일본에서는 예로부터 조정인은 인격적으로 훌륭한 ‘덕망가’이어야 하며, 교육이나 훈련에 의하여 양성되는 것이 아니라고 생각해 왔으나, 1990년대 부터 미국의 조정기법이 소개되고 다양한 논의를 거치면서 조정인 양성을 위한 교육이 필요하다는 생각이 일반화되어갔다. 그러다가 2004년에 ‘ADR법’이 제정되고 인증받은 ADR기관이 설립되면서 조정인의 양성에 대한 인식과 교육프로그램에 큰 변화를 가져왔다. 일본의 이러한 인식과 교육 프로그램의 변화는 우리나라에 다음과 같은 시사점을 주고 있다. 첫째, 일본은 정부가 주도하여 조정인 양성 교재를 제작하여 변호사회, 사법서사회 등에 보급하고 있다는 점이다. 우리나라에서도 정부나 법원이 우리나라에 맞는 조정인 양성교재를 개발하여 보급해야 할 것이다. 둘째, ADR법의 제정으로 인하여 민간조정을 활성화시킴과 동시에 조정인 양성에 대한 인식을 제고시켰다는 점이다. 우리나라에서도 ‘ADR법’의 제정을 통하여 인증받은 ADR기관을 설립하도록 해야 하며 이와 더불어 조정인 양성에 대한 사회적 인식을 제고시켜야 할 것이다. 셋째, 일본은 법원과 변호사회, 사법서사회 등이 중심이 되어 조정인 교육을 담당하고 있으며, 조정인 교육 프로그램 중 역할실연(role play) 등 실제적인 교육 프로그램을 중시하여 상당한 효과를 거두는 것으로 평가되고 있는 바, 우리나라에서도 법원이나 대한변호사협회 등에서 조정인 교육에 적극적인 역할을 해야 할 것이다. 넷째, 일본은 조정인 양성의 과제로서 법원과 변호사협회, 인접유사법률전문직, 민간형 ADR기관 등의 네트워크 형성과 협력을 강조하고 있는 바, 우리나라에서도 법원과 변호사회, 대한상사중재원, 그리고 행정기관 등이 네트워크를 형성하고, 법원이나 변호사회가 조정인 양성을 위하여 적극적으로 지원하는 시스템을 갖추는 것이 바람직하다. Japanese traditionally considered the mediators as excellent man of high moral repute and those are so born naturally that they could not be fostered by training or education. Introducing mediator techniques in U.S. to Japan as of 1990s, however, Japanese were so discussed on the education for training mediators that they concluded that the training sessions for mediators are required. As the ‘ADR law’ was enacted in 2004 and accredited ADR institutions were found, the awareness of Japanese as to fostering mediators and education programs was changed significantly. Such change in Japan brings us the following implications. First of all, Japanese government developed the textbooks for training mediators and distributed those books to the lawyer’s associations and judicial scrivener’s associations. It’s demanded to our government that developing and distributing such textbooks. Second of all, enacting ADR law in Japan vitalized private medication and enhanced the awareness as to fostering the mediators. In Korea, the ADR law should be enacted and accredited ADR institutions are needed to be found. Moreover, promoting the social awareness as to fostering mediators is required. Third of all, courts, lawyer’s associations, judicial scrivener’s associations are centered to educate preliminary mediators and they cherish the systematic and practical education program such as role play technique to obtain remarkable results. In Korea, courts and Korean Bar Association should take a role to educate and foster mediators. Fourth of all, Japanese puts stress on the networking and cooperating between courts, lawyer’s associations, related legal professionals, and private ADR institutes. Therefore, we should adopt such efforts in Japan to establish the system to promote networking and cooperating between courts, Korean Bar Association, Korean Commercial Arbitration Board, and administrative bodies.

『언해랍약증치방(諺解臘藥症治方)』의 납약에 대한 고찰 -『조선왕조실록(朝鮮王朝實錄)』과 『승정원일기(承政院日記)』를 중심으로-

Objective : Napyak has known as the herbal medicine, that kings of the Joseon dynasty bestowed on the royal officers around the last day of the each year. There are several researches on Napyak but those are focused the meaning itself, bibliographical studies on Unhaenapyakjeungchibang(which is the text related to Napyak), system in Joseon dynasty related to Napyak and so on. This articles is subject to research the real usage and medical meaning thrugh record of Joseon dynasty Method : Prescriptions of Unhaenapyakjeungchibang were browsed from the Annals of the Joseon Dynasty and the Royal Records of Royal Secretariat of the Joseon Dynasty and compared the main disease of prescriptions with the records above. Result : The main disease of prescriptions were corresponded with real usage records of the Annals of the Joseon Dynasty and the Royal Records of Royal Secretariat of the Joseon Dynasty except a few cases. And the new meaning of Napyak could be defined as the herbal medicine, that kings of the Joseon dynasty bestowed on the royal officers and all people to cure emergent disease around the last day of the each year. Conclusion : This research is for focusing the real usage of the Napyak thrugh Unhaenapyakjeungchibang prescription but this research is for the medical records of the Annals of the Joseon Dynasty and the Royal Records of Royal Secretariat of the Joseon Dynasty. Hereafter, the medical records researches could be conducted by real usage of prescriptions.

加味歸脾湯이 環境호르몬및 Apomorpine HCl에 의해 유도된 고양이의 勃起能에 미치는 影響

The effect of Gamigyuibitang on the penile erection induced by apomorphine HCl and on the erectile dysfunction induced by p,p-DDE, an environmental hormone derivate of DDT, were monitored using male cats. The changes of penile length, diameter &rectic periods were observed. The results were as followed. 1. After induction of penile erection using apomorphine HCl, penile lengths in the Gamigyuinitang-dosing groups were significantly and dose-dependently increased compared to that of single dose of apomorphine HCl (ApG1 and ApG2) and p,p-DDE dosing group (DDEG). 2. After induction of penile erection using apomorphine HCl, penile diameters in the Gamigyuinitang-dosing groups were significantly and dose-dependently increased compared to that of single dose of apomorphine HCl (ApG1 and ApG2) and p,p-DDE dosing group (DDEG). 3. After induction of penile erection using apomorphine HCl, erectic periods in the Gamigyuinitang-dosing groups were significantly and dose-dependently increased compared to that of single dose of apomorphine HCl (ApG1 and ApG2) and p,p-DDE dosing group (DDEG). In conclusion, dose-dependent and significant increase of penile length, diameter &rectic periods were detected in the Gamigyuibitang-dosing groups compared to other groups. According to these results, it is considered that Gamigyuibitang has some augmentation effect against to apomorphine HCl inducing penile erection and it also suggested that Gamigyuibitang has favorable effect to treatment of erectic dysfunctions induced by p,p-DDE.
