Not that long ago, waste was not a term that would concern the science of political economics or that of law. In simple agrarian societies with low numbers of population, wastes did not cause any social problems, since they were easily absorbed into nature through self-purification processes. However, with the advent of industrial mass production, human beings started generating a much more massive amount of waste. In addition, as many of those wastes do not decompose readily anymore, these issues have become urgent and require government action,
Waste has become a boarder-transcending problem that almost every nation faces to ing degrees. This struggle with waste problems occurs even though those nations exercise varied management policies in accordance with their unique social, political, economical, and geographical circumstances. There are, though, some common denominators. Most nations are adopting 3R policies (Reduction, Reusing, and Recycling) in order to properly manage wastes. The proper management of wastes has become a primary concern in maintaining a high quality of life on a national level as well as in endeavours to save the global environment.
It is in that context, that this study proposes plans to reform Korea's legal system by reviewing the current Korean waste laws and their implicit shortcomings and by conducting a comparative study on legal systems of waste-related laws in selected foreign countries.
The most critical shortcoming of Korea's waste-related laws is the multitude of different laws concerned with waste management, eventually hindering the public from understanding their legal structure as well as the effective enforcement of those laws. Moreover, the logical coherence and the interrelations in the chain of those legal structures are not clarified in regard to the relevant laws, residential ordinances and ministerial decrees. Neither the objective nor the philosophy or the basic guidelines of those laws are stipulated, and the definition of some critical concepts remains unclear. It also turns out that there are oversimplifications in the classification of wastes, insufficient subordinate regulations to enforce higher-ranked regulations, vague delegations of waste treatment responsibilities among related agencies, and so on.
This dissertation is concerned with a comparative study on the legal systems of waste related laws in Germany, the United States and Japan, scrutinizing historical trends of those countries waste policies and related laws, basic guidelines and philosophies of the pertinent laws and characteristics of waste management. In particular, this paper focuses on developing plans for reforming Korea's legal system by identifying and researching those nations pivotal waste laws with special emphasis on the "Recycling Economy and Waste Law" of Germany.
First of all, this dissertation proposes integrating separate waste-related laws into one comprehensive body of law which could be called Proper Waste Management Law. It specifically spells out the legal structure and contents that this proposed act should stipulate. It includes recommendations for reforming the shortcomings that were pointed out in regard to the current waste-related laws, for example, the lack of clarification of philosophies and basic guidelines, the reformation of the classification systems of waste, and the establishment of delegation principles of waste treatment responsibilities among agencies.
Finally, this dissertation proposes specific policies in the context of waste management. It ties to devise an alternative model for the national waste management system that includes enlarging the legislative power of the local governments, promoting measures for toxic waste management, strengthening penalties for violating waste management laws, restructuring regulations concerning waste deposing businesses, and system of deposit-refunds and waste generation charges, among others.
