복지 생산을 위한 공ㆍ사 기능 분담

다국어 초록 (Multilingual Abstract)

The principle of welfare state in the Korean Constitution has been developed incessantly in spite of a lot of historical or social conflicts. Notwithstanding, no satisfactory answers have been presented to the question of what status the principle takes in or what constitutional interpretation we should choose. The reason is, theoretically, that individual social rights do not have strong normative power, and practically, that we do not have affluent national finance and collective intention for the developed welfare. Therefore, the writer argues that we need functional cooperation between the state and the people in the area of the welfare service production urgently. The way how the functional sharing between the public and the civil, the way how the constitution is interpreted to support it, and the way how the public-civil legal institutions are designed are notably meaningful thesis. This article delves into the answers to those questions through diverse discussions on social welfare and comparative constitutional law.
