본 논문은 대한민국 제1공화국(1948~1960)의 정치사를 ‘삼권분립의 작동’이라는 동태적 관점에서 재구성하여 분석한다. 기존 정치사 연구가 주로 이승만 정권의 독재화나 민주주의의 실패라는 측면에 치중해 온 것과 달리, 본고는 입법·행정·사법 각 부문의 제도적 배열과 정치 행위자들의 실제 운영 양상을 실질적·행태적으로 추적한다. 이를 통해 제1공화국 정치가 단순히 권위주의의 전조가 아니라, 척박한 환경 속에서 삼권분립 원리가 현실에 적응하고 진화해 나간 제도화의 과정이었음을 논증하고자 한다.
연구의 주요 내용은 다음과 같다. 첫째, 제1공화국 시기 삼권분립은 명시적 규칙을 넘어 당대 정치 행위자들이 공유한 핵심적인 정치 원리이자 실천(practice)으로서 작동하였다. 제헌헌법은 대통령제와 의회제적 요소가 혼합된 구조였으나, 국회 간선제, 국무원 부서제, 국무위원 출석요구권 등의 장치를 통해 입법부가 행정부를 견제하고 통제할 수 있는 실질적 기반을 갖추고 있었으며, 국회는 이를 적극적으로 활용하였다. 이승만 장기집권과 대통령제로의 헌법개정은 제1공화국이 극복하지 못한 결정적인 한계이지만, 정치 운영에서는 헌법제정회의가 의도한 의회제적 정부 운영의 모습이 나타났다.
둘째, 입법부 운영의 핵심 기제로서 ‘본회의 중심주의’에 주목한다. 제1공화국 전반부 국회는 정당 규율이 미성숙했던 시기에 개별 의원의 자율성이 극대화된 본회의 토론과 의사결정을 통해 행정부와 대등하게 경쟁하는 독립적 권력 주체로 기능하였다. 이러한 전통은 후반기 거대 여당의 등장과 정당 간 대결 구도의 심화 속에서도 야당의 발언권 보장과 국정 감시 기능을 지탱하는 제도적 토대가 되었다
셋째, 사법부 독립성이 제1공화국 민주주의의 최저선을 지키는 핵심적 기반으로 작동하였다. 김병로 대법원장 시기를 포함하여 사법부는 선거 관련 소송과 인권 관련 판결 등에서 정치적 압력에 굴하지 않는 독립적 판단을 내렸으며, 이는 삼권분립의 형식적 유지를 넘어 법치주의의 실질적 구현으로 이어졌다.
결론적으로 본 연구는 제1공화국을 ‘취약국가 조건에서 수행된 치열한 제도적 실험과 적응의 과정’으로 재해석한다. 취약국가로서 직면했던 자유헌정의 딜레마 속에서도, 강건한 최소주의적 민주주의와 본회의 중심주의적 운영은 한국 민주주의의 장기적 복원을 위한 정초가 되었다. 특히 제1공화국의 정치사는 3·15 부정선거로 대변되는 최소주의적 민주주의의 침해를 스스로 시정할 수 있는 내적 동력을 축적해 온 과정이었다. 제1공화국에서 지속된 정기적 선거와 삼권 간의 조율 경험은 대한민국 민주주의 발전의 중요한 자산이 되었다. 본고는 ‘선거민주주의의 출발 → 법치의 제도화 → 자유의 확대’로 이어지는 제1공화국 고유의 발전 경로를 도출함으로써, 신생 민주주의 국가의 제도적 축적 과정을 설명하는 새로운 이론적 분석틀을 제시한다.

This study reexamines the political history of the First Republic of Korea (1948–1960) through a dynamic perspective on the operation of the separation of powers (samgwŏn pullip). Challenging the dominant narratives that portray the period primarily as a trajectory toward authoritarian consolidation or toward democratic failure, this study traces the institutional arrangements and behavioral patterns of the legislative, executive, and judicial branches. It argues that the politics of the First Republic was not merely a prelude to authoritarianism but an institutionalization process during which the principle of the separation of powers adapted and evolved under precarious conditions.
The analysis demonstrates that the separation of powers in the First Republic operated less as a formal constitutional design than as a shared institutional practice among political actors. Although the 1948 Constitution combined presidential and parliamentary elements, it endowed the legislature with substantive mechanisms to check executive authority. These included the indirect election of the president, cabinet countersignature requirements, and the right to request the attendance of state council members, which was routinely honored in practice. While Syngman Rhee’s prolonged tenure and constitutional revisions toward a stronger presidential system marked clear structural limits that the First Republic was unable to fully overcome, everyday political governance continued to reflect parliamentary logics envisioned by the Constitutional Assembly.
Central to this institutional configuration was what this study terms plenary-centeredness. In the early years of the First Republic, weak party discipline enabled the plenary session to function as the primary arena of deliberation and decision-making, empowering individual legislators and allowing the Assembly to operate as an autonomous political actor vis-à-vis the executive. Even after the emergence of a dominant ruling party, this mode of operation provided an enduring institutional foundation for opposition voice and legislative oversight.
Judicial independence further reinforced the minimum threshold of democratic governance. Under Chief Justice Kim Byung-ro, the judiciary rendered independent rulings in high-stakes election-related litigation and human rights cases, resisting political interference and establishing a pattern of judicial independence that facilitated a transition from the formal separation of powers to the substantive realization of the rule of law.
Taken together, the First Republic is reinterpreted here as a period of intense institutional experimentation within a vulnerable state. Despite persistent tensions surrounding liberty and constitutionalism, the coexistence of minimalist electoral democracy, plenary-centered legislative practice, and judicial independence generated cumulative institutional resources. These resources were rooted in the experience of periodic elections and coordination among the three branches, and they later enabled democratic restoration. By tracing a developmental trajectory from electoral democracy to the institutionalization of the rule of law and the expansion of liberty, this study offers a comparative framework for understanding democratic institutional accumulation in nascent democracies.
