This research was started to represent the modification range of rearrangement plans and a way to improve related steps through drawing change factors of rearrangement plans during the rearrangement project, and propose a method to reduce various conflicts between participants.
In the analysis of minor matters for rearrangement plans, this paper investigated the whole cases which were officially announced Seoul Metropolitian Government (SMG) during 1 year and through this, reviewed frequency of item change of rearrangement plans. Also, this research will be examined modification factors on a case-by case and evaluated the reason why they changed. Furthermore, after classifying four types, analysis about crucial characteristic will be followed.
Firstly, there are lots of examples that the change caused by minor mistake faithfully reflects the tenor of simplification procedures for rearrangement plans. In a simple mistake, because some Acts have more specific articles and standards, it is rather to say that there are not any serious problems in administrative procedures.
Secondary, since minor change by changing of upper and related policy accommodates external factors, it is hard to find certain problem in the process of reflection for it. With this, it is found that the change could achieve amazing effects by getting rid of useless procedure.
Thirdly, the slight things caused by result of discussion for rearrang ement plan could bring out various changes, such as layout planning, planing for roads and parks, community facilities and adjustment of zone.
Fourthly, the simple change created by the developer gets a large share of the frequency.
In accordance of the result, it is fair to say that the minor matters properly work in the resonable range of change. However, this paper argues that following items need to be logically operated by in pursuit of improvement and revision.
Above all, some items need to be added to articles for the simple change. Firstly, that is height of building. As the change procedure for average height, maximum height and height of a particular building is debatable, it needs to be revised from 'Maximum of the Building' to 'in less than 20% of the building height, 'like 'National Land Planning and Utilization Act'(NLPUA).
Secondary, that is the Article 53 of the NLPUA. In 7-3 (1) Article 4 'Act on the Maintenance and Improvement of Urban areas and Dwelling Conditions for Residents'(AMIUDCR), Rearrangement plan should contain items that District Unit Plan(DUP) determines. Aa an alterative, this research presents it needs to be revised that the AMIUDCR shall apply Article 25 the NLPUA.
Next, some items need to be eliminated in small changes.
Firstly, that is the change of 'Gross Floor Area' (GFA). GFA was deleted in the items of rearrangement plan due to revision 5 (4) AMIUDCR in 06. 02. 2009. Under the current law, it is necessary for the change to follow general modification procedure like 'Hearing of Opinions of Residents', 'Discussion of Urban Planning' and so on.
Secondary, 'Urban Planning Facilities' and 'Rearrangement Basis Facilities' are doubled. Even though those purpose and goal between the AMIUDCR and NLPUA are different, mostly they are overlapped and not clearly classified.
Thirdly, that is the plan for improvement of existing building. That plan is rather than 'Basic Investigation' instead of management using by rearrangement plan. Thus, it is highly desirable that the plan should be eliminated in items for rearrangement plan and change of minor matters
In conclusion, the change system for minor matters have several positive results in that regard like rationalization of regulation and simplication procedure. In particular, the result of discussion or simple change by developers are mostly suitable for the contents, period and ripple effect. However, average height and things which are classified by DUP should include in the items for minor matters except for overlapping between GFA and UPF, and article for improvement of existing building. In fact, it needs that over 20% change of maximum height should follow the general modification procedure. Also, in operation ways, particular standards about the range of small change and items should be presented in order to be operated more rationally.
It has limitation in that this paper focused on rearrangement plans in Seoul during 1 year and could not include all parts of change for minor matters. Also, it is necessary to give a supplementary about corelation between 'Master Plan for Urban and Residential Environment Rearrangement', 'Authorization for Project Implementation', 'Management and Disposal Plan' and modification of minor matters by in pursuit of additional examination.
