안보 목적의 온라인 정보수집제도 활용을 위한 수행체계 연구

현대암호와 보안기술의 발전으로 국가안보와 범죄수사를 위한 법집행기관의 감청이 불가능해지는 ‘암흑화(Going Dark)’ 상황을 맞아, 미국, 영국 등의 주요국들은 이에 대한 해결책으로 해킹수단을 활용한 온라인 정보수집을 법제도화하여 활용하고 있다. 온라인 정보수집은 그 효용성에도 불구하고 기본권 침해, IT 보안 훼손 등의 우려도 있어, 주요국들은 명확한 법제도와 통제장치를 마련하여 합리적으로 대응하고 있다. 유선 전화망 위주의 낙후된 감청체계를 유지하고 있는 우리나라도 달리 감청수단이 없는 현실에서 대테러, 방첩 등의 국가안보와 중대범죄에 대처하기 위해 온라인 정보수집을 감청으로 인정하고 이를 법제도화할 필요가 있다. 본 논문에서는 우리 환경에 적합한 온라인 정보수집제도 도입 및 활용을 위한 구체적인 운영원칙과 수행체계를 제안한다. 구체적으로는 온라인 정보수집의 동작 절차설계, 수집체계 구현원칙 제시, 수행조직의 분리배치, 수집도구의 투명한 관리체계 도입, 수집자료의 무결성 확보와 함께 법제도 마련, 운용상의 원칙 및 오남용 통제장치가 필요함을 제안한다. 제안된 수행원칙과 절차는 우리 법체계에 온라인 정보수집제도를 수용하기 위한 법률 및 표준 제정에 적극 활용될 것이다. The law enforcement agencies face the phase of ‘going dark’ that the conventional lawful interception for national security becomes impossible due to the development of modern encryption and cyber security technologies. In this regard, the major developed countries, such as the US and the UK, enact the online information collecting system by using hacking tools. Even though collecting information online is useful, there are also great concerns about the infringement of fundamental human rights and freedom of individuals and the impediment to IT security. Hence, those states set up the decent legal and control systems to respond to these concerns. Republic of Korea, on the other hand, sustains an old-fashioned wire-tapping system centered on the landline. It is necessary to legalize ‘online information collection’ in order to respond to the national security issues such as counterterrorism, counterespionage, and serious organized transnational crimes. This article examines specific operating principles and implementation systems for Korean government to properly collect information online. It consists of the procedural design of online information gathering, the principles for realization of collection system, the segmentation of performing organizations, the introduction of transparent management systems of collecting tools, the securement of integrity of collected data, the establishment of legal system, the operational rules, and the control devices preventing an improper use of information. The author hopes that the proposed performance principles and procedures would be positively reflected in enacting Korean laws and standards to adopt online information collection.
