The development of 21 century high technology and intelligence communication changed a human life radically. Especially, it made possible people to communicate regardless of time and place. As the crime becomes more violent, concealed, and specialized, this development of science, being introduced to the investigation department which has a lot difficulty in dealing with a criminal investigation and seizing real evidence. Among these, there are eavesdropping a telephone or person -to person conversation. However, this eavesdropping has a danger of interrupting the people’s freedom of communication and their privacy. Our country, also, is practicing the Protection of Communications Secrets Act about eavesdropping. However, this law of Protection of Communications Secrets Act has some problems, and the actual application of this law and the related law is very rare. In conclusion, I will recommend that we have to regulate the scope and the admissibility of the eavesdropping by reforming “The Protection of Communications Secrets Act,” instead of making a new law. In reforming the law, the foreign countries are good examples. Also, we will make a new law in order to prepare new collection evidence by researching the academic and the official together.
