프로축구 선수의 이적문제에 대한 고찰 = (A) Study on Trade Problem of Pro-Soccer Player

국문 초록 (Abstract)

본 연구는 프로축구구단에 입단하여 현재 J리그 스미즈 S펄스에서 활동하고 있는 A선수의 해외 이적상황에 대한 문제점을 심층 분석하여 프로축구 선수의 해외이적과 관련된 대안을 제시하는데 목적이 있었다. 이와 같은 연구목적을 달성하기 위하여 첫째, 국내 프로축구 에이전트의 현황은 어떠한가? 둘째, 국내 프로축구선수의 계약내용 및 해외이적 · 임대 시 조건과 절차는 무엇인가? 셋째, A선수의 이적 및 소유권분쟁의 근본적인 원인은 무엇인가? 넷째, 국내 프로축구 선수의 이적과 관련된 문제의 해결 방안은 무엇인가? 라는 네가지 연구문제를 설정하였다. 한편, 상기의 연구문제는 문헌연구, 심층면접 등 다양한 질적 연구방법을 이용하여 연구문제별로 분석되었다.
연구결과는 다음과 같이 같다. 첫째, 프로축구연맹에서 무자격 에이전트에 대한 규정이 강화 된 상태로 조사되었다. 그러나 국제축구연맹(FIFA) 규정 내 선수 에이전트 규정을 보면 선수의 직계가족, 변호사는 선수 대리인으로 활동할 수 있다고 입증됨에 따라 이들을 내세워 활동할 경우 제재할 수 없다고 나타났다. 둘째, 2004년 현재 FA자격을 취득한 193명에 대한 방안은 이루어지지 않은 반면 차후에 발생되는 문제를 해결하기 위해 프로축구연맹에서는 그에 따른 방안을 제시한 것으로 나타났다. 그밖에 선수가 해외이적 · 임대 시 조건으로는 선수의 기능성, 가능성, 상품성으로 조사되었고 이러한 선수들이 해외 이적 · 임대 절차로는 구단과 선수의 협의가 이루어져야 하며, 구단은 선수를 영입할 구단을 파악한 후 그에 대한 합의가 이루어져야 한다. 또한 이적구단은 자신들이 소속된 구단의 협회를 통해 선수가 현재 소속되어 있는 구단의 협회로부터 이적동의서를 받아야 하며, 그 이후 선수는 이적구단의 선수로서 활동할 수 있는 것으로 나타났다. 셋째, A선수의 이적 및 소유권분쟁을 파악한 결과 구단간의 커뮤니케이션에 대한 문제, 구단의 위약금 지불 문제, 구단의 송금시기 문제, 선수의 이중계약 및 위임장 남발에 대한 문제, 개인 기량 문제, 국내 에이전트의 협상 · 법률 문제, 국내 스포츠 마케팅의 능력에 대한 문제 등이 야기되고 있는 것으로 조사되었다.
결론적으로 이러한 문제를 해결하기 위해서는 국제축구연맹(FIFA) 규정 내 선수 에이전트 규정을 토대로 프로축구연맹 규약 ·규정집을 재편성하여 실행하여야 한다. 또한 전구단과 인수구단간의 원만한 커뮤니케이션이 필요하며, 구단은 선수를 배려할 줄 아는 인식이 있어야 한다. 선수 또한 에이전트를 신중하게 고려한 후 선임하고 해외진출 시 조급한 마음을 갖기보다는 에이전트를 신뢰하여야 한다. 그리고 해외로 진출한 후에는 자신의 능력을 최대한 발휘할 수 있도록 적응력을 키워야 한다. 이밖에도 국내 스포츠 마케팅사에서는 선수를 지속적으로 후원할 수 있는 팬프로그램을 개발할 필요가 있으며, 유럽에서 활동하고 있는 FIFA 공인 에이전트들과 대한축구협회가 협력하여 에이전트 양성을 위해 제휴를 맺고 그에 대한 기반을 형성할 필요가 있다.

다국어 초록 (Multilingual Abstract)

This study is designed to propose alternative plans regarding problems with an international transfer of soccer players by analyzing problems in depth, which is brought on by an international transfer of Soccer player A who joined a Korean professional soccer team and then transferred to Shimizu S-Pulse of J league. In order to complete this study, four questions are suggested as follows: first, what is a current situation of Korean professional soccer agencies?; second, what is the content of a contract of a Korean professional soccer team, and are conditions and procedures during an international transfer or lease?; third, what are fundamental causes for a current problem caused by Player As transfer and ownership dispute?; and fourth, what can be done to resolve problems regarding a transfer of a Korean professional soccer player? Each study question mentioned above is analyzed via various qualitative study methods such as literature reviews and in-depth interviews.
As a study result, Korea League has made more strict regulations for unlicensed agents. However, according to regulations on a players agent of the Federation International of Football Association (FIFA), a family member and lawyer can represent the player so their activities cant be restricted. Korea League has currently made some plans for the problems that might occur in the future, where there are no current plans for the licensed 193 agents. Also when a soccer player is transferred and leased internationally, conditions considered are the players ability, possibility, and commercial value. Procedures of transfer and lease are as follows: both the team and player should discuss about the transfer or lease; then the current team should understand of the team who accepts the player; and the both teams should mutually agree the transfer or lease. The transferee team should receive a certificate of transfer agreement from the league whose the transferor team belongs to through the league it belongs to. After that, the player can play as a player of the transferee team. Especially, results that are drawn from studies with Player As transfer and ownership dispute show following problems: communications between the two teams, the transferee teams penalty payment and payment remittance time, the players double contract and excessive issuance of a power of attorney, players capability, agreement and regulations of a Korean agent, and sport marketing ability within Korea.
Consequently, in order to solve these problems, a new regulation should be organized and added to and practiced upon Korea Leagues agreement and regulations, based on agent regulations of FIFA. Also the transferor and transferee teams need a smooth communication and understanding for a transferring player. Any player should be considerate when hiring an agent and also trust the agent rather than being impatience when he has an apportunity to transfer to a team abroad. And after being transferred to the team, he should develop adaptability in order to show his ability at the maximum level. Besides, any sport marketing firm within Korea should develop a fan program to support a player in a continuing basis, and its also necessary for Korea League to cooperate with FIFAs official agents who work in Europe currently in order to raise good agents and to form a base for an agent education.
