코로나19 상황에서 필요한 ‘통합적 인권의 이해’와 법ㆍ정책적 과제

코로나바이러스감염증-19(COVID-19, 이하 ‘코로나19’)의 확산으로 전 세계가 중대한 위기를 겪고 있다. 국내에서는 코로나19에 대응하기 위해 도입ㆍ시행되는 강제처분ㆍ방역ㆍ예방조치와, 코로나19로 초래되는 사회적ㆍ경제적 위기로 인하여 시민들의 인권이 광범위하게 제약되고 있다. 문제는 코로나19라는 명목 아래 인권의 제한이 너무 쉽게 정당화되고 국가의 실효성 있는 조치가 취해지지 않고 있다는 것이다. 본 논문은 코로나19와 같은 감염병 위기 상황에서 필요한 인권의 이해 방식으로 국제인권법의 ‘통합적 인권의 이해’를 제시하고자 한다. ‘통합적 인권의 이해’의 의미와 배경을 살펴봄과 동시에 ‘통합적 인권의 이해’의 관점에서 우리나라의 주류적 기본권론이 인권의 실현과 보장에 있어 가지는 한계를 검토한다. 나아가 본 논문은 ‘통합적 인권의 이해’에 따른 국가의 존중ㆍ보호ㆍ실현의무의 관점에서 코로나19 상황에서 발생하는 인권제약의 문제를 분석하고 평가한다. 이를 바탕으로, 코로나19와 같은 감염병 위기에서도 인권이 실현ㆍ보장될 수 있기 위해 필요한 법ㆍ정책적 과제를 제시한다. The world is experiencing a major crisis due to the spread of Coronavirus disease 2019(COVID-19). In Korea, citizens’ human rights are widely restricted due to compulsory dispositions, quarantine, and preventive measures introduced and implemented in response to COVID-19, as well as the social and economic crisis caused by COVID-19. A major concern is that restrictions on human rights are too easily justified in the name of COVID-19 prevention measures while no effective measures are being taken by the state to ensure human rights of citizens. This paper intends to present the “integrated understanding of human rights” approach to International Human Rights Law as a way of understanding human rights required in the context of a pandemic such as COVID-19. In addition to examining the meaning and background of “integrated understanding of human rights” approach, this paper also examines the limitations of Korean mainstream theory of fundamental rights in the realization and guarantee of human rights from this perspective. Furthermore, this paper analyzes and evaluates the problem of human rights restrictions during the COVID-19 situation in terms of the state’s obligation to respect, protect, and fulfill based on the “integrated understanding of human rights” approach. Based on this, this paper presents legal and policy tasks necessary to guarantee and realize human rights in an infectious disease pandemic crisis such as COVID-19.
