A Study on Prosecution Reform Case through Kingdon’s Multiple Streams Model: Focused on an Abolition of the Central Investigation Department of the Supreme Prosecutors’ Office in 2012
This study aims to identify the main factors of the prosecution reform case which attempted to abolish the Central Investigation Department of the Supreme Prosecutors’ Office of Korea in 2012. This study raises a research question of how the Department was abolished as a policy window was opened and what made it possible to be realized. For this purpose, this study analyzed the process of the abolition of the Central Investigation Department by using Kingdon’s multiple streams model. As a problems stream, the prosecution organization met a series of serious incidents, including corruption, scandal and internal strife in November, 2012. As a politics stream, the race for presidential election was heating up then. As a policies stream, there was a constant suggestion for the abolition of the Central Investigation Department.
The analysis reports that the Kingdon’s model is useful to explain a change and agenda setting in a constituent policy area, in particular, a change in the government sector reform. It reveals that problems stream has to be far stronger than the other streams to open up a policy window in such a constituent policy area. Likewise, it shows that the activities of semi-policy entrepreneurs who respond to the increasing external demand for reform play an essential role in opening up the policy window more widely and continually. These findings verify the non-linearity and accidentality of multiple streams model although the study pays a close attention to a constituent policy area. Moreover, the findings implies the importance of interdisciplinary research between law and policy studies.
