인공지능 기술, 특히 대형언어모델(LLM)에 기반한 생성형 인공지능은 이미 법률가의 업무 전반에 활용되고 있으며, 그 추론 능력의 고도화에 따라 재판 영역으로의 확장은 더 이상 가설적 전망에 머무르지 않는다. 이러한 변화는 법관 중심의 형사재판 구조에 중대한 영향을 미칠 가능성을 내포하는 한편, 형사재판의 신속성과 공정성을 제고할 수 있는 새로운 제도적 기회를 제공한다.
우리 헌법 제103조는 법관이 헌법과 법률에 따라 양심에 의해 독립하여 심판하도록 규정하고 있으며, 이는 전문적 법률지식과 직업적 윤리에 기초한 판단 구조를 전제로 사법의 정당성을 뒷받침해 왔다. 그러나 전문가 사법의 민주적 정당성에 대한 비판, 법관 개인이 지닐 수밖에 없는 인지적 편향과 물리적 한계는 현행 형사재판 구조에 대한 제도적 보완 필요성을 제기한다.
인간의 사고와 판단은 언어를 통해 표현되며, 형사판결 역시 사실인정, 법 적용, 결론 제시라는 언어화된 논증 구조를 통해 제시된다. 본 연구의 핵심적 관심은 인공지능이 이러한 판결 논증 구조를 학습·모방하여 재현할 수 있는지, 나아가 일종의 ‘논리적 판결 기계’로 기능할 수 있는지에 있다. 이는 법형식주의와 법현실주의가 긴장 관계 속에서 조정해 온 법적 판단 과정을 기술적으로 구현하고 가시화할 수 있는 가능성과 연결된다.
이러한 문제의식 아래 본 연구는 기존 인공지능의 재판 활용 논의가 주로 양형 판단의 보조 자료에 집중되어 온 것과 달리, 인공지능이 사실인정과 법 적용 단계에서도 일정한 역할을 수행할 수 있는지에 주목한다. 인공지능이 평균적·기준적 판단을 제시할 수 있다면, 이는 블랙박스와 같이 인식되어 온 법관의 심증 형성 과정을 보완·검증하는 기능을 수행함으로써 형사사법에 대한 신뢰 위기를 완화하는 하나의 제도적 대안이 될 수 있다.
이를 위해 본 연구는 이론적으로 법의 형식논리적 특성과 과학적 방법, 법형식주의와 법현실주의의 관계를 검토하고, 제도적으로는 형사재판에서 인공지능의 법적 지위, 인공지능 판단의 효력, 인공지능을 전제로 한 심급제도의 운영 가능성, 그리고 피고인의 방어권 보장을 위한 절차적 권리 설계 문제를 종합적으로 분석한다.
아울러 대형언어모델의 법적 추론 능력에 관한 선행 실증 연구를 검토하고, 실제로 상용화된 LLM을 활용하여 국내 형사사건에 대한 모의 판결문 작성 실험을 수행함으로써, 현재 기술 수준에서 인공지능 활용의 가능성과 한계를 구체적으로 분석한다.

Artificial intelligence technologies, particularly generative artificial intelligence based on large language models(LLMs), are already being widely used across legal practice, and as their reasoning capabilities continue to advance, their expansion into the judicial domain is no longer merely hypothetical. This development is likely to exert a significant impact on the judge-centered structure of criminal adjudication, while simultaneously offering new institutional opportunities to enhance the efficiency and fairness of criminal trials.
Article 103 of the Constitution of the Republic of Korea provides that judges shall adjudicate independently according to their conscience and in conformity with the Constitution and the law. This principle has traditionally grounded the legitimacy of the judiciary in professional legal expertise and judicial ethics. However, criticisms concerning the democratic legitimacy of expert adjudication, as well as the cognitive biases and practical limitations inherent to individual judges, call for institutional supplementation of the existing structure of criminal adjudication.
Human reasoning and judgment are expressed through language, and criminal judgments are likewise articulated through a linguistic structure of legal reasoning consisting of fact-finding, application of law, and the formulation of conclusions. The central concern of this study is whether artificial intelligence can learn, emulate, and reproduce this structure of judicial reasoning, and further, whether it can function as a form of a “logical adjudicative machine.” In this sense, artificial intelligence may serve as a technological means to implement and render visible the judicial reasoning process that has traditionally been mediated through the tension between legal formalism and legal realism.
From this perspective, this study moves beyond the conventional focus on the use of artificial intelligence primarily as a tool for sentencing assistance, and instead examines whether artificial intelligence can play a meaningful role in the stages of fact-finding and legal application. If artificial intelligence is capable of presenting average or benchmark judgments, it may complement and verify judicial decision-making processes that are often perceived as opaque, thereby offering a potential institutional response to the crisis of trust in criminal justice.
To this end, this study theoretically examines the formal-logical characteristics of law, the scientific method, and the relationship between legal formalism and legal realism. Institutionally, it analyzes the legal status of artificial intelligence in criminal adjudication, the legal effect of AI-generated judgments, the operation of multi-tier court system under the assumption of AI involvement, and the design of procedural safeguards to protect the defendant’s right to defense.
In addition, this study reviews prior empirical research on the legal reasoning capabilities of large language models and conducts experimental simulations in which commercially available LLMs generate mock criminal judgments based on actual Korean criminal cases. Through this analysis, the study concretely identifies both the possibilities and limitations of employing artificial intelligence in criminal adjudication at the current stage of technological development.
