The Constitution establishes the National Election Commission (NEC) as an independent collegial constitutional body because representative democracy grounded in popular sovereignty depends upon the politically neutral management of elections. Institutional independence is therefore instrumental rather than intrinsic. Independence and accountability are not competing constitutional values but complementary ones: the more independent and powerful an institution becomes, the more indispensable the mechanisms that ensure its powers are exercised lawfully.
Election management constitutes a distinct state function entrusted to an autonomous constitutional institution, not an ordinary executive function. Yet the contemporary NEC pairs a high degree of constitutional independence with minimal external oversight. The Constitutional Court's recent decision shielding the NEC from inspection by the Board of Audit and Inspection threw this imbalance into sharp relief while exposing a deeper defect in the statutory framework. The Election Commission Act has hollowed out the Commission's collegial character—all but one member serves in a non-standing, honorary capacity, a composition inherited from the Yushin-era Constitutional Committee that was designed to make constitutional review merely nominal—while the Public Official Election Act confers expansive regulatory and coercive powers without corresponding judicial safeguards. The underlying defect is structural: supervisory and implementing powers are fused in election commissions at every level, with no controls commensurate with the authority conferred.
A comparative examination of the United States, Canada, and Australia reveals two shared features of democratic election governance. First, supervisory authority is institutionally separated from implementing authority. Second, the coercive powers exercised in the course of election management are subject to meaningful judicial control. Korea departs from both principles.
The dissertation accordingly advances a principle of functional separation. Supervisory authority should be concentrated in a central collegial commission; implementing authority should be entrusted to subordinate single-head bodies operating under clear statutory constraints. To this end, it proposes reforms at two levels. Constitutional amendment should restructure the composition of the NEC and guarantee its budgetary autonomy; statutory reform should reestablish the Commission as a genuinely collegial body, concentrate coercive powers in the central commission subject to prior judicial review, expand legislative oversight, and establish a specialized election court.
Public confidence in democratic elections ultimately rests on an appropriate equilibrium between independence and accountability. An institution entrusted with safeguarding elections sustains its political neutrality not through independence alone but through controls commensurate with the authority it wields.
