The Constitution of Korea had guaranteed local autonomy since the establishment of the Constitution, but it was stopped under authoritarian government in 1961. Later, however, as a part of political and social democratization, local autonomy was recovered in 1991, and it is active these days.
A local government should be allowed to set its own norms of ground, basis and limitation for the independent execution of local affairs according to the residents’ intention. The Constitution grants the autonomous legislative power to local governments as a part of guarantee of local autonomy. The core of the autonomous legislative power is the ordinance-enacting power because the ordinances, which are decided by local assemblies, are considered as expression of the residents’ intention. There are two views about the legal character of the ordinance-enacting power. The one is that it is the autonomous legislation, and the other is that it is the delegated legislation. The former view is also divided over two theories. The one is the proper right theory, and the other is the derived right theory. But now, the autonomous legislation theory based on the derived right theory is widely accepted.
The problem of limit of the ordinance-enacting power contains two aspects. The one is the scope of the ordinance-enacting power(what kinds of affairs can be the object of the enactment of ordinance) and the other is the limit of the ordinance-enacting power (how far the ordinance can regulate objects in comparison with the parliamentary act).
The subject scope of the ordinance-enacting power means that the ordinance can regulate only the local government’s affairs. According to the traditional theory of affairs classification, the local government’s affairs are composed of the autonomous affairs and the entrusted affairs. Unless there is the delegation by the parliamentary act, the affairs entrusted to organs are not to be object of the ordinance because they are not the affairs of the local government. The traditional theory of affairs classification, however, has not been significant these days. Therefore, the national government should abolish the entrusted affairs of organ and transfer them to the local governments. If it is impossible, the national government should handle them by itself. It can be achieved only by amendment of present laws.
The problem of relationship between the ordinance and the parliamentary act is divided into a question of the superiority of the parliamentary act and a question of the reservation to the parliamentary act.
It is natural that the ordinance that violates the parliamentary act is null and void because a principle of the superiority of the parliamentary act is applied to the ordinance. But the real problem is when an ordinance which seems to conflict with the parliamentary act should be considered as violating it. The theory of the preoccupation by the parliamentary act was devised to answer this question. However, the content of the theory has been considerably mitigated, so the additional ordinance, which has more strict regulations than the parliamentary act on same purpose and objects, and the extra ordinance, which has more objects than the parliamentary act on same purpose and standards, are approved under certain requirements.
In the question of ordinance and the reservation to the parliamentary act, the theories and precedents approve that the enactment of ordinance does not require the delegation of the parliamentary act. Nonetheless, the ordinance that limits residents’ rights, imposes duty, or provides for penalty requires the delegation by the parliamentary act under the proviso of Article 15 of the Korean Local Autonomy Law. In view of the principle of the constitutional reservation of the fundamental rights limitation to the parliamentary act and the principle of the nullum crimen, nulla poena sine lege, the theories and precedents acknowledge the constitutionality of the proviso. Yet, the parliamentary act cannot restrict the ordinance-enacting power because it is authorized directly by Section 1, Article 117 of the Constitution. And, if the ordinance similar to the parliamentary act, at least as to the autonomous affairs of the local government, the ordinance should be allowed to limit residents’ right, to impose duty, or to provide for penalty without the delegation by the parliamentary act. Hence, the proviso of Article 15 of the Korean Local Autonomy Law is unconstitutional in the case of the autonomous affairs.
In the diversified society now, the revitalization of local autonomy must be accomplished for the democratization of administration and the balanced development of community. It is necessary to improve various systems for the revitalization of local autonomy. The local government, especially, should be able to decide and to manage the local affairs independently by the extension of the ordinance-enacting power.
Central government should redistribute affairs between national and the local government and should improve the law and the system to strengthen the autonomous right of the local government. And also, the local government should improve its ability to manage the local problems under their control.
