative legal analysis of the regulatory systems of the United States, the European Union, Germany, and the Organisation for Economic Co-operation and Development (OECD), focusing on the legal definition of alternative methods, national validation systems, regulatory acceptance mechanisms, and inter-agency governance.
The analysis identifies three major institutional limitations in the current Korean legal framework. First, the legal definition and terminology of alternative methods differ across individual statutes, resulting in inconsistent regulatory standards. Second, the national validation body lacks a clear statutory basis and legal authority, limiting the regulatory use of validated methods. Third, the processes of method development, validation, and regulatory acceptance operate independently without an integrated governance structure or legally mandated inter-agency coordination. By contrast, the United States, the European Union, and Germany have established national validation systems that link validated methods to regulatory decision-making through institutionalized inter-agency cooperation.
Based on these findings, this study proposes the enactment of a comprehensive act to promote alternatives to animal testing. The proposed legislation establishes a unified legal definition of alternative methods, clarifies the responsibilities of the State and relevant administrative agencies, provides a statutory basis for the national validation center, establishes an inter-ministerial governance framework, and creates legal mechanisms for incorporating validated methods into regulatory procedures. Through these measures, the proposed Act integrates the development, validation, and regulatory acceptance of alternative methods within a single legal framework.
This study argues that promoting alternative methods requires more than incremental amendments to individual statutes. Instead, it demonstrates the need for a comprehensive basic act capable of integrating fragmented legal provisions, strengthening inter-agency governance, and connecting validation outcomes with regulatory decision-making. In doing so, it presents a legislative model for advancing animal welfare while improving the scientific reliability and regulatory effectiveness of safety assessment in Korea.
