미국의 SPS 관련 법적규제 체계와 WTO 분쟁사례연구

본 논문은 WTO/SPS 협정과 함께 SPS 관련 최대 제소국이자 피소국인 미국의 SPS 규제 체계, 미국의 SPS 분쟁실태와 분쟁사례를 분석해 봄으로써 시사점을 얻어내고 향후 한국의 SPS 관련 정책과 제도적 방향을 찾아 보는데 목적을 두고 있다. 연구 결과를 요약하면 첫째, 현행 WTO/SPS 협정상에는 교역국 간에 분쟁 발생 시 논란이 될 수 있는 조항들이 다수 존재한다는 점을 알 수 있다. 둘째, 미국의 SPS 법규 체계가 매우 광범위하고 복잡하여 그것이 미국과 교역국 간에 중요한 SPS 분쟁 발생의 배경을 이루고 있다. 셋째, SPS 분쟁사례를 보면 모든 분쟁에서 과학적 근거 제시와 고도의 위험평가능력을 요구하고 있다. 따라서 과학수준이 낮고 위험평가능력이 부족한 국가들은 SPS 분쟁에서 피해를 볼 수밖에 없다. 따라서 향후 한국도 선도적으로 위생검역제도를 재정비해 나가야 함은 물론 고도의 전문인력 양성, 선진국 등 타국과의 정보교류 등 협력체제 구축이 적극적으로 추진되어야 한다고 판단된다. This paper aims at finding and proposing Korea’s desirable policies and systems SPS measures in future by reviewing WTO/SPS Agreement, the U.S. legal frameworks of SPS measures and the cases of the related disputes in WTO. As a result of this study, the authors found several meaningful points. Firstly, there are many articles and words which can bring forth controversies between WTO members in the process of SPS related disputes. Secondly, U.S. legal frameworks related to SPS measures are very complicated and strong in comparison with other countries, and its complexity and strictness are being one of major cause of frequent dispute. Thirdly, as a result of analyzing the cases of disputes in which U.S. involved as complainant and respondent, the authors found that the high-level scientific knowledge and capability are needed to evaluate risks in relation to SPS measures. Therefore, Korea has to reset its SPS systems positively, cultivate many of professional manpowers and build up the close cooperative systems including exchange of SPS informations with the advanced countries.
