노인복지법 규범의 정당성에 따른 비판적 분석에 관한 연구 -한국 노인복지법을 중심으로-

이 연구는 사회복지법의 규범적 정당성 관점에서 사회적 기본권으로서의 권리성, 대상자의 요건과 범위, 급여의 요건과 종류 및 수준, 국가의 책임성으로서의 임의규정과 강행규정 및 재정 부담 원칙, 그리고 노인인권보장이라는 준거 틀을 사용하여 노인복지법을 비판적으로 분석하기 위하여 수행되었다. 사회복지법은 헌법상 사회권 기본권이라는 근본규범으로부터 유래하는 것이며 사회적 기본권으로서 의 권리성이란 헌법상 기본권의 권리를 실현하고, 사회복지법의 대상자들을 권리의 주체로 인정해야 하며, 또한 권리의 명확화를 의미한다. 이것은 동시에 국가의 책임주체를 명확히 하여야 한다는 뜻이다. 그러므로 노인복지법의 제 조항은 헌법상의 국가 의무이행과 국민의 권리를 보장하는 이념과 원칙을 반영하여야 한다. 즉 노인복지법의 대상자인 노인을 권리의 주체로 인정해야하며, 국민의 기본권 보장 이라는 헌법상의 사회적 기본권으로서의 권리를 적극적으로 담보해 나가야 한다. 이 연구에서의 논의를 바탕으로 다음과 같이 제안하고 한다. 첫째, 사회적 기본권으로서의 권리성 확보를 하여야 한다. 둘째, 노인복지 대상자의 요건과 범위의 확대하여야 한다. 셋째, 노인복지 급여의 적절이 반영 되어야 한다. 넷째, 국가의 책임성 강화되어야 한다. 다섯째, 노인인권의 법적보장이 되어야 한다. 노인인권의 보장은 무엇보다도 법적인 보장이 담보되어야 한다. 선언이나 계획, 원칙, 강령 등으로는 실효적인 목표를 달성하는데 한계가 있을 수 있다. 노인인권에 관한 인식의 전환이 우선 전제되어야 하겠지만, 현재의 시대적ㆍ국가적 상황 하에서 고령자의 헌법상 사회보장권을 보다 체계적ㆍ효율적으로 실현할 수 있는 법적 보장을 확보하는 것이 가장 중요하다. 물론 이러한 법원칙은 고령자의 사회 보장권을 규정하고 있는 헌법을 비롯한 그 하위 법률의 제정원칙과 국제적 고령자보호 원칙 등을 총 체적으로 수용하면서도, 고령자라고 하는 특수계층에 대한 보호의 목적과 당위성을 구체화는 내용이 어야 한다. 이 연구는 비록 미시적인 수준에 불과하지만 노인복지법을 비롯한 사회복지관련 법의 규범적 정당성에 관한 논의의 시사점을 제공하는데 그 의의를 둔다. The purpose of this study is to examine the social rights of the social welfare law from the viewpoint of normative legitimacy, the right of social rights, the requirements and scope of the subject, the requirements and kinds and levels of benefits, the arbitrary rules and regulations, To analyze critically the elderly welfare law. The social welfare law derives from the fundamental norm of the fundamental right of the social right. The right as a social fundamental right is to realize the right of fundamental rights in the Constitution, to recognize the persons of the Social Welfare Act as the subject of rights, and also to clarify rights. At the same time, this means clarifying the responsibility of the state. Therefore, the Article of the Elderly Welfare Act should reflect the ideals and principles that guarantee the fulfillment of national obligations and the rights of the people in the Constitution. In other words, the elderly who are the target of the Welfare Act for the Elderly should be recognized as the subject of rights, and the rights of the basic rights of the people should be assured actively. Based on the discussion in this study, we propose the following. First, it should secure the rights as social fundamental rights. Second, the requirements and scope of elderly welfare subjects should be expanded. Third, the appropriateness of welfare benefits for the elderly should be reflected. Fourth, the responsibility of the state should be strengthened. Fifth, it should be a legal guarantee of the human rights of the elderly. The guarantee of the human rights of the elderly should be guaranteed the legal guarantee above all. Declarations, plans, principles, and codes may limit the achievement of effective goals. The transition of the perception of the human rights of the elderly should be a prerequisite, but it is most important to secure a legal guarantee to realize the social rights of the elderly in the systematic and efficient way under the current state of affairs. Of course, these legal principles embody the principles of the enactment of the lower law, including the Constitution, which prescribes the social security rights of the elderly, and the principles of the protection of the elderly, while elaborating the purpose and necessity of protecting the elderly Content should be. Although this study is only at a microscopic level, this study implies that it provides implications for the discussion of the normative justification of the social welfare law, including the elderly welfare law.
