The legal terminology change from “cultural properties” to “cultural heritage” aims to ensure preservation and transmission of cultural heritage to future generations. However, despite such institutional changes, real-world implementation faces significant challenges. Current societal issues such as a rapid population decline, aging demographics, and economic stagnation make it difficult for the state to secure resources necessary for the excavation and preservation of cultural heritage. Moreover, criticisms persist regarding the financial burdens imposed on citizens for preservation and maintenance, often infringing on property rights.
This study examines the conflicts between real estate development projects and protection of buried cultural heritage from the perspectives of public real estate law and cultural heritage preservation. This study has reviewed the issues and proposed solutions for the zoning regulations under the National Land Planning Act, the principle of causation for excavation and investigation costs, property rights infringements due to on-site preservation measures, administrative liability for negligence in cultural heritage-related permits, restrictions on construction within 500 meters of cultural heritage protection zones, strategies for preservation and utilization of cultural heritage, and issues under the Act on the Promotion of Historic Cities.
Key Findings and Recommendations after the research include:
Firstly, if any buried cultural heritage is discovered, the principle of causation, while aimed at recovering development profits, should place the burden of investigation and excavation costs entirely on the state. However, developers may exceptionally bear some costs within reasonable limits. In addition, in chases where land expropriation f surrounding areas is not implemented following on-site preservation measures for buried cultural heritage, it is proposed to create a mutually beneficial plan by providing incentives such as increased building coverage and floor area ratios. If any relocation measures are taken, local governments should establish dedicated archaeological museums, allowing visitors to explore both artifacts and the area's historical context in one location.
Secondly, there are weak legal foundations in the National Land Planning Act. Where the protection zones are designated as zoning districts related to cultural heritage, the cultural heritage-related laws only establish zoning areas and districts without further integration. Therefore, it may be worthwhile to introduce site-specific district unit plans for historic sites and extend large-scale excavation and preservation efforts to private entities. By establishing district unit plans and allowing development, the areas can be transformed into tourism industry zones, enabling the recovery of development costs while allowing the general public to enjoy cultural heritage and engage in tourism.
Thirdly, under the Cultural Heritage Act, issues arise when administrative authorities unlawfully approve construction or development restrictions due to negligence. In such cases, a balance must be struck between the public interest of cultural heritage protection and the private interest of property rights, and administrative authorities should be held liable for damages resulting from their negligence.
Fourthly, restrictions on construction activities within historical and cultural environment preservation areas pose a challenge. The designation of cultural heritage protection zones alone should be sufficient. However, it is reasonable to entirely abolish construction or development restrictions even for areas beyond 500 meters from the outer boundary of designated cultural heritage sites. If such restrictions are to be maintained, landowners should be granted the right to sell the unused portions of building coverage and floor area ratios that would otherwise be achievable through development activities.
Lastly, the Special Act on the Preservation and Promotion of Historic Cities allows for the future designation of ancient cities, but such designation can impose additional restrictions on development activities compared to the current regulations. Since cities that qualify as historic cities are already somewhat historically recognized, there is no reason to delay their designation. An example of a city that could be designated as a historic city is Haman in Gyeongsangnam-do.
