노인성범죄의 실태분석과 경찰의 대응방안 = An Analysis on the Elderly Sex Offenses and the Counter-measures of the Police15

The purpose of this study is to find the counter-measures against the elderly sexoffenses to realize 'a society safe from sexual violation,' which is a governmental task ofthe incumbent government through the analysis of their actual state.
So far, sex offenses have been committed by age groups of 20 to 40 and the elderlyhave been considered to be potential victims vulnerable to sex offenses.
Even if they themselves committed sex offences, they were considered to be abnormalbehaviors caused by their great age and because of the low occurrence rate and socialawareness of 'their being the weak in the society,' their sex offenses haven't been socialissues and they were not punished severely for those reasons.
But as the society is aging rapidly, the occurrence rate of their sex offenses is not onlygoing up, but also its severity is getting worse to the extend that there is no need todifferentiate their offenses from those of different age groups in tackling them. So it'sabout time to have new recognition and forensic approach toward it. Accordingly, thisstudy proposes the counter-measures of the police against the elderly sex offenses asfollows.
First, the laws and regulations related with the elderly sex offenses must be preparedand enacted and also lots of efforts must be earnestly made to build the nation'sawareness of them.
Second, the protective activities for the second class citizens must be reinforced byutilizing the Big Data related with the public safety.
Third, investigative capacity and professionalism such as construction of investigativesystem solely dedicated to sex offenses must be enhanced.
Fourth, construction and vitalization of the public safety system for the organiccooperation with the concerned institutions such as the government, local government and NGOs must be promoted.
Fifth, criminal justice institutes must have the will to solemnly execute the new lawsand regulations.

국문 초록 (Abstract)

본 연구는 최근 심각한 사회문제로 부각되고 있는 노인 성범죄의 실태분석을 토대로 현 정부의주요 국정과제인 ‘성폭력으로부터 안전한 사회’를 구현하기 위한 경찰의 대응방안을 모색하는 데목적이 있다.
이제까지 성범죄는 주로 20대부터 40대까지에 의해 발생하고, 노인은 성범죄에 취약한 잠재적 피해자로 여겨져 왔으며, 만약 노인이 성범죄의 행위자라고 해도 이는 고령에 따른 이상 행동으로취급되거나 그 낮은 발생 빈도와 ‘노인은 약자’라는 사회적 인식 때문에 경미한 처벌에 그치거나관심을 받지 못하는 경우가 대부분이었다. 그러나 사회가 급속히 고령화하면서 노인 성범죄도 발생 빈도가 늘어나고 있을 뿐만 아니라 그 심각성이 기존 성인층에서 발생하는 성범죄와 차별하여대응할 근거가 전혀 없을 정도로 심화되고 있어 새로운 인식과 범죄학적 측면에서의 접근이 필요한 시점이다.
따라서 본 연구에서는 이렇게 급증하는 노인 성범죄에 대한 경찰의 대응방안을 다음과 같이 제시하고자 한다.
첫째, 노인 성범죄 관련 법⋅제도적 정비와 함께 국민적 공감대 형성을 위해 공론화를 본격적으로 추진하여야 한다. 둘째, 치안 빅 데이터(Big Data)를 활용한 사회적 약자 보호활동을 강화하여야 한다. 셋째, 성폭력 전담 수사체계 구축 등 수사의 전문성과 역량을 강화하여야 한다. 넷째, 국가, 지자체, NGO 등 관련 기관과의 유기적인 협업을 위한 치안시스템 구축 및 활성화를 도모해야한다. 다섯째, 새로운 법⋅제도에 대한 형사사법기관의 엄정한 집행의지가 있어야 한다.
