영국의 공용수용 및 손실보상제도의 발전과정과 법체계에 관한 고찰

국문 초록 (Abstract)

이 논문은 영국의 공용수용 및 손실보상제도의 발전과정과 법체계에 관한 고찰로 영국의 공용수용의 법적 근거와 공용수용 절차 그리고 손실보상제도의 보상기준과 내용에 대해 서술하고 있다. 우리나라가 제헌헌법 제23조에서 손실보상제도를 규정하고 이를 실현하기위한 개별법인 구 토지수용법을 1962년에 제정한 것과 비교해 볼 때, 영국은 이미 15세기부터 토지보상의 역사가 시작되었다. 1541년에 수용 및 손실보상에 관한 최초의 법안인 ‘글로체스터의 도관에 관한 법안’(The Bill for the Conduit at Gloucester)을 시작으로, 1845년에는 통일적인 법전으로 ‘토지조항통합법’(the Land Clause Consolidation Act)이 제정되어 공용수용절차와 손실보상에 관한 일반원칙이 확립되었다. 그 후에도 다양한 관련 개별법의 제정되고, 수차례의 개정을 통하여 공용수용절차가 매우 체계적이고 정교하게 발전하여 현재에 이르고 있다. 그리고 토지보상에 대한 이론도 발달하여 공용침해로 야기된 재산권과의 충돌문제를 합리적으로 해결해 오고 있다. 이에 반하여 우리나라는 1970년대부터 정부 주도로 경제개발을 위한 산업단지 조성과 도로, 철도 등 사회적 인프라구축을 위한 대규모사업을 추진하여온 이래로 현재에도 많은 공익사업들이 진행 중에 있다. 최근에는 도시재개발과 관련해서 취득절차와 보상을 둘러싼 많은 법적 분쟁이 발생하고 있다. 따라서 현행 공용수용과 손실보상제도의 문제점을 논의하는 과정에서 이미 그러한 경험을 토대로 법적 제도적 장치를 마련해 두고 있는 영국의 공용수용과 손실 보상제도를 연구할 필요가 있다. 비교법적 차원에서도 아직까지 영국법에 대해서는 많은 연구가 이루어지지 않았다는 점에서도 연구의 의미가 있다. 지면상 영국의 공용수용과 손실보상의 법체계와 발전과정에 한정하여 서술하겠지만 이를 통해 우리나라의 현행 법체계의 문제점을 되돌아보는 기회가 되고, 점점 증가하고 있는 보상관련 법적 분쟁을 해결하기 위한 현실적인 대안제시에 도움이 되었으면 한다.

다국어 초록 (Multilingual Abstract)

This paper describes law system of U.K’s compulsory purchase and compensation such as Land Clause Consolidation Act, Acquisition of Land Act, Land Compensation Act, Compulsory Purchase Act, Land Tribunals Act. And this paper explain the rules and contents of compensation, the development of U.K’s compulsory purchase and compensation, main legal issues. The history of the land compensation has already started since the 15th century in the UK. In 1541, the first law, The Bill for the Conduit at Gloucester, to compulsory purchase was enacted. In 1845 ‘Land Clause Consolidation Act’ enacted and general principles of compensation has established. Even then, a variety of compensation law was enacted. Through the several revision, laws was developed very systematic and Carefully. And the theories about the land compensation caused by compulsory purchase, were development. Therefore in U.K, the legal disputes of compensation have been solve reasonably. Now we face a new problem about compulsory purchase and compensation. However, UK already has set up legal and institutional devices by experience. Therefore, we need to study about the UK’s compensation system.
So far, all the new discussed problems are related to fair compensation. So, this paper focuses on UK‘s compensation system for ‘fair compensation’. And this paper is described how to resolve legal disputes related to compulsory purchase and compensation. The purpose of this paper is contribute to set the theory of the compensation system and prepare the legal system which resolves legal disputes. It is valuable to learn various legal systems for understand foreign legal system, and enlarges the depth of academic. But more important, We should have drawn the lesson from the diversity, in order to provide direction for a number of legal dispute. Through the study of foreign legal system, study researchers should provide a clue to issues that can not solve within the existing legal system of academic theory. It is very valuable. More in-depth studies in this area should be established and will improve the problems of existing laws. This paper is introduce the UK’s compulsory purchase and compensation system which is unfamiliar to us. And through the analysis on legal system, this paper offer improving our current compensation system.
