靑少年 有害業所의 實態와 靑少年保護方案에 관한 硏究 = (A) study on the conditions of the entertainment businesses detrimental to the youth and the reform measures for protection of the youth

Only if our youth grow up correct and sound, we will have a hope for the future. For the youth will be the actors leading our society in the future. Thus, this study focuses on the “entertainment businesses detrimental to our youth”, or a part of the environment obstructing the sound growth of our youth. The environment detrimental to the youth may be a comprehensive concept covering a variety of physical, social and psychological environments impeding the sound growth and development of the youth as well as the interchanges between youth and these environments. This study was aimed at reviewing the conditions and problems of the entertainment businesses, a part of the detrimental environment, and thereby, suggesting the ways to protect our youth from those entertainment businesses. The results of this study can be summarized as follows; The problems of the entertainment businesses are that they admit the youth illegally or employ the youth for their interests. The illegal admission of the youth by the shameless entertainment businesses create various causes for the juvenile delinquencies, and the illegal employment of the youth by them is intended to exploit the youth to save their cost. Furthermore, the illegal employment entices the youth away from home or school only to have the youth fall into delinquencies. Such malpractices conducted by the entertainment businesses may be equated with the infringement on human rights or the offenses making our youth ruined emotionally, which must be a serious social problem. The reasons for the increasing entertainment businesses admitting or employing the youth may be explained in sociological terms, though complicated; the Korean society has witnessed an ‘anomie’ or conflicts between economic growth and cultural stagnation. 국문 초록 (Abstract)

靑少年이 바르고 健全하게 成長해야 미래의 희망이 있는 것이다. 靑少年은 장차 사회를 이끌고 갈 主役으로 되기 때문이다. 靑少年 有害環境이란 靑少年이 健全하게 成長·發展하는데 有害한 영향을 미치는 각종 物理的·社會的·心理的 環境들과 靑少年과 이러한 環境들간의 相互作用을 總稱하는 包括的 槪念이다.本 論文의 핵심은“靑少年 有害業所”인데 청소년 유해업소는 청소년 有害環境의 작은 하나의 요소이다 本 硏究는 物理的 環境중 有害業所의 實態와 問題點 그리고 改善과 靑少年 保護方案을 提示하였다. 靑少年 有害業所에서 문제가 되는 것은 出入이 허용되지 않는 靑少年을 不法 出入시키고 또한 不法으로 業所에 고용하는 것이다. 불법 출입은 靑少年 非行의 여러 原因이 되며 불법고용은 業主들이 값싼 노동력의 원천으로 惡用하고 靑少年들에게 家出이나 學業中斷 등을 조장하여 탈선의 길로 빠져들게 하여 결과적으로 人權蹂躪과 정서적 荒廢化를 겪는 등 사회문제가 되고 있다. 靑少年 有害業所가 늘어나고 靑少年의 不法出入 고용이 되는 이유는 한국사회의 構造的 문제로서 經濟發展 과정에서의 經濟와 文化가 부합되지 않는‘Anomi’를 겪으면서 不正腐敗, 賂物, 돈만 벌면 다 된다는 풍조, 享樂産業, 그릇된 飮酒文化, 퇴폐적 性 文化 등이 複合的으로 작용하였기 때문이다. 靑少年 有害業所의 分布實態는 도시 中心部나 新都市 주변에 대단위 유흥단지가 造成 되었으며 또한 주택가 곳곳까지 業所들이 파고들고 있다. 靑少年의 有害業所 接觸實態는 娛樂性 有害業所인 전자오락실, 만화방, 노래방, 비디오방, pc방 등은 청소년의 70-80%가 利用經驗이 있었다. 成人用 有害
