Article 8 of the 5th Republic Constitution reads “The State shall strive to sustain and develop the cultural heritage and to enhance national culture.” And, Article 1 of the Law for the Protection of Cultural Properties reads “The purpose of this law shall be to contribute to the cultural advancement of the general public and to the cultural development of the world.” In the rapidly developing country like Korea, however, the cultural remains are apt to be damaged or lost, in case legislation concerned is insufficient.
It seems to be necessary to investigate into the development of existing law on cultural properties and to propose how to preserve them effectively and legally.
Cultural properties are the remains of folk-culture which deserve to be preserved. They are to be perished, but for proper protecting measures. Therefore each nation is putting in order the legal system for the protection of cultural properties and taking all the possible measures for their maintenance and utilization.
The destructions of cultural and historical circumstances, which are due to the extensive effect of the national land development, have at last brought about people's longing for 'Cultural Age'.
Cultural properties are never restored, however, if once destroyed and their value disappears if their forms are altered.

This dissertation purports to review the historical background of the Law for the Protection of Cultural Properties of Korea and to specify the import of cultural properties. The dissertation also examines the actual aspects of cultural properties protection in some other countries.
The national land development in highly industrialized societies has destroyed cultural properties, no less than the war, while the historical environments have been destroyed under the name of developments.
Such situations made some fore-runners and local inhabitants arouse a movement for the protection of cultural properties. The movement has eventually developed into an action for the people's enjoying right of cultural properties.
Many remains have been destroyed in Japan whose legal system is very much similar to that of Korea. Eventually the movement for protecting cultural properties has developed into the administrative litigation from the inhabitant's action. The IBA Ruins Case carried into court as the first appeal attracts public attention in terms of the plaintiff qualification and the enjoyment right of cultural properties.
That case is currently under the state of closing trial in the Appellate Court. Judging from judicial precedent in Japan's courts, the plaintiff does not seem to win the suit.
III
This kind of dillemma, shown in Japan today, between the land development and the preservation of cultural properties, will be brought up in Korea sooner or later.
Making reference to Japan's cases, this dissertation attempts to propose a new legal principles of enjoying cultural properties in terms of the relationship between the two propositions.
All the possible preparatory legal systems for the protection of cultural properties are also examined in the dissertation.
In connection with the latter problem, it is suggested that the cultural properties committee should necessary become deiberation organization, and local organizations and reserch institutes should participate in the protection and utilization of cultural properties.
The importance is pointed out to establish the administrative procedures for designating or annulling cultural property items and for their protection from the national land development. This problem remains, however, open to further investigation.
