There could be three approaches to resolve public disputes : power-based, rights-based, and interests-based approaches. There is yet a developed public disputes resolution system in our society so that many have relied on physical power and legal settlement to resolve public disputes. However, our society have also been facing several fledging cases that were successfully resolved with an interests-based approach which focus on building consensus through participation, discourse, and negotiation of relevant stakeholders. This paper introduces a public dispute case involved around the Seoul National Hospital, which is a mental health clinic and is located at a residential zone in Gwangjin-gu, Seoul. The Seoul National Hospital case was successfully reached to an agreement through a mediation process which was assisted with professional mediators. Thus, this case may provide rare and useful policy implications to resolve similar public disputes.

This research is to establish a checklist of public conflict what can be used for the purpose of diagnosis and prevention of public conflict. The checklist for public conflict developed in the following order: first, the factors selected through a literature review and priority; second, review and the check checklists of Seoul Metropolitan Government Office and Government Policy Coordination to complement and utilize the existing list and to reflect the experience of experts in a number of conflict adjustment. The checklist derived research results contains key and around stakeholders factor 15 items, conflict issues factor 7 items, Environmental Factors 6 items. The checklist is important to apply to the actual case, so it is necessary feasibility verification of reality. In this respect, this study looked applied to leverage South Road office in Seoul as illustrative examples of conflict stretching checklist. The case could be seen through the checklist, check for the three regions corresponding to the degree of conflict and at thesame time imperfections in the checklist could be confirmed as well. This study is exploratory research to develop a checklist that can contribute to the diagnosis and prevention of public conflict. Therefore, there is a need to improve the checklist investigated by additional conflict factors not addressed in this study, and applied to a variety of cases the practicality and utility of the checklist there is a need to continue to improve.
갈등해소를 위한 합의형성과정의 장애와 반전요인에 관한 연구

There are several appearances of obstacles and reversals which impact on the consensus-building processes. However, current researches only focuses on the factors that make effects on the causes and results of public disputes related to the government policies. Not many researchers are interested in the processes of conflict resolutions. This paper is based on the experiences of mediating 6 public conflicts with which the researcher have personally dealt. As a result, there are five findings for the obstacles ? mediator, interest parties, newly structured representatives body, politics, and wrong advices by experts. Also, eight reversal factors are found ? trust building between mediators and interest parties, statesmen, interest parties, power unbalance between central and local governments, consensus- building between experts who represent both interest parties, promise by the high level government decision-makers, and the government’s will and sincerity to resolve conflicts.
