警察情報活動의 法的 根據와 限界에 관한 硏究

국문 초록 (Abstract)

오늘날 경찰의 임무는 19세기 자유주의 국가관에 입각한 소극적 치안유지 업무에 그치지 않고 국가의 경영과 공공의 질서유지를 위해 정치·경제·사회·문화·학원·종교 등 모든 분야에서의 관련성을 가지지 않을 수 없게 되었다.
현재 우리나라의 경찰은 범죄의 예방·진압 및 수사, 경비·요인경호 및 대간첩작전의 수행, 치안정보의 수집·작성 및 배포, 교통의 단속과 위해의 방지, 기타 공공의 안녕과 질서유지 등의 기능을 수행하고 있다. 그러나 이러한 기능을 원활히 수행하기 위해서는 체계화되고 잘 정비된 정보의 도움이 꼭 필요하다. 경찰에 있어 정보관리가 중요한 이유는 이것 때문이라고 할 수 있다.
경찰의 정보활동은 적극적인 공공복리의 증진을 목적으로 하는 작용은 아니지만 사후적인 일반경찰 기능으로는 행할 수 없는 국가의 안전과 사회공공의 안녕과 질서유지를 위한 활동이라고 말할 수 있겠다. 하지만 최근 국내여건은 정보의 중요성에 대한 인식은 하면서도 경찰의 정보활동에 대한 인식이 부족하여 치안정보, 정책소재발굴등 정보수집활동과 관련하여 출입제지, 정상적인 정보채증활동 방해등 여러 가지 갈등들이 빚어지고 있는 것이 현실이다. 따라서 과거와 같은 인권침해적 정보활동은 배제되어야 하겠지만, 국가의 안전보장을 확보하고 정책소재를 발굴하기 위해 필요한 정보활동은
명확한 법적 근거를 통해 보장되어져야 할 것이다. 그럼에도 현재 우리나라의 경우에는 경찰의 정보활동과 관련한 법적 근거가 미비한 수준에 있어 이의 조속한 개선이 필요한 실정이다.
우리의 이러한 입법상 미비점을 해결키 위해 우선, 경찰정보활동의 내용과 함께 그 한계로서의 개인정보보호문제에 관해 살펴보고, 또한 각 국의 국가정보기관들의 정보활동과 관련한 근거법규와 판례들을 비교검토 해본 다음, 오늘날 국민의 알권리문제와 관련, 새롭게 거론되고 있는 정보공개제도에 대해서도 경찰의 특수성과 관련지어 검토해 보고자 하였다. 끝으로, 현행법 체제하의 개선방안을 검토해 보고 독일의 법규정을 하나의 모델로 하여 우리 실정에 맞는 입법안(시안) 마련을 시도해 보았다. 나아가 본 연구를 통해 미래지향적인 경찰정보활동기준을 설정하고 각종 미비된 법규를 체계적· 통일적으로 정비함으로써 차질없는 국가기능수행과 아울러 정보수집단계에서의 각종 갈등해소로 정보활동의 원활화·민주화에 다소나마 기여할 수 있게 되기를 기대해 본다.

Today's police duties go beyond passive maintenance of the public order based on the liberal view on the state of the 19th century. For the management of the state and maintenance of the public order, they are now related to all fields including politics, economy, society, culture, school, religion, etc.
Currently, the functions performed by the Korean police include: crime prevention, repression and investigation; guarding, security guard for key figures, and anti-espionage activities; security information collection, compiling and distribution; traffic control and accident prevention; and maintenance of the public peace and order. But systematic and well-classified information is necessary for the police to perform such functions smoothly. This is why information management is so important to the police.
Police intelligence activities are not aimed at directly promoting the public welfare but such activities are carried out because they can enhance the security of the state and promote the public peace and order that cannot be achieved through the general ex post facto police functions. People recognize the importance of intelligence but their recognition of police intelligence activities is lacking. Accordingly, the nation's recent conditions surrounding such intelligence activities are not so favorable to the police as witnessed by various conflicts erupted in reality that include access restrictions in relation to intelligence gathering activities for security maintenance and policy establishment and obstruction of normal intelligence evidence collecting activities. Therefore, it is necessary to exclude intelligence activities that can infringe on human rights as witnessed in the past but intelligence activities needed for the guarantee of the national security and policy establishment should be protected through clear legal bases. Nonetheless, the nation's legal bases for police intelligence activities are not sufficient and their improvement is urgently required.
To help resolve such legal shortcomings, this study has examined the details of police intelligence activities and their limitations in relation to the personal information protection issue. The study has also investigated the legal bases and judicial precedents related to intelligence activities of foreign intelligence agencies. Then, it has taken a look at people's right to know and the recently proposed information disclosure system in relation to the special nature of police activities. Finally, this study has considered the improvement measures possible under the current laws and regulations and drawn up a draft bill suitable to Korea which was modeled after the laws and regulations of Germany. This study is expected to contribute to the establishment of future-oriented police intelligence activity standards and the systematic and standardized improvement of relevant laws and regulations, thus facilitating effective performance of the state functions. The study is also expected to contribute to smoother and more democratic police intelligence activities through resolution of conflicts in the information collecting stages.
