인터넷상 표현에 대한 법적 책임의 구조에서 다중채널네트워크(MCN)

다중채널네트워크(MCN)은 유튜브의 등장으로 활성화된 UCC 또는 UGC의 상업화된 버전이라고 할 수 있다. 일인 미디어인 이용자는 스스로 콘텐츠를 생산하고 그 조회 수에 따라 광고수익을 분배받을 수 있게 되었다. 다중채널네트워크의 비즈니스 모델은 인터넷 이용자이면서 콘텐츠를 만드는 크리에이터를 도와주고 콘텐츠로 발생하는 수익을 나누어 가지면서 시작되었다. 미국과 유럽연합이 저작권 분야에서 온라인 매개자인 ISP에게 고지 및 제거체제라는 ‘세이프 하버’를 제공하기로 합의한 지 거의 20년이 다 되어간다. 그동안 이 고지 및 제거 체제는 저작권뿐 아니라 온라인 매개자의 법적 책임 전반으로 확대되어왔다. 현재의 인터넷 규제질서는 고지 및 제거 체제에 기초한 자율규제 시스템을 중심으로 확립되었다. 다중채널네트워크 등장의 무대가 되어준 유튜브의 콘텐츠 ID가 그 대표적인 예라고 할 수 있다. 그러나 이용자 그리고 이용자의 표현의 자유라는 공익은 사익을 추구하는 플랫폼 사업자이면서 자율규제의 주체인 ISP에 거의 의존하고 있다. 그래서 이용자는 이 ISP의 불합리하고 불공정한 조치나 오류에 대해 절차적으로나 실체적으로 대응할 능력이 거의 없는 형편이다. 그런 상황에서 다중채널네트워크가 등장했다. 다중채널네트워크는 콘텐츠 제작자이면서 이용자인 크리에이터의 편에 서서 수익을 창출하는 주체이다. 그리고 이들이 유튜브를 상대로 상당히 의미있는 태도 변화를 이끌어 내기도 했다. 앞으로 다중채널네트워크와 이용자 및 크리에이터의 관계가 어떻게 변화할지는 모른다. 그러나 현재 다중채널네트워크는 ‘저작권자 > 온라인 매개자 > 인터넷 이용자’의 구도로 확립된 인터넷 규제질서에서 그동안 소외되었던 이용자들의 권리를 대변하고 있다. We can call the Multi-Channel Networks(MCN) a commercial version of UCC or UGC which has been activated by YouTube. Internet users who are me-media themselves can make money by how much click for their creating contents. The Biz-model of MCN is starting from dividing the creators’ money for supporting their creating contents. It is almost 20 years old since USA and EU agree to give a safe harbor to online intermediaries in the copyright area. Meanwhile this safe harbor, that is notice and takedown regime has escalated not only copyright but also liability of intermediaries at large. Today of Internet regulatory regime is mainly established by the private ordering which is based on the notice and takedown, such as YouTube’s Content ID where MCNs has beginning. However the internet user and public interest of their free speech are on the ISP which is the business as a platform operator for its own interest. Therefore a user has little recourse, either procedural or substantive, when there is an irrational and unfair measure or an error of the private ordering. MCN is a player who makes money on the side of the creator who is a user and a contents maker. MCN has made YouTube changes its attitude significantly. We don’t know how can change the relationship between MCN and the internet user or the creator in future. But now MCN stands by the weak user in the internet regulatory regime of ‘copyrights holders – online intermediaries – internet users.’

This paper reviews current Temporary measure system and its problems. Korean Act on Promotion of Information and Communications Network Utilization and Information Protection, etc imposes a duty to control Internet users` activity to Internet Service Providers(ISPs). Among such institutional apparatuses, the most efficient one is the Temporary measure. However it has several shortcomings but the most critical thing is that it has shifted the responsibility observing due process onto ISPs. This can violate the freedom of expression on the internet. Before introducing it certainly consulting advanced institutions, such as the Notice and Take-Down System(NTD) which has several devices to guarantee a due process of law or stem abusing and misusing, but leaned to the side of the injured party the Temporary measure system has been taken off these devices. By comparing Temporary measure with those NTDs, we can spotlight its fundamental and unconstitutional flaws. Fortunately, Korean Communications Commission begins to discuss amendment but, whatever alternatives are, for the freedom of expression in the internet space its faults should be stated clearly.
