사회 내 보안처분<sup>1)</sup>으로서 보호관찰의 실효성 제고방안 - 보호관찰 특별준수사항을 중심으로 -

보호관찰은 보호관찰대상자를 교정시설 내에 수용하여 생활하게 하는 대신 사회 내 에서 일정기간 준수사항을 지키는 것을 조건으로 보호관찰관 의 지도·감독을 통해 재사회화 목적을 실현하는 제도이다. 보호관찰 준수사항은 보호관찰관의 지도·감독의 지침이 되고, 대상자에게는 생활의 지침이 자 행위의 기준이 된다. 현재 우리나라에 도입되어 시행되고 있는 보호관찰은 크게 기소유예와 결합된 보호관찰, 집행유예 및 선고유예 그리고 전자장치부착명령 및 성충 동약물치료명령과 결합한 보호관찰, 형 집행 종료 후 보호관찰, 가석방심사 위원회 등 행정기관을 통한 가석방과 결합된 보호관찰, 치료감호 집행 중 치료감호심의위원회를 통한 가종료와 결합된 보호관찰, 소년범 등의 보호처분의 한 종류로서 보호관찰 등이 있다. 보호관찰 집행을 위한 기본법은 「보호관찰 등에 관한 법률」이고, 보호관찰대상자가 지켜야할 준수사항도 규정되어 있다. 그럼에도 최근 도입된 전자장치부착명령이나 성충동약물치료명령의 경우에는 필요적으로 보호관찰이 병과되고 각 개별법에 준수사항을 따로 정하고 있다. 그 내용이 「보호관찰 등에 관한 법률」상의 준수사항과 차이가 없음에도 이중으로 규정되어 있어 집행상의 혼란을 초래할 수 있으므로 기본법이라 할 수 있는 「보호관찰 등에 관한 법률」에서 통합해서 규정하는 것이 바람직하다. 법원 또는 보호관찰심사위원회에서 준수사항을 설정할 때에는 보호관 찰관이 작성하여 보고한 판결전조사서 및 사안조사 등이 중요한 결정인자로 작용하기 때문에 보호관찰관은 적극적으로 준수사항 부과에 대한 의견을 개진해야 한다. 또한 보호관찰관의 지도·감독에 대한 대상자의 반응에 따라 준수사항이 추가되거나 변경되는 등의 절차를 통해 다종다양하게 형성될 수 있으므로 그 내용도 응보형 준수사항과 개선형 준수사항으로 구분 하여 부과하여야 한다. 보호관찰 준수사항의 문제점으로는 전자장치부착명령 등과 병과된 강 성적 보호관찰과 집행유예 등 재범위험성이 낮은 자에게 부과하는 연성적 보호관찰을 구분하지 않고 실시하고 있고, 성인대상자와 소년대상자를 구분 함이 없이 준수사항을 일률적으로 규정하고 있었다. 또한 소년 및 성인대상 자에게 특별준수사항이 부과되지 않은 경우에는 일반준수사항만으로는 보호관찰관의 지도·감독에 한계가 예상되고, 준수사항으로 부과하는 일부 내용이 명확하지 않아서 대상자에게 그 의미가 정확하게 전달되지 않을 가능성이 있음을 지적할 수 있다. 이상의 논의를 통해 보호관찰의 실효성을 확보하기 위해서 입법적 측 면과 보호관찰 준수사항의 집행 면에서 개선점을 도출하였다. Probation is a system that realizes the purpose of re-socialization through the supervision and direction of probation officers who provide correctional programs to probationer for a certain period of time. Probation observance is a guide for supervision and direction by probation officers, and a guideline to life and standards of conduct to probationers. The probation that is currently introduced and implemented in Korea is largely probation combined with suspension of prosecution, suspended sentence, electronic monitoring order and chemical castration order, after released and with parole through administrative agencies such as the parole review committee. medical treatment and custody review board, and probation as a protection measure for juvenile offenders. The basic law for probation is the act on probation. There are also provisions to be followed by probationers. Nevertheless, in case of the recently introduced electronic monitoring order and chemical castration order, probation is required and probation observance eachindividual law is determined. Probation observance contents are doubled even though they are not different from the observance of the individual law on probation. It is desirable to integrate them in the law on probation. When setting up probation observance matters in the court or probation review committee, probation officers should actively express their opinions on the imposition of compliance matters, since the preliminary investigations prepared and reported by the probation officer act as important determinants. In addition, since the probation observance items can be added or changed according to the response of the probationer to the guidance and supervision of the probation officer, the contents can be divided into retributive and improved compliance items. Currently the problem of probation observance is not distinguished between soft probation and strong probation, and not divided into juvenile offender and adult offender. In case of not imposed special rule to juvenile offender and adult offender, there are certainly limits to probation officer's supervision and direction. It can be pointed out that the probation observance are vaguely defined, making it difficult for probation officer to supervise probationer. Through the above discussion, in order to secure the effectiveness of probation, improvement points in legislative aspects and enforcement of probation were drawn.
