성 매매 경험 청소년의 재활을 위한 복지방안의 연구 : 원조교제 여자청소년을 중심으로 = (A) Study on the Rehabilitation and Welfare of Teenage Female having experience of Sex for money

국문 초록 (Abstract)

청소년기 성장과 발달의 독특성으로 인해 청소년은 사회복지의 중요한 대상으로 부상하고 있다. 그럼에도 불구하고 청소년복지는 아동복지의 연장선상에서 논의되는 경우가 많았고, 청소년복지를 담당하는 기관들도 최근에야 법적, 제도적 근거를 마련하였다. 청소년의 복지를 증진하고 청소년의 각종문제를 예방하고 대안을 찾기 위해서는 청소년에 대한 객관적이고 과학적인 이해가 선행되어야 한다. 청소년에 대한 올바른 이해의 첫걸음은 청소년의 성을 이해하는 것이며, 청소년 성의 이해 없이는 청소년의 이해나 청소년 복지를 논하기 어렵다.
그럼에도 불구하고 오늘날 우리나라의 청소년 성 문제에 대한 각계의 접근은 현재의 환경변화를 충분히 반영하지 못하고 성에 대한 생물학적 지식 중심이나 기성세대의 의식을 강요하는 등의 부적절한 대책으로 일관해 오고 있는 실정이다. 이러한 맥락에서 연구자는 성 매매 경험이 있는 여자 청소년들을 어두운 과거에서 이끌어내어 밝은 미래에로 인도할 수 있는 길을 마련해 주기 위한 복지대책을 찾는데 그 목적을 두었다. 지금까지 청소년 성 문제와 관련한 연구가 주로 청소년이 일방적으로 성폭력이나 성 학대의 피해자인 경우, 그렇지 아니하면 이른바 원조교제라는 이름으로 벌어진 성인들의 성 문란 행위의 피해자인 청소년에 관한 것이었다. 그러나 본 연구에서는 성을 대가로 자발적인 행위에 나선 경험을 가진 여자 청소년들이 그와 같은 성 매매 행위에 빠져들게 된 원인 및 동기와 특성을 규명하는 것에서부터 시작하여 그러한 성 매매 경험 청소년을 더 이상의 불행 없이 사회에 정착시킬 수 있는 사회복지적 재활 방안을 제시하고 저 하는 것이다. 본 연구에서는 광범위한 성 매매 행위 가운데서도 청소년이 자발적(voluntarily)이고 주도적(initiatively)으로 참여하는 경우로 한정하였다.
연구자는 본 연구에서 성 매매 경험이 있는 청소년에 대한 복지의 재활을 다루기 전에 청소년 개념과 청소년의 인간 발달적 특성을 살펴보았으며, 청소년 복지에 대하여서는 교육, 심리학적으로 그들을 이해하는 것부터 시작하였다. 특히 성 매매 경험을 가진 청소년을 위한 복지를 수행하기 위하여서는 성 매매 경험 청소년들이 그들의 행위 이후에 어떠한 반응을 보이는가를 살펴보았는데, 대부분의 경험자들이 자신들의 행위에 대하여 반성이나 후회보다는 하나의 일(아르바이트)이나 별로 비난받을 행위가 아니라는 태도를 보이고 있다. 그럼에도 그들에게서 찾을 수 있는 것은 기성사회에 대한 냉소와 비판, 원망적인 표현과 반응을 보이고 있다.
본 연구에서 청소년에 대한 무조건적인 금지적 차원의 성교육에 대한 반성과 함께 자유로운 인격체로 성장해 가고 있는 우리의 청소년에게 자의식을 심어주는 차원의 예방과 치료적 차원의 복지 서비스를 제공하는 방안을 제시하였으며, 성 매매 경험 청소년을 위한 복지방안으로는 치료적 복지와 예방적 복지로 나누고, 성 매매 경험 청소년이 마침내 포함될 수밖에 없는 미혼모로서의 복지문제까지를 다루었다는 점에 의의가 있다.
성 매매 경험 청소년에 대한 예방적 복지에서는 청소년들이 부적절한 성관계에 빠지지 아니하도록 청소년 대상의 성교육제도를 개선할 것, 지역 사회복지관이 청소년 성 문제와 성교육에 적극적인 역할을 할 것, 그리고 성 매매 장소 등에 대한 법적 규제를 강화해 나갈 것을 제시하였고, 치료적 복지 방안으로는 선도시설의 적극적 개입과 활용, 성 매매 청소년을 의료보험의 수급대상자로 포함시키는 일, 전문치료상담사의 양성을 통하여 성 매매 경험 청소년에게 재활을 통한 심리적, 육체적 건강을 회복시키는 일, 국가나 지방자치단체 등의 직업보도, 재정지원 강화를 구체적으로 제시 성 매매 행위를 재차 행하지 않도록 하는 방안을 제시하였다. 특히 청소년 미혼모를 위한 복지방안에서는 외국의 미혼모를 위한 복지정책과 방안을 예를 들어 제시하여 우리나라 미혼모에 대한 현행 복지정책의 문제점을 지적하고 그 개선점을 제시하고 있다.

다국어 초록 (Multilingual Abstract)

The purpose of this thesis is to investigate the female adolescent's sexual experience on the standpoint of the cause, motive and consequence of the act, and to find rehabilitation and social welfare program for the teenage female having experience of Sex for money or any other consideration. So, this study differs from the precedent researches on sexual misuse by adults or juvenile sexual problem itself. In this study, two topics: The one is sexual experience as unhappy events and the other is how to solve the unhappy result. I suggested that the female adolescent's meeting with adult for sex for money or other compensation should not be treated as 'another type of prostitution'. Although female adolescents meet male adults for money or enjoy, it is not absolutely correct to blame the girls alone for their reckless or advert action. We all the society and adults are responsible for their acts and unhappiness. This means the social welfare programs and certain rehabilitation plans are necessary, urgently.
This study consists of 6 chapters including the introduction and brief conclusion. The main parts of the thesis are the Status quo of adolescents' sexual misuse and its characteristics(chapter 2.), Principles and basic rules of social welfare for juvenile(chapter 3.) and concrete programs for rehabilitation and welfare support for the experienced female(chapter 4.). This study treats the problems of so to say unmarried mothers through sexual experience as a part of social welfare and rehabilitation policy. This makes this study unique.
As social welfare program can be considered:
Treatment of mental or physical wound by rehabilitation facilities, hospitals and social insurance system(especially, unmarried mothers should be included in medicare in order that the sexual experienced female need not to pay from their own pocket and so not to hesitate from opening their problem), specially trained counselors dispatched promptly for the unhappy cases, job recommendation and training and education for getting on own feet. Unmarried mothers are women who are pregnant or already gave birth to a child without legitimate and appropriate marriage. They are likely to be alienated socially and politically. They tend to be isolated even from their own family. So are their children. Without personal ability and economic support to solve their problems, they need the help of social welfare institutions of the government. The laws and policy should be made model after pattern of foreign countries like Scandinavia, Germany and so on. To prevent the further sexual misuse social institutes and welfare professionals should pay every effort. Sexual education must also be enhanced. Every chances and opportunity allowing inappropriate sexual misuse should be at the first stage strictly deterred and prohibited.
