비도시지역에서 관리지역 세분과 입지특성이 개발행위허가 실행에 미치는 영향 : 경기도 이천시를 중심으로 = The Management area subdivision and locational characteristic effect on the Development permission and Execution in non-urban area

국문 초록 (Abstract)

2003년 「도시계획법」과 「국토이용관리법」을 「국토의 이용 및 계획에 관한 법률」(이하 국토계획법)로 통합･제정하면서 비도시지역의 난개발문제를 적극적으로 해소하고자 하였다.
해소 수단으로 개발 행위 허가제도를 비도시지역으로 확대하였으며, 관리지역을 대상으로 한 관리지역 세분제도를 추가로 도입하였다.
도입 이후 지속적으로 재산가치 하락 및 생활불편에 관한 민원과 소송 등으로 인해 과도한 행정력 소모를 유발시키는 원인이 되었다.
개발행위허가제도와 관리지역 세분제도가 도입된지 10년이 지난 지금, 비도시지역 개발에 어떠한 영향을 미쳤으며, 제도 상호간 어떠한 관계가 형성되었는지, 실제 개발행위허가가 실행된 사례를 대상으로 분석을 실시하여 특성을 관찰하고자 한다.
연구의 목적과 이전 연구와의 차별성을 고려하여 개발행위허가와 관리지역세분이 이뤄진 경기도내 지자체 중 이천시를 대상으로 선정하였으며, 개발행위허가와 관리지역 세분이 동시에 이뤄진 2008년 1월부터 동년 12월까지 발생한 비도시지역 개발행위허가를 대상으로 하였다.
실제 개발행위허가의 실행에 대한 유형화 및 특성 분석(관리지역세분외 특성 및 요인에 관한 분석 포함)을 실시하였다. 개발행위허가가 실제로 어떻게 이뤄졌는지 검토한 뒤 통계분석과 공간적 특성 분석을 통해 개발행위허가 실행여부와 관리지역세분간의 관계를 파악하고 이들을 유형화한 후 기타 요인 및 설명변수에 관한 특성을 파악하고자 하였다.

다국어 초록 (Multilingual Abstract)

In 2003, integrating and enacting the law of urban planning and the act on the utilization and management of the national territory as the national planning act, have tried to solve the problem of the development thoughtless for the environment. As the solution, the Development permission system was enlarged to non-urban areas, additionally introduced the management area subdivision system at the targeting areas. After introducing the system, there were civil complaints and suits about discomfort of living as well as depreciating the value of property. These problems caused too much waste at the administration.
Now, 10 years later, by analyzing the real cases, I hope to research the relationship between the Development permission and The Management area subdivision and how they effect on developing the non-urban areas. Considering the purpose of this study to put discrimination with other studies, I especially chose the case of 'Ichoeon' among the local governments in Gyeonggi-do. Because it was enacted the Development permission and The Management area subdivision at the same time from January to December, in 2008.
I conduct characteristic analysis and classifying on the actual implementation of Development permission(including the analysis of the other factors about the subdivision and locational characteristic).
After reviewing how conducted the Development permission actually, I understood the relationship between the affection on the Development permission and The Management area subdivision through the statistical analysis and analysing the spacial properties. Then, classified them and studied other factors and characteristic about explanatory variable.
