북한은 외국투자은행법, 나진선봉경제무역지대법, 자유경제무역지대외국체류 및 거주 규정, 신의주특별행중구 기본법, 개성공업지구법, 금강산 관광지구법 등을 제정하면서 경제발전을 촉진하기 위해 경제관리의 정규화, 규범화하고 있다. 그러나 북한은 투자환경의 중요한 요소인 하부구조가 상당히 낙후된 국가이다. 더욱이 북한은 사회주의 국가이기 때문에 법적 구속력은 일반 자본주의 국가에 비해 상당히 약한 상황이다. 물론, 북한은 풍부한 지하자원을 보유하고 있다는 면에서 매력적인 투자환경을 가진 국가이다. 또한 북한은 양질의 풍부한 노동력이란 매력적 투자환경을 갖고 있는 국가이며 현재 실질적인 각종 법 제정으로 적극적인 외국인투자 유치를 위해 노력하고 있다. 그러나 북한에 이와 같은 매력적인 투자 요인이 있음에도 불구하고 외국의 투자가 소극적이고 각종 문제가 노출되고 있다. 이는 그만큼 북한의 투자에 있어서 장애요인이 매력적인 요인보다 더 크기 때문이다. 따라서 본 논문은 북한의 대외개방화에 있어서 장애요인이 무엇인지를 살펴보고 경제특구 정책의 실효성 및 그 특징이 무엇인지를 집중분석하였다. In order to promote economic growth and foreign investment North Korea enacted Rajin-Sonbong Free Economic Zone Act, Foreign Residence and Residence Regulations in Free Economic Zone, Shinuiju Special Administrative District Law, Gaeseong Industrial Complex Act, Mt. Geumgang Tour Zone Law, etc. and it has been standardizing the economic management. However, North Korea has a very poor infrastructure which is one of the important factors of investment environment. Moreover, as North Korea has a socialist system, it carries a weak legal binding force comparing to other countries. North Korea has an attractive investment environment in terms of its rich natural resources and low-cost labor force. Besides, it has been trying to promote foreign investment by enacting the related laws. Despite this effort and such an investment environment, foreign investment is still being undertaken passively and many troubles have been arising. This paper will review the factors influencing the North Korea's openness, and analyze the efficiency and features of special economic zone policies.

Basically FDI-related legal system of North Korea seems insufficient to ensure the legal security regarding foreign investment owing to inexperienced and unskilled legislation of capitalist law. For instance, it has ambiguous legal words and concepts, and lacks consistency. Also it can`t guarantee investment effectiveness fully. Therefore a series of amendments to FDI-related laws of North Korea has to be done. Firstly, it has to make clear ambiguous legal words and concepts. Secondly, it has to streamline mutually conflicting laws and regulations. At the same time the North Korean government has to avoid the centralized control and operation of the governmental authorization process and change it`s passive attitude toward FDI.
