It probably seems that the emerging trend is the enormous jump of the Internet user populations and the prompt development of a new Information Technology, and if that is so, we must recognize that the electronic commerce("e-commerce") based on the Internet is increasing rapidly year after year. In fact, it is presented by some or other reports that the volume of business to consumer("B2") e-commerce market have amounted to 1,011 hundred million dollars as of June, 2001 all over the world. According to this, we have an anticipation that the volume will amount to 4,281 hundred million dollars in the year 2004.
When a new transaction in the trade business as it is called e-commerce bursts into sight, and the turnover of e-commerce is increasing step by step, the disputes in the transaction("e-disputes") also rises gradually. As everyone knows, one of the characteristics which is apt to attach e-commerce is that e-commerce has no national boundries. When e-disputes break out, therefore, the settlement of these disputes almost depends upon this or that litigation, but an litigation is as likely as not beseted with the questions of which authorities have jurisdiction, which law applies, international court proceedings etc. that bring difficulties in its train, for example, the superfluous time and expense required. Thus, we must settle e-disputes, in effect, not by a common litigation but by arbitration, mediation, and conciliation etc., that is to say, Alternative Disputes Resolution("ADR"), which gives to the interested parties a reasonable resolution on the ground of the comprehensive judgment from the technology concerned, the legal questions, and transaction interests without wasting of time and expense.
There is already lively discussions on ADR-its necessity and principles, as resolution for e-disputes within the international organization, the US, the EU, and some private organization. In relation to this, it seems that ADR based on the on-line has an especial fitness, as resolution for e-disputes. Of course, we have not still the uniform rules or regulations for ADR, but yet we have reached an agreement in principle that ADR should be independent, impartial, easily accessible to disputes parties, free or low cost, guarantee on transparent resolution procedures, enforced or required compliance on the parties concerned. ADR is conducted by the Korean Commercial Abitration Board("KCAB"), Korea Institue for Electronic Commerce("KIEC"), and Korea Consumer Protection Board in our country("KCPB"). On the other hand, in other countries, the web sites, which use the various technologies and provide the on-line ADR services for disputes parties, already open and play a part in.
This study is an attempt to investigate some various trends, the actual operation conditions, and the problems in operation in relation to ADR, which is for the settlement of e-disputes rising from the business to consumer e-commerce, in the international organizations or foreign countries, and moreover the developmental possibility of ADR in our country. In sum, the product of this study is as follows:
Firstly, ADR for the settlement of e-disputes in our country is now decentalized into various organizations, for example KCAB, KIEC, KCPB etc., but it is necessary to centralize all the e-disputes for the settlement in E-Commerce Mediation Commitee("ECMC") in KIEC.
Secondly, the disputes mediation decision of ECMC must carry legal binding force to have a practical efficacy. If that decision carries no legal binding force but merely recommendatory one, the decision won't have an effect on the settlement for e-disputes.
Thirdly, it is necessity to revitalize the Cyber Mediation Center in ECMC, depending upon the introduction of advanced technology from foreign ADR services(e.g. automated system, ADR system combined trustmark, etc.). But, it is also necessary to supplement such technological matters as party authentication, security and the like.
Fourthly, we must examine the legal matters related to internal ADR procedures and decision in order to have internationally practical enforceability, and also the technological matters related to cultural-linguistic differences between many countries to provide disputes parties concerned with the on-line services.
Finally, we must instruct disputes parties in ADR, inform of ADR in order to the activation and success of the settlement for e-disputes based on ADR.
